SCTM# 1000-86-5-8.1 En-Consultants on behalf of 1625 INDIAN NECK HOLDING CORP. requests a Wetland Permit to remove existing 4'x74' fixed timber catwalk and construct in its place a proposed elevated fixed "L" shaped timber dock using open grate decking consisting of a 4'x123' elevated catwalk leading to a 6'x16' fixed platform at its seaward end. Located: 1625 Indian Neck Lane, Peconic. SCTM# 1000-86-5-8.1 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my determination that the proposed actions are INCONSISTENT with the below listed LWRP policy and therefore are INCONSISTENT with the LWRP: The purpose of the 55 foot dock extension has not been identified. A vessel proposed for use has not been identified. 6.3 Protect and restore tidal and freshwater wetlands. The applicant has not demonstrated that the following dock standards pursuant to § 275-11. Construction and operation standards have been met. (d) Review and approval of dock applications. Before issuing a permit for a dock structure, the Trustees shall consider whet( er the dock will have any of the following harmful effects: [1] Whether the dock will impair navigation or be located in areas of high vessel traffic or vessel congestion; The proposed dock extension would extend into the public waters. The increased draft of larger vessels and decreasing water depths does not warrant incremental extension of permanent, private, dock structures into public water bodies Alternatives such as a seasonal mooring in pre-established areas with adequate water depth is a better option. [2] Whether the dock will unduly interfere with the public use of waterways for swimming, boating, fishing, shellfishing, waterskiing and other water-dependent activities; Private dock structures extending into public waters decreases the public use of bottomlands and the nearshore area. (5] Whether the dock will cause degradation of surface water quality and natural resources; Richmond Creek is a New York State Significant Coastal Fish and Wildlife Habitat and New York State Department of Environmental Conservation Critical Environmental Area. (12] Whether adequate facilities are available to boat owners and/or operators for fueling, discharge of waste and rubbish, electrical service and water service. 9.3 Preserve the public interest in and use of lands and waters held in public trust by the state and the Town of Southold. A. Limit grants, leases, easements, permits or lesser interest in lands underwater in accordance with an assessment of potential adverse impacts of the proposed use, structure, or facility on public interest in public lands under water. The dock structure will extend further into public waters resulting in a net decrease in public access to public underwater lands and the nearshore area. The applicant currently enjoys access to public water via an existing private, dock structure which could be replaced. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed actions. i Town of Southold E C E U > LWRP CONSISTENCY ASSESSMENT FORM aF"ECO2 2016 A. A proposed action will be evaluated as to its significant beneficial and adverse effects upon the coastal area (which includes all of Southold Town). If any question in Section C on this form is answered "yes" or "no", then the proposed action will affect the achievement of the LWRP policy standards and conditions contained in the consistency review law. Thus, each answer must be explained in detail, listing both supporting and non- supporting facts. If an action cannot be certified as consistent with the LWRP policy standards and conditions, it shall not be undertaken. See LWRP Section III - Policies; Pages 22 through 32 for evaluation criteria. ® Yes ❑ No ❑ Not Applicable LWRP CONSISTENCY ASSESSMENT FORM ADDENDUM FOR 1625 INDIAN NECK HOLDING CORP. 1625 INDIAN NECK LANE PECONIC, NY SCTM#1000-86-5-8.1 Policy 6 The proposed dock would constitute a replacement and extension of the existing dock to be removed and would be consistent in scope and character with various other docks located along the westerly and easterly shorelines of Richmond Creek. Specifically,the dock would be situated between and within the pier line of two similarly designed fixed "L"-shaped docks, including the adjacent dock to the south with a 4' x 12' platform at its seaward end, which was permitted in 2012 by a modification to Wetlands Permit No. 5046; and the adjacent dock to the north with a 6' x 20' platform at its seaward end, which was permitted in 2015 by Wetlands Permit No. 8579. The 6' x 16' platform at the seaward end of the proposed dock would extend approximately 3 8 feet seaward of mean lower low water(roughly 23 percent of the width of the surface waters of Richmond Creek at mean lower low tide) and would be located more than 15 feet from the extended southerly property line. Therefore, the dock would be consistent with the construction standards set forth by §275-1 l(C)(2) and would have no adverse impact on navigation or other public and recreational use of Richmond Creek. The purpose of the dock is to provide a fixed point of elevated structural access over the existing vegetated marsh to allow for access to the water and dockage of private, noncommercial watercraft. Without a replacement dock, the same location on the site could still be used for access, but watercraft would have to be dragged through the marsh, which together with the associated foot traffic would create the potential for loss of wetland vegetation along the shoreline. To mitigate any potential impacts of the dock construction on the adjacent tidal wetland area and Town waters, the proposed dock would be constructed entirely with open-grate decking and 4"x 4"posts over the vegetated marsh and would be elevated a minimum of 4' above the grade of vegetated tidal wetlands. Overall, the dock design is consistent a) generally with the rules and regulations of the Town Wetlands Law, Chapter 275, and the New York State Tidal Wetlands Act, Article 25; and b) specifically with that of the recently permitted docks on the two adjacent properties. Therefore, consistent with Policy 6, the dock would not cause a"fragmentation of ecological communities,"result in the physical loss,degradation, or functional loss of ecological components, or otherwise adversely impact the adjacent wetland ecosystem or tidal waters of the Town.
