The New York District, U.S. Army Corps of Engineers, has received a request for
Department of the Army authorization for the,following activity:
APPLICANT: John & Evelyn Braun

ACTIVITY: , Construct a new ramp, 307inches-wide by 16-feet-long, leading to a
new float, 6-feet-wide by 20-feet-long, supported by two (2) "10-'
inch-diameter timber piles.
Authorized under Nationwide Permit Number 3, Maintenance, the
removal and in-place replacement of an existing 4-foot-wide by 45-
foot-long existing fixed pier and the removal of an existing 30-inch-
wide-by 14-foot-long ramp and 7-foot-wide by 14-foot-long float.
The proposed structure will extend approximately 25-linear feet
from the Plane of Mean Low Water into Deep Hole Creek.
The purpose of this project is to,provide access to the waterway for
recreational boating.
WATERWAY: Deep Hole Creek, a tributary of Mattituck Creek
LOCATION: Mattituck, Town of Southold, Suffolk County, New York
As this is minor in nature, authorization may be by Letter of Permission. This is
in accordance,with current Federal Regulations governing work in navigable waters of
the United States. To accomplish the coordination required, prior to the issuance of a
Letter of Permission, your review of the enclosed drawings is requested.
Pursuant to Section,307 (c) of the Coastal Zone Management Act of 1972 as
amended (16 U.S.C. 1465 (c)(3)(A)), the applicant has certified that the activity
complies with and will be conducted in a manner that is consistent with'the approved
state coastal zone management program.

AUTHORIZATION
Pursuant to the provisions of Chapter 275 of the Town Code of the Town of Southold and in
accordance with the Resolution of the Board of Trustees adopted at the meeting held on April 5, 2018, and in
consideration of application fee in the sum of$250.00 paid by John & Evelyn Braun and subject to the Terms
and Conditions as stated in the Resolution, the Southold Town Board of Trustees authorizes and permits the
following:
Wetland Permit to remove existing fixed dock, ramp and float; construct in same location a new
proposed 4'x45' fixed dock inclusive of a set of steps within the fixed dock portion to accommodate
lowering the fixed dock section seaward of embankment using thru-flow decking and supported with 8"
diameter cca piles; a 16100" aluminum ramp; and a 6'x20' floating dock using un-treated timber

decking secured by two(2) 10"diameter cca piles; and as depicted on the revised site plan prepared by
Jeffrey Patanjo dated April 9,2018,and stamped approved on April 16,2018.
IN WITNESS WHEREOF,the said Board of Trustees hereby causes its Corporate Seal to be affixed,

TERMS AND CONDITIONS
The Permittee John &Evelyn Braun, residing at 680 Deep Hole Drive, Mattituck ,New
York, as part of the consideration for the issuance of the Permit does understand and
prescribe to the following:
1. That the said Board of Trustees and the Town of Southold are released from any and all
damages, or claims for damages, of suits arising directly or indirectly as a result of any
operation performed pursuant to this permit, and the said Permittee will,at his or her own
expense, defend any and all such suits initiated by third parties, and the said Permittee
assumes full liability with respect thereto,to the complete exclusion of the Board of
Trustees of the Town of Southold.
2. That this Permit is valid for a period of 24 months, which is considered to be the estimated
time required to complete the work involved, but should circumstances warrant, request for
an extension may be made to the Board at a later date.
3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to
maintain the structure or project involved,to provide evidence to anyone concerned that
authorization was originally obtained.
4. That the work involved will be subject to the inspection and approval of the Board or its
agents, and non-compliance with the provisions of the originating application may be cause
for revocation of this Permit by resolution of the said Board.
5. That there will be no unreasonable interference with navigation as a result of the work
herein authorized.
6. That there shall be no interference with the right of the public to pass and repass along the
beach between high and low water marks.
7. That if future operations of the Town of Southold require the removal and/or alterations in
the location of the work herein authorized, or if, in the opinion of the Board of Trustees,
the work shall cause unreasonable obstruction to free navigation, the said Permittee will be
required, upon due notice, to remove or alter this work project herein stated without
expenses to the Town of Southold.
8. That the said Board will be notified by the Permittee of the completion of the work
authorized.
9. That the Permittee will obtain all other permits and consents that may be required
supplemental to this permit, which may be subject to revoke upon failure to obtain same.
10. No right to trespass or interfere with riparian rights. This permit does not convey to the
permittee any right to trespass upon the lands or interfere with the riparian rights of others
in order to perform the permitted work nor does it authorize the impairment of any rights,
title, or interest in real or personal property held or vested in a person not a party to the
permit.

