Main Rd. &Youngs Ave.) ® �O Telephone: 631 765-1938 Southold, NY 11971 �lyCOUNT`I LOCAL WATERFRONT REVITALIZATION PROGRAM TOWN OF SOUTHOLD MEMORANDUM To: Michael Domino, President Town of Southold Board of Trustees From: Mark Terry, LWRP Coordinator Date: November 14, 2017 Re: LWRP Coastal Consistency Review for KIMOGENOR POINT COMPANY, c/o DANIEL BINGHAM, PRESIDENT SCTM# 1000-116-6-24 1 En-Consultants on behalf of KIMOGENOR POINT COMPANY, c/o DANIEL BINGHAM, PRESIDENT requests a Wetland Permit to repair existing clubhouse foundation, i.e. install new foundation pilings, replace porch decking, replace and/or sister existing foundation framework components (e.g. girders), and install new materials to stabilize and secure the building (e.g. hurricane straps); construct approximately 133 linear feet of mid-sill vinyl bulkhead (EL. ±4.73') around three sides of existing clubhouse and install ±34" untreated cap to cover bulkhead and gap between bulkhead and existing porch; install ±4' extension of existing bulkhead return (stepped down to EL. ±3.6') to connect to proposed mid-sill bulkhead; backfill extended return with approximately 4 cubic yards clean sandy fill and plant with Spartina patens (18" o.c.) to establish approximately 64sq.ft. area of high marsh; replace two sets of existing steps with two sets of±4'x7' wood platforms (over mid-sill bulkhead),and ±2'x7' steps; remove and replace in-kind/in-place ±4'x5' section of existing dock catwalk to allow for installation of mid-sill bulkhead; place approximately 46 cubic yards clean sandy fill beneath clubhouse to raise grade to EL. ±3.6'; and remove and replace in-place 5'x86' timber footbridge using open-grate decking. SCTM# 1000-116-6-24.1 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the action is CONSISTENT with the Policy Standards and therefore is CONSISTENT with the LWRP provided the following is considered to further Policy 6. 1. Reduce CCA treated materials in construction. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the.proposed action. All applicants for permits* including Town of Southold agencies, shall o e i or proposed actions that are subject to the Town of Southold Waterfront Consi tency ��" v. This assessment is intended to supplement other information used by a Tow n making a determination of consistency. *Except minor exempt actions including Building Permits and other ministerial permits not located within the Coastal Erosion Hazard Area. 2. Before answering the questions in Section C, the preparer of this form should review the exempt minor action list, policies and explanations of each policy contained in the Town of Southold Local Waterfront Revitalization Program. A proposed action will be evaluated as to its significant beneficial and adverse effects upon the coastal area (which includes all of Southold Town). If any question in Section C on this form is answered "yes" or "no", then the proposed action will affect the achievement of the LWRP policy standards and conditions contained in the consistency review law. Thus, each answer must be explained in detail, listing both supporting and non- supporting facts. If an action cannot be certified as consistent with the LWRP policy standards and conditions, it shall not be undertaken. Although not a registered historic landmark,the existing clubhouse was constructed in 1909 and has for more than a century remained as the centerpiece of Kimogenor Point,symbolizing and maintaining the historic character of the community that was originally founded 109 years ago. And consistent with Policy 2,the clubhouse building is being preserved in place using appropriate repairs. Attach additional sheets if necessary Policy 3. Minimize loss of life, structures, and natural resources from flooding and erosion. See LWRP Section III - Policies Pages 8 through 16 for evaluation criteria ® Yes ❑ No ❑ Not Applicable The proposed bulkhead is consistent with the fundamental objective of Policy 4,which is to minimize loss from flooding and erosion,in this case the potential loss of the historic,109-year old clubhouse structure that stands on an island characterized by tidal wetlands and cannot practicably be relocated. The project design is further consistent with the policy goal of using a hard structural erosion protection method only where the hazard cannot be avoided(the clubhouse cannot be relocated);it is not possible to enhance any natural protective feature or use a vegetative approach to protect the clubhouse from flooding and erosion,leaving a hard structure as the only design consideration that can practicably and effectively do so;the proposed mid-sill bulkhead has been limited to the minimal scale necessary and is based on sound engineering practices;vegetative marsh restoration and enhancement are incorporated into the project design;and there will be no adverse impact to adjacent property or coastal processes and no significant direct or indirect costs incurred by the public as a result of the project. See LWRP Section III - Policies; Pages 22 through 32 for evaluation criteria. ® Yes ❑ No ❑ Not Applicable Consistent with Poliy 6,to protect and restore the quality and function of the surrounding tidal wetland ecosystem,the project includes mitigation measures designed to protect and preserve to the maximum extent practicable the existing tidal marsh vegetation during construction using temporary heavy equipment mats;to replace any marsh vegetation that is damaged or lost during construction by way of restorative marsh plantings;and to enhance/create an approximately 64sf area of high marsh landward of the proposed extended bulkhead return where that area of upland is gradually eroding and subsiding. Additionally,in order to mitigate the coverage created by the 34"bulkhead cap needed to cover the corrugated vinyl sheathing of the proposed bulkhead and the gap between the bulkhead and the existing porch,the cap will be constructed of untreated,light-penetrable,open-grate material. And to further reduce and limit the introduction of treated materials over the wetlands and surface waters,the existing wood footbridge to the clubhouse will be reconstructed with untreated,light-penetrable,open-grate decking. Therefore,the project will result in the maintenance and preservation of the 108-year old clubhouse without causing significant adverse impacts to the adjacent tidal wetlands or surface waters.
