En-Consultants on behalf of CASTELFORTE, LLC, c/o MAGGIE N. SPARAGNA requests a
Transfer of Wetland Permit#1807 from Robert Wilson to Castelforte, LLC, c/o Maggie N. Sparagna,
as issued on April 30, 1984; and for an Amendment to Wetland Permit#1807 to remove existing
6'x20' floating dock and two (2) pilings, and construct a fixed "L" shaped timber dock consisting of a
4'x34' catwalk (included +/-3' steps to grade at landward end) leading to a 6'x12' fixed "L" shaped
platform at seaward end. Located: 2100 Glenn Road, Southold. SCTM# 1000-78-2-38
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment Form
submitted to this department, as well as the records available to me, it is my recommendation that
the action is CONSISTENT with the Policy Standards and therefore is CONSISTENT with the
! LWRP provided that:
4 1. The Board verifies the location of the bank. Wetland Permit#1807 was conditioned that the
dock does not "go out" more than 10' from the top of bank.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its
written determination regarding the consistency of the proposed action.

and other ministerial permits not located within the Coastal Erosion Hazard Area.
2. Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfront Revitalization Program. A proposed action will be evaluated as to its significant
beneficial and adverse effects upon the coastal area (which includes all of Southold Town).
If any question in Section C on this form is answered "yes" or "no", then the proposed action will
affect the achievement of the LWRP policy standards and conditions contained in the consistency
review law. Thus, each answer must be explained in detail, listing both supporting and non-
supporting facts. If an action cannot be certified as consistent with the LWRP policy standards and
conditions, it shall not be undertaken.

(southoldtown.northfork.net), the Board of Trustees Office, the Planning Department, all local
libraries and the Town Clerk's office.

Policy 6
The proposed fixed "L"-shaped dock will replace a previously existing "L"-shaped
floating dock assemblage, which was permitted pursuant to Southold Trustees Permit No.
1807 in 1984, and would be consistent in character with the many similar docks that
characterize the subject and opposing developed shorelines of West Creek. The proposed
coverage of West Creek by the portion of the dock situated seaward of the high water line
would be approximately 144 square feet, which represents a 40 sf reduction of the
approximately 184 square feet of West Creek covered by the previously permitted
catwalk, ramp, and 6' x 20' float. The proposed dock would also be situated between and
within the pier line of two adjacent docks, including a similar fixed dock to the west that
was permitted in 2009 pursuant to Southold Wetlands Permit No. 7181. Specifically, the
proposed dock would extend +13 feet seaward of the high water line or approximately
17% of the width of the waterway at mean lower low tide. Therefore, the dock will be
consistent with the dock construction and operation standards set forth by §275-11(C)(2)
and will not interfere with navigation or other public use of the adjoining waterway. To
minimize the dock's impact on tidal wetlands vegetation, the entire dock structure will be
constructed with open-grate decking. Therefore, consistent with Policy 6, the proposed
dock will not cause the"fragmentation of ecological communities;"result in the physical
loss, degradation, or functional loss of ecological components; or have any other
significant adverse impact on the adjacent tidal wetlands or waters of the Town and will
otherwise comply with the statutory and regulatory requirements of Chapter 275 and
Article 25 of the New York State Environmental Conservation Law.
