On May 30, 2017 this office received an application seeking area variances for two proposed non-permitted accessory structures based on a Notice of Disapproval (last revised April 3, 2017) denying your application for a permit to construct a"new accessory hoop house and farm building.. The application was originally scheduled to be heard by the Board at a public hearing on September 7, 2017. The matter was then adjourned pursuant to your written request, and rescheduled for January 4, 2018. Thereafter, on December 4, 2017, this office received a portion of an amended application along with a handwritten request stating that the applicant wished"to amend application #7088 to an interpretation of the Disapproval Letter dated 7-22-2016." Unfortunately, further explanation and/or explanation regarding the requested amendment is needed prior to the Board hearing the application. The request for"an interpretation of the � Disapproval Letter" seeks relief that is outside the jurisdiction of the Board. Pursuant to New York Town Law § 267-b and Section 280-146 of the Town Code, the Board is only empowered to hear an appeal from a decision or determination of the Building Inspector, grant variances from the provisions of Chapter 280 of the Town Code, and interpret any provision of Chapter 280 relating to a decision or determination of an administrative official. #7088, Michael Harkin Page 2 Therefore, in order to further process the application and schedule the matter for a public hearing, the amended application should address the following: • Are you seeking to appeal the determination denying your application for a building permit (i.e., you think the Building Department incorrectly denied your application)? • If you are seeking to appeal the denial of your application for a building permit contained in the Notice of Disapproval, please provide an amended application stating that you seek to appeal the Notice of Determination. Please provide specifics, to the extent possible, as to what you think is wrong with the determination. • Are you seeking an interpretation of the Town Code related to determination made in the Notice of Disapproval? • If you are seeking a determination of the Town Code, please state in your amended application the sections and/or provisions of Chapter 280 that you would like the Board to interpret in connection with the Notice of Disapproval. • Do you still want to seek area variances as an alternative relief? If so, the amended application should include the request for area variances. Please be advised that due to large amount of applications currently being reviewed by the Board, your matter is going to be removed from the Board's January 4`'Agenda and will not be rescheduled until a completed amended application addressing the issues raised in this letter is received.