Dear Mr. Patanjo:
The Board of Town Trustees took the following action during its Special meeting held on
Thursday, April 5, 2018 regarding the above matter:
WHEREAS, Jeffrey Patanjo on behalf of JOHN & EVELYN BRAUN applied to the
Southold Town Trustees for a permit under the provisions of Chapter 275 of the
Southold Town Code, the Wetland Ordinance of the Town of Southold, application
dated February 15, 2018, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, the LWRP Coordinator recommended that the proposed application be
found Inconsistent with the LWRP, and,
WHEREAS, the Board of Trustees has furthered Policy 6.3 of the Local Waterfront
Revitalization Program to the greatest extent possible through the imposition of the
following Best Management Practice requirements: the proposed dock is a removal of
existing and replacement in same location; and
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on April 5, 2018, at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,

WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 275 of the
Southold Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that for the mitigating factors and based upon the Best Management
Practice requirement imposed above, the Board of Trustees deems the action to be
Consistent with the Local Waterfront Revitalization Program pursuant to Chapter 268-5
of the Southold Town Code, and,
RESOLVED, that the Board of Trustees approve the application of JOHN & EVELYN
BRAUN to remove existing fixed dock, ramp and float; construct in same location a new
proposed 4'x45' fixed dock inclusive of a set of steps within the fixed dock portion to
accommodate lowering the fixed dock section seaward of embankment using thru-flow
decking and supported with 8" diameter cca piles; a 16'x30" aluminum ramp; and a
6'x20' floating dock using un-treated timber decking secured by two (2) 10" diameter
cca piles; and as depicted on the revised site plan prepared by Jeffrey Patanjo dated
April 9, 2018, and stamped approved on April 16, 2018.
Permit to construct and complete project will expire two years from the date the permit
is signed. Fees must be paid, if applicable, and permit issued within six months of the
date of this notification.
Inspections are required at a fee of $50.00 per inspection. (See attached schedule.)

The Southold Town Board of Trustees adopted the following Resolution at a meeting
held on Thursday, April 5, 2018:
DESCRIPTION OF ACTION: Jeffrey Patanjo on behalf of JOHN & EVELYN BRAUN
requests a Wetland Permit to remove existing fixed dock, ramp and float; construct in
same location a new proposed 4'x45' fixed dock using thru-flow decking and supported
with 8" diameter cca piles; a 3'x16' aluminum ramp; and a 6'x20' floating dock using un-
treated timber decking secured by two (2) 10" diameter cca piles. Located: 680 Deep
Hole Drive, Mattituck. SCTM# 1000-115-12-9
S.E.Q.R.A. NEGATIVE DECLARATION OF ENVIRONMENTAL SIGNIFICANCE:
WHEREAS, the Southold Trustees are familiar with this project having visited the site
on March 14, 2018 and having considered plans for this proposed dock at their March
19, 2018 work session, and;
WHEREAS, in reviewing the project plans dated January 31, 2018, it has been
determined by the Southold Town Board of Trustees that all potentially significant
environmental concerns have been addressed as noted herein:
• Navigation: The proposed dock meets standards and does not extend beyond
1/3 across the water body. Depths for the dock terminus are within Town
Trustees, New York State Department of Environmental Conservation and United
States Army Corps. of Engineers guidelines and there is no recognized
Federal/New York State/Town navigation channel in the immediate vicinity of the
proposed structure.
• Scope: The proposed dock is not longer than docks on neighboring properties.
• Toxicity: To protect the waters of Peconic Bay the dock's decking shall be
constructed entirely of non-toxic materials.
• Scope in relation to the riparian rights of shellfishers: The plan provides for a
standard piling design that will permit access beneath the decking for small
vessels at low tide and those seeking shellfish and Crustacea on foot in season.
Accordingly, it does not materially diminish riparian access to harvest beneficial
marine organisms.
• Scope in relation to the rights of small human powered water craft to navigate the
waters adjacent to the proposed dock: A human powered vessel traveling would
not be inconvenienced by the proposed dock. At low tide a kayak might be able .
to paddle beneath most docks in this area.
• Environmental upkeep: The dock design projects a usual lifespan of 30 years
with limited pile replacement so as to minimize disturbance of the bottom.
THEREFORE, on account of the foregoing, the Southold Town Board of Trustees
Approve and Authorize the preparation of a Notice of Negative Declaration pursuant to
SEQRA for the aforementioned project.

Hope all is well. Unfortunately I didn't have time to revise the drawings to show
the proposed dock at a lowered height to match the neighbors design. As this
isn't a crucial design element for the project I would recommend this option be
modified during the public hearing and our permit be based on the revised design
drawings if that is acceptable to the Town. Ultimately there will be no change in

design other than lowering the height of the fixed dock a foot or so, this change
will not impact the approval in any way and will have no effect on the overall
scope of the project.
I will still, need to make this modification with the NYSDEC as well, so one set of
revised plans would be best.

