Board of Trustees Appl: tion WETLAND/TRUSTEE LANDS APPLICATION DATA Purpose of the proposed operations: To provide hot tub and an increased, partially roofed-over deck area for outdoor but covered recreational use. Area of wetlands on lot: +/-1,936 square feet Percent coverage of lot: +/-7.8 oia Closest distance between nearest existing structure and upland edge of wetlands: 71 feet Closest distance between nearest proposed structure and upland edge of wetlands: 65 feet (hot tub) Does the project involve excavation or filling? X N o Yes If yes, how much material will be excavated?N/A cubic yards How much material will be filled? N/A cubic yards Depth of which material will be removed or deposited: N/A feet Proposed slope throughout the area of operations: N/A Manner in which material will be removed or deposited: N/A Statement of the effect, if any, on the wetlands and tidal waters of the town that may result by reason of such proposed operations (use attachments if appropriate): In order to maintain and protect the integrity and function of the existing wetland and naturally occurring wetland buffer vegetation on the property, both the proposed hot tub and deck addition are to be located beyond the limit of the existing 65'wide,NYSDEC-covenanted,naturally vegetated wetlands non-disturbance buffer situated adjacent to the freshwater wetlands associated with Lily Pond to the east. Thus, where proposed, neither the hot tub nor the deck addition will require clearing or disturbance of existing natural vegetation;the deck addition will be located farther from wetlands(73') than the existing deck(71'),so there will be no additional encroachment on the existing wetlands setback by the deck;and the hot tub exceeds the 50'wetlands setback required for swimming pools and related structures,as set forth in Section 275-3(D)(1)(a)(5)of the Wetlands Law of the Town of Southold. Although the deck expansion would add only 460 sf of lot coverage to the property, which at 12.7 percent would remain dust over half the code-permitted 20 percent,a drywell is proposed to capture and recharge potential runoff associated with the proposed 375 sf roofed over portion of deck. And a temporary project limiting siltation fence will be installed along the landward limit of the non-disturbance buffer to ensure that the naturally existing buffer and wetland areas are in no way disturbed during construction. Therefore, due to the its design and incorporated mitigation measures, the project will not have any adverse effects on the adjacent freshwater wetland or naturally vegetated buffer area. f 1 617.20 Appendix B Short Environmental Assessment Form Instructions for Completing Part I-Project Information. The applicant or project sponsor is responsible for the completion of Part 1. See LWRP Section III - Policies; Pages 22 through 32 for evaluation criteria. ®Yes ❑ No ❑ Not Applicable In order tomaintain and protea the integrity and function of the existing wetland and naturally occurring wetland buffer vegetation on the property, the proposed deck addition will be located beyond the limit of the existing 65' wide,NYSDEC-covenanted,naturally vegetated wetlands non-disturbance buffer situated adjacent to the freshwater wetlands associated with Lily Pond to the east. Thus, the deck addition will require no clearing or disturbance of existing natural vegetation;and it will be located farther from wetlands(73')than the existing deck(71'),thus creating no additional encroachment on the existing wetlands setback. And although the deck expansion would add only 460 sf of lot coverage to the property, which at 12.7 percent would remain just ova half the code-permitted 20 percent,a drywell is proposed to capture and recharge potential runoff associated with the proposed 375 sf roofed ova portion of deck. A temporary project limiting siltation fence will be installed along the landward limit of the non-disturbance buffo to ensure that the naturally existing buffo and wetland areas are in noway disturbed during construction;and New York State DEC Freshwater Wetlands Permit No.I-0738-03088/00002 has already been issued for the project. Therefore, due to the its design and incorporated mitigation measures, the project will not have any adverse effects on the adjacent freshwater wetland or naturally vegetated buffer area and will be consistent with Policy 6.
