Main Rd &Youngs Ave.) Southold, NY 11971 ® �p Telephone: 631 765-1938 olyON% LOCAL WATERFRONT REVITALIZATION PROGRAM TOWN OF SOUTHOLD MEMORANDUM To: Michael Domino, President Town of Southold Board of Trustees From: Mark Terry, LWRP Coordinator Date: November 14, 2017 Re: LWRP Coastal Consistency Review for SEAN & LESLIE OLSEN SCTM# 1000-70-4-25 En-Consultants on behalf of SEAN & LESLIE OLSEN requests a Wetland Permit to remove and replace in-place approximately 85 linear feet of existing timber bulkhead with vinyl bulkhead; incidentally dredge 5' wide area adjacent to bulkhead to a maximum depth of-4' MLW and use approximately 10 cubic yards of sand/silt spoil as backfill, reconstruct in-place existing 4.5'x7' seaward platform attached to bulkhead and reattach existing 2.5'x9' ramp and 5'x16' floating dock to remain; construct an 8'x20' on-grade, open-grate deck landward of bulkhead; and to establish and perpetually maintain a 5' wide non-turf buffer along newly constructed bulkhead. Located: 975 West Hill Road, Southold. SCTM# 1000-70-4-25 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the actions to remove and replace in-place approximately 85 linear feet of existing timber bulkhead with vinyl bulkhead; incidentally dredge 5' wide area adjacent to bulkhead to a maximum depth of- 4' MLW and use approximately 10 cubic yards of sand/silt spoil as backfill; reconstruct in-place existing 4.5'x7' seaward platform attached to bulkhead construct an 8'x20' on-grade, open-grate deck landward of bulkhead; and to establish and perpetually maintain a 5' wide non-turf buffer along newly constructed bulkhead are CONSISTENT with the Policy Standards and therefore are CONSISTENT with the LWRP provided the following is considered. The proposal to reattach existing 2.5'x9' ramp and 5'x16' floating dock to remain is recommended as INCONSISTENT. No permits were found for the structures in Town records. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. Town of Southold Lcompe 3 2017 LWRP CONSISTENCY ASSESSMENT FORM A. INSTRUCTIONS qSouthold Town g Bo 1 . All applicants for permits* including Town of Southold agencies, shal proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This assessment is intended to supplement other information used by a Town of Southold agency in making a determination of consistency. *Except minor exempt actions including Building Permits and other ministerial permits not located within the Coastal Erosion Hazard Area. 2. Before-answering the questions in Section C, the preparer of this form should review the exempt minor action list, policies and explanations of each policy contained in the Town of Southold Local Waterfront Revitalization Program. A proposed action will be evaluated as to its si nificant beneficial and adverse effects upon the coastal area (which includes all of Southold Town). If any question in Section C on this form is answered "yes" or "no", then the proposed action will affect the achievement of the LWRP policy standards and conditions contained in the consistency review law. Thus, each answer must be explained in detail, listing both supporting and non- supporting facts. If an action cannot be certified as consistent with the LWRP policy standards and conditions, it shall not be undertaken. A copy of the LWRP is available in the following places: online at the Town of Southold's website (southo I dtown.northfork.net), the Board of Trustees Office, the Planning Department, all local libraries and the Town Clerk's office. Minimize loss of life, structures, and natural resources from flooding and erosion. See LWRP Section III - Policies Pages 8 through 16 for evaluation criteria ® Yes ❑ No ❑ Not Applicable The project seeks to construct vinyl bulkheading in the same location as existing timber bulkheading for the purpose of maintaining the property's historical method of protection against erosion and flooding. The existing,developed site has been unproved with and supported by a bulkhead since prior to 1977,and there is no viable non-structural alternative means of maintaining and protecting the upland portion of the property in its current location. Without replacement and maintenance of the bulkhead the subject property would be exposed to erosion and flooding. Therefore the project is consistent with Policy 4. See LWRP Section III - Policies Pages 16 through 21 for evaluation criteria ® Yes ❑ No ❑ Not Applicable The project is consistent with Policy 5 to the extent that the existing treated timber bulkhead will be replaced with a bulkhead constructed with untreated vinyl sheathing;the fixed platform will be reconstructed with open-grate decking;the proposed on-grade deck landward of the bulkhead will be constructed with open-grate decking; and a 5'wide non-turf buffer will be established in place of existing lawn adjacent to the new bulkhead,which can serve as both a sink and filter for surface water runoff and potential contaminants contained therein. The proposed incidental dredging within 5 feet of the newly constructed bulkhead will not adversely impact water quality because the spoil will consist of sandy/silty soils derived primarily from lost upland material; and the effects of turbidity will be localized,ephemeral,and contained by a silt curtain deployed during the bulkhead replacement and dredging activities. See LWRP Section III - Policies; Pages 22 through 32 for evaluation criteria. ® Yes ❑ No ❑ Not Applicable u The project will effectively maintain the historically existing site conditions without any change in or significant adverse impact on the adjacent tidal waters or wetlands except that the treated timber bulkheading will be removed and replaced with untreated vinyl sheathing;the existing fixed platform will be reconstructed with open-grate decking;the proposed on-grade deck will be constructed with open-grate decking;and a 5'non-turf buffer will be established and maintained along the landward side of the new bulkheading,thereby reducing lawn area and increasing buffer area for increased absorption and filtering of runoff adjacent to the waterway And the localized,ephemeral effects of the proposed incidental dredging to recover lost upland material(to be retained on site as backfill)will be contained by a silt curtain.
