SCTM# 1000-122-4-29 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the action is CONSISTENT with the Policy Standards and therefore is CONSISTENT with the LWRP. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. This assessment is intended to supplement other information used by a Town of Southold agency in making a determination of consistency. *Except minor exempt actions including Building Permits and other ministerial permits not located within the Coastal Erosion Hazard Area. 2. Before answering the questions in Section C, the preparer of this form should review the exempt minor action list, policies and explanations of each policy contained in the Town of Southold Local Waterfront Revitalization Program. A proposed action will be evaluated as to its si nificant beneficial and adverse effects upon the coastal area (which includes all of Southold Town). If any question in Section C on this form is answered "yes" or "no", then the proposed action will affect the achievement of the LWRP policy standards and conditions contained in the consistency review law. See LWRP Section III - Policies; Pages 22 through 32 for evaluation criteria. ®Yes 0 No ❑ Not Applicable LWRP ADDENDUM for ANGELIC & JOHN DURANTE,JR. 4260 OLE JULE LANE MATTITUCK, NY SCTM#1000-97-7-2 Policy The subject property is vacant and unimproved except for a bulkhead along the shoreline of James Creek, which was approved by the Board of Trustees in 1987 (see Wetlands Permit No. 415). The proposed development of the property consists of the construction of a new two-story dwelling located a minimum of 100 feet from wetlands, compliant with Section 275-3(D)(1)(a)(1); and a swimming pool and related masonry patios located a minimum of 75 feet from wetlands, thus compliant with the NYSDEC's required wetlands setback and in excess of the minimum setback required for pools and pool related structures pursuant to Section 275-3(d)(1)(a)(5). The project also proposes the installation of a fixed platform, ramp, and floating dock adjacent to the existing bulkhead for private boat dockage, which is compliant with all dock construction standards set forth in Section 275-11(C)(2). The project has been further designed to minimize impacts associated with property development and maximize the protection and restoration of the adjacent tidal wetland ecosystem through additional mitigation measures. Specifically, in addition to a proposed drainage system of leaders, gutters, and drywells to collect roof runoff, the potential for increased surface water runoff will be mitigated by the establishment and maintenance of a 15' wide, approximately 1,500 sf non-turf buffer adjacent to the existing bulkhead. This buffer area will serve both as a sink and filter for stormwater runoff and contaminants, thereby mitigating both the quantity and quality of potential runoff reaching the harbor. The potential for temporary runoff and site disturbance during construction will be contained by a project limiting fence. And the dwelling will be served by a sanitary system located almost 140 feet from wetlands and thus well beyond Chapter 275 jurisdiction. For these reasons, the project will not have any significant adverse impacts on the adjacent tidal wetlands or waters of the Town. For these reasons, the project will not have any significant adverse impacts on water quality or the adjacent tidal wetlands or surface waters of the Town and will thus be consistent with Policies 5 and 6 of the LWRP.
