Main Rd. &Youngs Ave.) N S • COQ Telephone: 631 765-1938 Southold, NY 11971 O Fast: 631 765-3136 LOCAL WATERFRONT REVITALIZATION PROGRAM TOWN OF SOUTHOLD MEMORANDUM To: Michael Domino, President Town of Southold Board of Trustees From: Mark Terry, LWRP Coordinator Date: December 7, 2017 Re: LWRP Coastal Consistency Review for RICHARD & AMY BRAUNSTEIN SCTM# 1000-114-1-7.2 Jeffrey Patanjo on behalf of RICHARD & AMY BRAUNSTEIN requests a Wetland Permit to install 90 linear feet of Coir Log stabilization with associated native plantings; installation of 12 linear feet of interlocking rip-rap along shoreline under existing fixed dock; installation of four (4) 8" diameter cca treated piles on landward end of existing fixed dock; installation of 4'x4' stairs for beach access off of dock; and to install one (1) additional 6'x20' floating dock fastened onto the 6' wide northeasterly section of existing 6'x20' floating dock and piles with existing outer tie-off pile to be used as a float securing pile. Located: 1885 Home Pike,.Mattituck.. SCTM# 1000-114-1-7.2 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The proposal to install 90 linear feet of Coir Log stabilization with associated native plantings; installation of 12 linear feet of interlocking rip-rap along shoreline under existing fixed dock; installation of four (4) 8" diameter cca treated piles on landward end of existing fixed dock; installation of 4'x4' stairs for beach access off of dock is recommended as CONSISTENT. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the action to install one (1) additional 6'x20' floating dock fastened onto the 6' wide northeasterly section of existing 6'x20' floating dock and piles with existing outer tie-off pile to be used as a float securing pile is INCONSISTENT with the below listed Policy Standards and therefore is INCONSISTENT with LWRP. 6.3 Protect and restore tidal and freshwater wetlands. A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction 275-11 C(2)(c)[1][b][i]If any part of a residential dock structure includes a float or floating dock, the float or floating dock portion shall be designed so that, with the exception of the pilings: It is no larger than six feet wide and 20 feet long except on Fishers Island if the need is demonstrated; or of equal square footage as determined by the Trustees. 275-11 C(2)[111 Personal watercraft or jet ski floats cannot be added to any float, stairway, or dock without a Trustee permit. Floats may not cumulatively exceed 120 square feet. The two floats would equal 240 square feet combined and exceed 120 square feet. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. All applicants for permits* including Town of Southold agencies, shall complete this CCAF for proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This assessment is intended to supplement other information used by a Town of Southold agency in making a determination of consistency. *Except minor exempt actions including Building Permits and other ministerial permits not located within the Coastal Erosion Hazard Area. 2. Before answering the questions in Section C, the preparer of this form should review the exempt minor action list, policies and explanations of each policy contained in the Town of Southold Local Waterfront Revitalization Program. A proposed action will',be evaluated as to its si scant beneficial and adverse effects upon the coastal area(which includes all of Southold Town). 3. If any question in Section C on this form is answered "yes" or "no", then the proposed action will affect the achievement of the LWRP policy standards and conditions contained in the consistency review law. Thus, each answer must be explained in detail, listing both supporting and non- supporting facts.
