Box 1179 54375 State Route 25 3 Southold, NY 11971 (cor.Main Rd. &Youngs Ave.) Southold, NY 11971 Telephone: 631 765-1938 COUa LOCAL WATERFRONT REVITALIZATION PROGRAM TOWN OF SOUTHOLD MEMORANDUM To: Michael Domino, President Town of Southold Board of Trustees From: Mark Terry, LWRP Coordinator Date: June 14, 2017 Re: LWRP Coastal Consistency Review for 675 HILL ROAD, LLC, c/o GLENN HEIDTMANN SCTM# 1000-70-4-28 Suffolk Environmental Consulting on behalf of 675 HILL ROAD, LLC, c/o GLENN HEIDTMANN requests a Wetland Permit to construct a dock consisting of a 4'x6' entry ramp secured by two (2) 6"x6" posts; 4'x7' steps secured by four(4) 6"xT posts; 4'x15' elevated catwalk supported by four (4) 6"x6" posts; a 3'x15' hinged ramp; and a 6'x20' floating dock secured by four(4) 8"x8" pilings. Located: 675 Hill Road, Southold. SCTM# 1000-70-4-28 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is INCONSISTENT with LWRP Policy 6, specifically 6.3 (below) and therefore, INCONSISTENT with the LWRP. The following needs to be addressed. The applicant must demonstrate that the following dock standards pursuant to § 275-11. Construction and operation standards have been met. (d) Review and approval of dock applications. Before issuing a permit for a dock structure, the Trustees shall consider whether the dock will have any of the following harmful' effects: [1] Whether the dock will impair navigation or be located in areas of high vessel traffic or vessel congestion The dock measures 55' to the opposite shoreline not accounting for the existing docks opposite the structure or vessels moored. The impediment to navigation of the waterway could be large, narrowing the navigable channel and causing a potential safety risk. The channel appears to be along the northern shoreline where the dock is proposed. (2] Whether the dock will unduly interfere with the public use of waterways for swimming, boating, fishing, shellfishing, waterskiing and other water-dependant activities; See above comment. [5] Whether the dock will cause degradation of surface water quality and natural resources, [11] Whether the cumulative impacts of a residential and commercial dock will change the waterway or the environment and whether alternate design, construction, and location of the dock will minimize cumulative impacts; and [12] Whether adequate facilities are available to boat owners and/or operators for fueling, discharge of waste and rubbish, electrical service and water service. 9.3 Preserve the public interest in and use of lands and waters held in public trust by the state and the Town of Southold. A. Limit grants, leases, easements, permits or lesser interest in lands underwater in accordance with an assessment of potential adverse impacts of the proposed use, structure, or facility on public interest in public lands under water. It is recommended that the proposed dock structure is designed to not extend into public trust waters resulting in a net decrease in public access to public underwater lands to the greatest extent practicable. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. Town of Southold LWRP CONSISTENCY ASSESSMENT FORM JUN 0 9 2017 A. INSTRUCTIONS Southold TownPlanning Board 1. All applicants for permits* including Town of Southold agencies, shall complete this CCAF for proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This assessment is intended to supplement other information used by a Town of Southold agency in making a determination of consistency. *Except minor exempt actions including Building Permits and other ministerial permits not located within the Coastal Erosion Hazard Area. 2. Before answering the questions in Section C,the preparer of this form should review the exempt minor action list, policies and explanations of each policy contained in the Town of Southold Local Waterfront Revitalization Program. A proposed action will be evaluated as to its significant beneficial and adverse effects upon the coastal area(which includes all of Southold Town). 3. If any question in Section C on this form is answered"yes" or"no",then the proposed action will affect the achievement of the LWRP policy standards and conditions contained in the consistency review law. Thus,each answer must be explained in detail,listing both supporting and non- supportin%!facts.. If an action cannot be certified as consistent with the LWRP policy standards and conditions,it shall not be undertaken. A copy of the LWRP is available in the following places: online at the Town of Southold's website (southoldtown.northfork.net),the Board of Trustees Office,the Planning Department, all local libraries and the Town Clerk's office. Foster a pattern of development in the Town of Southold that enhances community character, preserves open space,makes efficient use of infrastructure,makes beneficial use of a coastal location,and minimizes adverse effects of development. See LWRP Section III—Policies;Page 2 for evaluation criteria. ® Yes ❑ No ❑ Not Applicable Subject proposal is consistent with the policy in that the siting/utilization of the dock will maintain the character of the surrounding neighborhood, which currently consists of many similarly-improved residential lots with similar shoreline structures (i.e. docks). In addition, subject proposal will be in harmony with the"...beneficial use of a coastal location..." in that the dock requires its coastal location. Accordingly, we believe that this project is consistent with this policy. Attach additional sheets if necessary Policy 2.
