Cardinale SCTM# 1000-122-3-1.5 ALAN A. CARDINALE requests a Wetland Permit to construct a communal dock serving Lots 1.5. 1.7, 1.8 & 1.9 consisting of a 4' wide wooden ramp at landward end connecting to a 4'x34' fixed wooden dock with a 4'x40' fixed "L" section; two 3'x14' adjustable ramps off of either end of 40' fixed dock section; two 6'x20' floating docks situated in an "I" configuration with two (2) 8" diameter float securing piles for each float; two (2) 8" diameter tie-off piles centered between the two floating docks; and two sets of two (2) 8" diameter tie-off piles situated approximately 13' away from each floating dock. Located: 570 Private Road #28, Mattituck. SCTM# 1000-122-3-1.5 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the action is INCONSISTENT with the below listed Policy Standards and therefore is INCONSISTENT with LWRP. 6.3. Protect and restore tidal and freshwater wetlands. A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction 1. Comply with Trustee regulations and recommendations as set forth in Trustee permit conditions. The applicant must demonstrate that the following dock standards pursuant to § 275-11. Construction and operation standards have been met. 9 7 Y (d) Review and approval of dock applications. Before issuing a permit for a dock structure, the Trustees shall consider whether the dock will have any of the following harmful effects: [1] Whether the dock will impair navigation or be located in areas of high vessel traffic or vessel congestion; The applicant has not demonstrated that the dock structure with a vessel moored would not extend into navigable waters and impair navigability. The 1/3 rule assessment must include a representative vessel. A large vessel moored to the dock could hinder or impede navigation of the narrow channel depending on length. [2] Whether the dock will unduly interfere with the public use of waterways for swimming, boating, fishing, shellfishing, waterskiing and other water- dependent activities; j41 Whether the dock will significantly impair the use or value of waterfront property adjacent to or near the dock, [5] Whether the dock will cause degradation of surface water quality and natural resources, The number of boats proposed to be moored at the dock has not been discussed. High density of vessels within a water body prompts NYSDEC officials to administratively close areas to shellfishing due to threat of bacteria loading. The waterbody contains two marina uses currently and a high density of vessels cumulatively affecting water quality is a concern. [11] Whether the cumulative impacts of a residential and commercial dock will change the waterway or the environment and whether alternate design, construction, and location of the dock will minimize cumulative impacts, and The dock is proposed to serve 5 residential lots, the number of maximum vessels that could be moored to the dock at any given time has not been provided. Throughout Peconic Bay and Gardiners Bay (Reaches 5 through 9) approximately two hundred and forty five (245±) public and quasi-public access points have been established to allow for public access to the foreshore and nearshore (navigable) waters. These public access points include; public and private marinas; park district, town and state boat launch facilities; town and state road ends and private parks and road ends. Currently, there are approximately forty (40) public and private marinas and nineteen (19) boat launch facilities available to the public to gain access to Peconic Bay and Gardiners Bay. Public access can also be gained by utilizing numerous rights-of-way at the end of public roads. This is an effective means of gaining access to the public trust lands. [12] Whether adequate facilities are available to boat owners and/or operators for fueling, discharge of waste and rubbish, electrical service and water service. The disposal of sanitary waste on vessels and wash down chemicals capable of adversely affecting water quality has not been discussed. 9.3 Preserve the public interest in and use of lands and waters held in public trust by the state and the Town of Southold. A. Limit grants, leases, easements, permits or lesser interest in lands underwater in accordance with an assessment of potential adverse impacts of the proposed use, structure, or facility on public interest in public lands under water. The establishment of a communal dock furthers this policy by limiting the number of docks over sensitive wetlands. Nevertheless, the proposed dock structure will extend into public trust waters resulting in a net decrease in public access to public underwater lands and the nearshore area. Private dock structures extending into public trust lands and waters obstruct public use of waters and bottomlands held in public trust in the area where the dock is located and does not meet this policy.
