Located: 835 Tarpon Drive, Southold. SCTM# 1000-53-5-8 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the action is CONSISTENT with the Policy Standards and therefore is CONSISTENT with the LWRP provided that: 1. The pool de-watering drywell is located less than 50' from the tidal wetland. It is recommended that the de-watering drywell is located the greatest distance from the tidal wetlands as practicable. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. All applicants for permits* including Town of Southold agencies, shall complete this CCAF for proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This assessment is intended to supplement other information used by a Town of Southold agency in making a determination of consistency. *Except minor exempt actions including Building Permits and other ministerial permits not located within the Coastal Erosion Hazard Area. 2. Before answering the questions in Section C, the preparer of this form should review the exempt minor action list, policies and explanations of each policy contained in the Town of Southold Local Waterfront Revitalization Program. A proposed action will be evaluated as to its si ni�ant beneficial and adverse effects upon the coastal area (which includes all of Southold Town). If any question in Section C on this form is answered "yes" or "no", then the proposed action will affect the achievement of the LWRP policy standards and conditions contained in the consistency review law. Thus, each answer must be explained in detail, listing both supporting and non- supporting facts. See LWRP Section III - Policies; Pages 22 through 32 for evaluation criteria. ® Yes ❑ No ❑ Not Applicable LWRP CONSISTENCY ASSESSMENT FORM ADDENDUM FOR ROBERT & RITA REIS WIECZOREK 835 TARPON DRIVE SOUTHOLD, NY SCTM#1000-53-5-8 Policy 6 The project consists of the construction of an inground swimming pool that will result in an increase in Town- defined lot coverage by only 410 square feet to approximately 13.4 percent. In order to avoid interference with the groundwater table, the swimming pool will be limited in depth and raised partially above grade(+/- 18") using approximately 25 cy of fill (obtained from the on-site excavation of the proposed swimming pool)contained with a "Redi-Rock" retaining wall system, which allows the fill to be placed over the top of the retaining wall. The retaining wall and swimming pool will be set back no less than 50 feet from wetlands, as required by Section 275- 3(D)(1)(a)(5)of the Wetlands Law of the Town of Southold. A temporary project limiting silt fence will be set in place between the work site and the surrounding tidal and freshwater wetland areas to control and contain site disturbance and potential runoff during construction;and a pool drywell will be installed upon completion of construction to permanently capture pool backwash. In order to mitigate the additional lot coverage, approximately 285isf of existing-impervious driveway will-be-converted-to_a=pervious-drivew ay=su�rfacd;and approximately 2,380 sf of naturally vegetated buffer areas will be maintained within 10 feet of the wetland boundaries on the property. Therefore,the project will be fully compliant with Chapter 275 and will not result in the physical loss, degradation, or functional loss of ecological components or otherwise adversely impact the adjacent tidal or freshwater wetland areas.
