The following action was taken by the Southold Town Board of
Trustees on February 27, 1992:
RESOLVED that the Southold Town Board of Trustees approve the
request to amend permit $3821 to move the house southward as per
DEC.
Please note that this project is subject to Coastal Erosion
review and a application should be submitted as soon as possible.

Dear Sirs:
A permit was issued to construct a one-family dwelling,
sanitary system, etc., on my client's property in Orient.
A copy of your permit No. 3821 is attached for your ready
reference.
Subsequent to receipt of your permit, the NYSDEC denied
their tidal wetlands application largely on the basis of
the home being too close to what they felt to be the high
water line of Long Island Sound. A copy of their denial
letter is attached.
In accordance with the instructions contained in that
denial letter, we have filed a new application with the
NYSDEC, which moves the house southward. As this neces-
sitates a modification in the Trustees' approval, I
request that this be done and that you appreciate the
difficult situation that the applicant is in.
I trust you will agree that these modifications will not
adversely affect the small freshwater wetlands located
along the south side of the property. We affirm our
agreement to remove the old road and plant marsh in the
area as long as the NYSDEC does not ultimately require us
to retain it.

The following action was taken by the Board of Town Trustees during
its regular meeting held on April 25, 1990 regarding the above
matter:
WHEREAS, Eh-COnsultants IN BEHALF OF Perez/Williams applied to the
Southold Town Trustees for a permit under the provisions of the
Wetland Ordinance of the Town of Southold, application dated December
4, 1989 and,
WHEREAS said application was referred to the Southold Town
Conservation Advisory Council for their findings and recommendations,
and,
WHEREAS, a public hearing was held by the Town Trustees with respect
to said application on April 25, 1990 at which time all interested
persons were given an opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar
with the premises in qllestion and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation
submitted concerning this application, and,
WHEREAS, the Board has determined that the project as propoMed will
not affect the health, safety and general welfare of the people of
the town,
NOW, THEREFORE BE IT
RESOLVED THAT EN-CONSULTANTS IN BEHALF OF PEREZ/WILLIAMS BE AND
HEREBY IS GRANTED PERMISSION UNDER THE WETLAND ORDINANCE TO:
Construct a one-family dwelling, pool, deck, sanitary system well,
bluestone (or similar pervious) driveway. Approximately 500 c.y. of
clean fill to be trucked in to raise grades.
CONDITION: Revised plans as Der corresnondence of March 29,
1990, must be sLLbmitted ~ ~- ~O~he Board of Trustees
before a permit will be issue~.
This permit will expire two years from the date it is signed if work
has not commenced by said date. Fees must be paid, if applicable,
and permit issued within six months of the date of this
notification. Two inspections are required and the Trustees are to
be notified upon completion of said project.
Please return to the Building Department for a determination on the
need for any other permits which may be required for this project.
Permit will be issued upon payment of the following fees for work to

truck in fill to raise grade. The CAC disapproves of the project because
the road will go across the freshwater wetlands, the septic system would be
higher than the pond and more information is needed on the hydraulics of the
pond and the property should be staked and marked clearly.
