Michael Domino, President Town of Southold Board of Trustees From: Mark Terry, LWRP Coordinator Date: October 16, 2017 Re: LWRP Coastal Consistency Review for JOHN CROKOS SCTM# 1000-14-2-3.11 Robert Wilson on behalf of JOHN CROKOS requests a Wetland Permit for the existing 187sq ft. of bluff stairs consisting of a 4'6"x10'9" (48sq.ft.) upper landing to a 4'6" wide set of stairs, to a 4'6"x4'9" (21sq.ft.) middle landing to 4'6" wide stairs down to the beach with the bottom six steps being hinged in order to fold away when stairs are not in use; and that all platforms all stairs but the final six steps have 36" handrails. Located: 2110 Grandview Drive, Orient. SCTM# 1000-14-2-3.11 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the action is INCONSISTENT with the below listed Policy Standards and therefore is INCONSISTENT with LWRP. 6.3 Protect and restore tidal and freshwater wetlands. A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction 1. Comply with Trustee regulations and recommendations as set forth in Trustee permit conditions. The structure was constructed without a Board of Trustee Wetlands permit. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. All applicants for permits* including Town of Southold agencies, shall complete this CCAF for proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This assessment is intended to supplement other information used by a Town of Southold agency in making a determination of consistency. *Except minor exempt actions including Building Permits and other ministerial permits not located within the Coastal Erosion Hazard Area. 2. Before answering the questions in Section C, the preparer of this form should review the exempt minor action list, policies and explanations of each policy contained in the Town of Southold Local Waterfront Revitalization Program. A proposed action will .be evaluated. as to .its significant beneficial and adverse effects anon the coastal am(which includes all of Southold Town-., 3. If any question in.Section C on this form is answered "yes" or "no", then the proposed action will affect the achievement of the LWRP policy standards and conditions contained in the consistency review law. The stairs provide access and beneficial use of the beach and coastal water to the residents,while being designed and consntructing with care to not have destructive impact on the surrounding environment in terms of erosion,or pollution. See LWRP Section III —Policies Pages 16 through 21 for evaluation criteria © YesF1 No El Not Applicable The stairs were desgned to have virtually no impact on the local water quality and supply The stairs themselves end well landward of the high tide line,and the lower section of stairs can be folded away during seasonal storms or periods of exceptionally high water Also the stairs have minimal or no impact on the existing vegetation of the bluff ensuring that there is no significant increase in stormwater run-off reaching the water. Attach additional sheets if necessary Policy 6. Protect and restore the quality and function of the Town of Southold ecosystems including Significant Coastal Fish and Wildlife Habitats and wetlands.
