Box 1179 54375 State Route 25 Southold, NY 11971 (cor.Main Rd. &Youngs Ave.) cagy =.c Southold, NY 11971 Telephone: 631 765-1938 LOCAL WATERFRONT REVITALIZATION PROGRAM TOWN OF SOUTHOLD MEMORANDUM To: Michael Domino, President Town of Southold Board of Trustees From: Mark Terry, LWRP Coordinator Date: July 17, 2017 Re: LWRP Coastal Consistency Review fo NICHOLAS & BARBARA PALLANTE r SCTM# 1000-111-14-30 Michael Kimack on behalf of NICHOLAS & BARBARA PALLANTE requests a Wetland Permit to dredge approximately 400 cubic yards of spoil within an approximate 63'x68' (±4,284sq.ft.) area; use approximately 120 cubic yards of dredge spoil to construct a surrounding berm and dispose of the remainder dredge spoils to an approved upland site; construct a ±275 linear foot earthen berm approximately 2' in height with 1 on 3 sides surrounding excavated area; provide a ±320 linear foot long silt fence surround with staked bales around berm; construct steel drop weir within excavated area with outfall pipe to return clarified water to pond; area to be dredged using a long-arm excavator and deposited in excavated area; ±5,000sq.ft. dredging area to be contained'by floating booms and silt screening; dredge spoils disposal area to be restored to conditions that existed prior to excavation and spoils deposition; excess excavated material not used in restoration and to be disposed in an approved upland site; and to remove five (5) trees on the property consisting of one (1) 24" caliper; three (3) 6" caliper, and one (1) 2" caliper. SCTM# 1000-111-14-30 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my determination that the proposed actions are INCONSISTENT with the below listed LWRP policy and therefore are INCONSISTENT with the LWRP: The trees to be removed are not shown on the plans 6.3 Protect and restore tidal and freshwater wetlands. The applicant has not demonstrated that the following dock standards pursuant to § 275-11. Construction and operation standards have been met. Erosion control. Installation of an erosion control structure is necessary during any building, grading, landscaping or site work activity within Trustee jurisdiction. This structure may include, but is not limited to, installation of a silt fence, hay bales, wood chip berm and silt booms. The placement of the erosion control structure(s) shall be determined by the Trustees or their designee. All intertidal construction and excavation requires the installation of a silt boom that will retain all suspended sediments within the immediate project area. Turbidity controls such as a floating turbidity screen are not shown on plans. (3) Dredging. LgLCreeks. LIJ Only maintenance dredging (as defined in §275-2 is permitted, unless the applicant owns underwater land or the applicant is requesting permission to dredge in connection with installation of low-sill bulkheads. All maintenance dredging permits shall be valid for a period no greater than 10 years. [Amended 12-18-2007 by L.L. No. 23-20071 Dredging may be permitted when it can be demonstrated that the actions of man have resulted in impairment to water quality or habitat value. The applicant has not demonstrated that water quality or habitat values have been impacted. The Town's shallow creeks provide important ecological benefits to the health of the Peconic Estuary. Adverse impacts (removal, death) to the marine benthic community are expected as result of the proposed dredging activity. The dredging appears to be proposed to support the use of the waterbody for large, private, recreational vessels. Large recreational vessels that require deeper waters for safe operation should be moored in areas with adequate water depth (marinas). Q Dredging in, or in close proximity to salt marsh vegetation (Distichlis spicata, Spartina alterniflora or Spartina patens) or seagrass (Ruppia maritia or Zostera marina) meadows is prohibited. The dredging is in close proximity to intertidal fringe marsh on portions of the subject and surrounding properties. 9.3 Preserve the public interest in and use of lands and waters held in public trust by the state and the Town of Southold. A. Limit grants, leases, easements, permits or lesser interest in lands underwater in accordance with an assessment of potential adverse impacts of the proposed use, structure, or facility on public interest in public lands under water. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed actions.