Deep Hole Creek. The Board has required newly constructed docks to be low profile structures.
The plans are incomplete because they do not show the State channet: The State channel is.
closer to their dock/pier and it impedes navigation.They are in a narrower section of the creek and are
closer to the far opposite shoreline: In addition, the water depths are not provided;..
The ramp is too long.Neighboring docks were destgned with shorter ramps. �.
Neighboring docks were designed toibegin the catwalk on the shorelinein order to
public access including stairs on the dock. .�.

The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of
Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards.
Based upon the information provided on the LWRP Consistency Assessment Form submitted to this
department, as well as the records available to me, it is my recommendation that the proposed action is
INCONSISTENT with the below Policy Standards and therefore is INCONSISTENT with the LWRP.
The applicant has not demonstrated that the action meets the below policies.
6.3 Protect and restore tidal and freshwater wetlands.
A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws
and regulations for all Andros Patent and other lands under their jurisdiction
1. Comply with Trustee regulations and recommendations as set forth in Trustee permit
conditions.

terminus of the dock. Vessels located in areas with inadequate
water depth results in bottom scarring, species loss and turbidity.
[6] Whether the dock will cause habitat fragmentation and loss of significant
coastal fish and wildlife habitats;
The proposed action is located within a New York State Critical
Environmental Area. At the discretion of the Board of Trustees, any
operations proposed in critical environmental areas (§ 275-2) may be
subject to more stringent requirements than detailed in this section.
Such requirements may include, but are not limited to, denial of
certain operations, shortening or reducing the size of structures,
and increasing the width of non-disturbance buffers.
[7] Whether the dock will result in the destruction of or prevent the growth of
vegetated wetlands, seagrasses including ee/grass (Zosters marina) and
widgeon grass (Ruppia maritima) or shellfish;
A loss of commercial/recreational shellfishing areas will occur as a
result of this action.
[11] Whether the cumulative impacts of a residential and commercial dock will
change the waterway or the environment and whether alternate design,
construction, and location of the dock will minimize cumulative impacts;
The extension of pre-existing dock structures into public waters to
accommodate larger vessels is changing how the public uses the
waterway.
[12] Whether adequate facilities are available to boat owners and/or operators
for fueling, discharge of waste and rubbish, electrical service and water
service.
Not discussed.
9.4 Assure public access to public trust lands and navigable waters.
E. Provide access to, and reasonable recreational use of, navigable waters and
public trust lands under water.
1 Provide for free and unobstructed public use of all navigable waters below the line
of mean high water for navigation, recreation, and other public trust
purposes, including the incidental rights of public anchoring.
The proposed dock structure (if approved) will result in a perpetual loss in
unobstructed public access and use of public underwater lands equal to the
dock and vessel dimensions. The narrowness of the waterbody in this
section of Deep Hole creek coupled with the length and fixed nature of the
dock could impede navigation of other vessels.
The LWRP states "Piers, docking facilities,.and catwalks must not result in
an unnecessary interference with use of public trust lands. Alternatives to
long piers or docks include use of dinghies to reach moored boats and
mooring in nearby marinas. Dredging solely to accommodate the draft of
larger boats is not a recommended alternative".

In the event that the action is approved; to further policies 6.3 Protect and restore tidal and freshwater
wetlands and Policy 11. Promote sustainable use of living marine resources in Long Island Sound, the
Peconic Estuary and Town waters. It is recommended that the Board require that the silt boom be
deployed during the construction of the structure pursuant to:
§ 275-11 Construction and operation standards.
A. General. The following standards are required for all operations within the jurisdiction of the
Trustees:
(2) Erosion control. Installation of an erosion control structure is necessaN during any
building, grading, landscaping or site work activity within Trustee jurisdiction. This structure may
include, but is not limited to, installation of a silt fence, hay bales, wood chip berm and silt
booms. The placement of the erosion control structure(s) shall be determined by the Trustees or
their designee. All intertidal construction and excavation requires the installation of a silt boom
that will retain all suspended sediments within the immediate project area.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its
written determination regarding the consistency of the proposed action.

LWRP CONSISTENCY ASSESSMENT FORM
A. INSTRUCTIONS
1. All applicants for permits* including Town of Southold agencies, shall complete this CCAF for
proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
making a determination of consistency. *Except minor exempt actions including Building Permits
and other ministerial permits not located within the Coastal Erosion Hazard Area.
2. Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfront Revitalization Program. A proposed action will -be evaluated as to its significant
beneficial and adverse effects upon the coastal area(which includes all of Southold Town).
3. If any question in Section C on this form is answered "yes" or "no", then the proposed action will
affect the achievement of the LWRP policy standards and conditions contained in the consistency
review law. Thus, each answer must be explained in detail, listing both supporting and non-
supporting facts. If an action cannot be certified as consistent with the LWRP policy standards and
conditions,it shall not be undertaken.
