The structure is a groin.
Suffolk Environmental Consulting on behalf of RICHARD J. MAY requests a Wetland Permit to
reconstruct the existing ±76.0' long timber jetty along the southern shoreline by reducing the
overall length to ±68.0' (to extend to the ALW); jetty is not to exceed 2.5' above grade; the use of
vinyl sheathing; TxT timber waters; and 8"— 10" diameter timber pilings staggered on either side.

The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment Form
submitted to this department, as well as the records available to me, it is my recommendation that
the proposed action is CONSISTENT with the LWRP policies and therefore CONSISTENT with the
LWRP provided the following is required for further Policies 5 and 6.
1. Require a vegetated non-turf buffer landward of the bulkhead incorporating existing,
native, salt tolerant vegetation.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its
written determination regarding the consistency of the proposed action.

LWRP CONSISTENCY ASSESSMENT FORM - Planning Board
A. INSTRUCTIONS
1. All applicants for permits* including Town of Southold agencies, shall complete this CCAF for
proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
making a determination of consistency. *Except minor exempt actions including Building Permits
and other ministerial permits not located within the Coastal Erosion Hazard Area.
2. Before answering the questions in Section C,the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfront Revitalization Program. A proposed action will be evaluated as to its significant
beneficial and adverse effects upon the coastal area(which includes all of Southold Town).
3. If any question in Section C on this form is answered"yes" or"no", then the proposed action will
affect the achievement of the LWRP policy standards and conditions contained in the consistency
review law. Thus,each answer must be explained in detail,listing both supporting and non-
supporting facts.. If an action cannot be certified as consistent with the LWRP policy standards and
conditions, it shall not be undertaken.
A copy of the LWRP is available in the following places: online at the Town of Southold's website
(southoldtown.northfork.net),the Board of Trustees Office,the Planning Department, all local
libraries and the Town Clerk's office.

,Applicant proposes to reconstruct the existing timber jetty along the southern shoreline of subject
property. The existing jetty is comprised of timber sheathing and measures 76.0' ± in overall
length. The Proposed / Reconstructed letty will be comprised of Vinyl Sheathing sandwiched
between Timber Walers (6" x 6") and Timber Pilings (8.0" - 10" @) - staggered either side), and
will be reduced to 68.0'±in overall length(to extend to the ALW). The new Jetty is not to exceed
2.5' above grade.

Policy 1. Foster a pattern of development in the Town of Southold that enhances community character,
preserves open space,makes efficient use of infrastructure,makes beneficial use of a coastal location,and
minimizes adverse effects of development. See LWRP Section III—Policies; Page 2 for evaluation
criteria.

Subject proposal is consistent with the policy in that the siting/utilization of the reconstructed jetty
will maintain the character of the surrounding neighborhood, which currently consists of many similarly-improved
residential lots with similar shoreline structures (i.e. jetties). In addition, subject proposal will be in harmony with
the"...beneficial use of a coastal location..." in that the legally created residential waterfront (i.e. coastal) lot will be
enhanced by the reconstructed jetty in order to maintain the protection &stabilization of the beachfront.
Accordingly, we believe that this project is consistent with this policy.

Subiect proposal will not adversely impact the visual quality of the surrounding area in that the surrounding
area is currently comprised of properties improved with similar structures (i.e. jetties) of similar size and scope.
Scenic resources, assumedly views of Peconic Bay, are not at risk due to the length of the reconstructed jetty
being reduced in length and the height being no greater than 2.5' over grade. Accordingly,this proposal will
comply with Policy 3.
