Robert Barratt on behalf of JOHN KATONA requests a Wetland Permit to demolish existing
dwelling, abandon existing sanitary and construct new two-story, single-family 2,600sq.ft. dwelling
with 770sq.ft. attached garage for a 3,370sq.ft. total footprint; install new septic system landward of
dwelling inside retaining wall which will maintain a grade elevation to meet S.C. Health Dept.
standards; install a driveway; install gutters to leaders to drywells to contain roof runoff, and in
accordance with Chapter 236 of the Town Code-Stormwater Runoff; install and perpetually maintain
a 20' wide non-turf buffer along the landward edge of the wetlands; and to install a line of staked
hay bales prior to and during construction. Located: 160 Inlet Lane, Greenport. SCTM# 1000-43-5-

The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment Form
submitted to this department, as well as the records available to me, it is my recommendation that
the proposed action is CONSISTENT with the policy standards and therefore is CONSISTENT with
the LWRP provided the Board considers the following:
Due to the proximity of the dwelling to ground and surface waters (Note that the surface
water body shows evidence of high nutrient loading due to the amount of floating vegetation
due to poor flushing). It is recommended that the Board consider requiring the following
conditions on the parcel to further Policy 5 and Policy 6 and protect water quality:
1. Establishment of a 30' wide non-fertilized, landscaped buffer landward of the wetland line
(Figure 1). Chapter 268 of the Southold Town Code defines a landscape buffer as:
LANDSCAPED BUFFER-A land area of a certain length and width which is planted with
indigenous, drought-tolerant vegetation similar to that found within the immediate proximity
of the parcel. Vegetation shall be installed in sufficient densities to achieve 95% ground
cover within two years of installation. Survival of planted vegetation shall be 90% for a

In addition it is recommended that the Board clarify the depth of the proposed drywells in
relation to groundwater. No dimensions have been provided for the drywells and
groundwater was encountered at 4.5' below grade according to test hole data (1/27/14).
Pursuant to Chapter 268, the Southold Town Zoning Board of Appeals shall consider this
recommendation in preparing its written determination regarding the consistency of the proposed
action.

1. All applicants for permits* including Town of Southold agencies, shall complete this CC or
proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This
assessment is intended to supplement other intformation used by a Town of Southold agency in
making a determination of consistency. *Except minor exempt actions including Building Permits
and other ministerial permits not located within the Coastal Erosion Hazard Area.
2. Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfront Revitalization Program. A proposed action will be evaluated. as to its sign ficant
beneficial.and adverse effects upon the coastal area(which includes all of Southold Town).
3: If any question in Section C on this form is answered "yes" or "no", then the proposed action will
affect the achievement of the LWRP policy standards and conditions contained in the consistency
review law. Thus, each answer must be explained in detail, listing both suuportin and non,
