En-Consultants on behalf of THOMAS & GERMAINE CASSIDY requests a Wetland Permit to remove and replace (in-place and up to 12 inches higher) approximately 90 linear feet of existing timber with vinyl bulkhead; construct a ±28' vinyl bulkhead in-place of existing ±29' timber bulkhead (up to 12 inches higher and up to 5 feet farther landward); construct ±32' vinyl bulkhead in-place of and up to 12 inches higher than existing ±27' timber bulkhead, construct a ±6' southerly return, and ±12' northerly return in-place of existing 8' northerly return; incidentally dredge up to 10 feet seaward of new±31, ±32', ±28' and ±24' sections of bulkhead (950sq.ft. total area) to a maximum depth of-2.5' MLW and use approximately 70 cubic yards of sand/silt spoil as backfill; remove all existing wood walkways/decks and construct new 4'x±36' and 4'x±31' wood walkways, and to establish and perpetually maintain a 5' wide non-turf buffer area landward of all new bulkheading. Located: 280 Beebe Drive, Cutchogue. SCTM# 1000-97-7-2 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold.Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the action is CONSISTENT with the Policy Standards and therefore is CONSISTENT with the LWRP. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. p ECCE E Town of Southold LWRP CONSISTENCY ASSESSMENT FORM OCT 66 2017 A. INSTRUCTIONS Southold Town 1, All applicants for permits* including Town of Southold agencies, shall Pi Nng a proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This assessment is intended to supplement other information used by a Town of Southold agency in making a determination of consistency. *Except minor exempt actions including Building Permits and other ministerial permits not located within the Coastal Erosion Hazard Area. 2. Before answering the questions in Section C, the preparer of this form should review the exempt minor action list, policies and explanations of each policy contained in the Town of Southold Local Waterfront Revitalization Program. A proposed action will be evaluated as to its si nificant beneficial and adverse effects upon the coastal area (which includes all of Southold Towni If any question in Section C on this form is answered "yes" or "no", then the proposed action will affect the achievement of the LWRP policy standards and conditions contained in the consistency review law. Thus, each answer must be explained in detail, listing both supporting and non- supporting facts. Minimize loss of life, structures, and natural resources from flooding and erosion. See LWRP Section III - Policies Pages 8 through 16 for evaluation criteria ® Yes ❑ No ❑ Not Applicable The project seeks to construct vinyl bulkheading in substantially the same location as(and up to 12 inches higher than)existing permitted timber bulkheading(see Town Wetlands Permit No. 1860)for the purpose of maintaining the property's historical method of protection against erosion and flooding. (Two sections of bulkhead will be slightly modified in length and/or orientation for the purpose of squaring the northeasterly comer of the existing boat basin). The existing,developed site has been improved with and supported by a bulkhead since prior to 1984,and there is no viable non-structural alternative means of maintaining and protecting the upland portion of the property in its current location. Without replacement and maintenance of the bulkhead the subject property would be exposed to erosion and flooding. Therefore the project is consistent with Policy 4 Attach additional sheets if necessary Policy 5. Protect and improve water quality and supply in the Town of Southold. See LWRP Section III - Policies Pages 16 through 21 for evaluation criteria ® Yes ❑ No ❑ Not Applicable The project is consistent with Policy 5 to the extent that the existing treated timber bulkhead will be replaced with a bulkhead constructed with untreated vinyl sheathing and a 5'wide non-turf buffer will be established in place of existing lawn adjacent to the new bulkhead,which can serve as both a sink and filter for surface water runoff and potential contaminants contained therein. The proposed incidental dredging within 10 feet of some sections of newly constructed bulkhead will not adversely impact water quality because the spoil will consist of sandy/silty soils,primarily from upland material lost to the boat basin through the aging bulkhead;and the effects of turbidity will be localized, ephemeral, and can be contained by a silt curtain deployed during the bulkhead replacement and dredging activities. Attach additional sheets if necessary Policy 6. Protect and restore the quality and function of the Town of Southold ecosystems including Significant Coastal Fish and Wildlife Habitats and wetlands. See LWRP Section III - Policies; Pages 22 through 32 for evaluation criteria. ® Yes ❑ No ❑ Not Applicable The project will effectively maintain the historically existing site conditions without any change in or significant adverse impact on the adjacent tidal waters or wetlands except that the treated timber bulkheading will be removed and replaced with untreated vinyl sheathing;all existing decking that overhangs the waterway(and vegetated tidal marsh)will be removed; and a 5'non-turf buffer will be established and maintained along the landward side of all new bulkheading,thereby reducing lawn area and increasing buffer area for increased absorption and filtering of nmoff adjacent to the waterway.
