HomeMy WebLinkAboutLP-04/17/2018 LAND PRESERVATION COMMITTEE MEETING Minutes & Discussion Notes from Meeting held Tuesday, April 17, 2018 at 7:00 p.m. Town Hall Annex – Land Preservation Department Members Present: Sam McCullough, Chairman Anne Murray Will Lee Doris McGreevy Lillian Ball John Simicich Eric Keil Members Absent: none Also present: Melissa Spiro, Land Preservation Coordinator Melanie Doroski, Land Preservation Secretary Bob Ghosio, Town Board Liaison Holly Sanford, PLT Project Manager Chris Baiz Commencement:  The meeting began at 7:01 p.m. with seven LPC members present. Next Regular Meeting:  The next regular meeting is scheduled for Tuesday, May 1, 2018. Committee Minutes and Adoption:  Acceptance of LPC meeting minutes from April 3, 2018 MOTION made by Anne Murray, seconded by Doris McGreevy, to adopt the 4/3/2018 Land Preservation Committee meeting minutes. Motion carried: 4/0/3 (LPC members Lillian Ball, Eric Keil & Will Lee abstained as they were not in attendance at the 4/3/2018 LPC meeting) Land Preservation Applications and Inquiries: MOTION made by Eric Keil, seconded by Lillian Ball, to enter into Executive Session – Proposed Acquisition, Sale of Real Property Where Publicity Would Substantially Affect the Value Thereof Motion carried: 7/0 The LPC members entered into EXECUTIVE SESSION at 7:03 p.m.  SCTM #1000-83.-2-16 (RICHARD McBRIDE and JAMES McBRIDE) PDR application: Purchase Offer Update \[Executive Session\] Land Preservation Coordinator Melissa Spiro presented status of application. MOTION made by Sam McCullough, seconded by Anne Murray, to end Executive Session. Motion carried: 7/0 EXECUTIVE SESSION ENDED at 7:05 p.m.  SCTM #1000-120.-3-2, 11.8 & 11.10 (PATRICIA DiVELLO) PDR application: Follow-up regarding design concept Land Preservation Coordinator Melissa Spiro presented status of DiVello application and her initial review with Town Board. Area offered for preservation needs to conform to minimum conservation subdivision requirements before Town Board will refer application to Land Preservation Committee to pursue.  SCTM #1000-100.-2-4 (ROGER ROBINSON) PDR application: Review re-activated application Land Preservation Coordinator Melissa Spiro received a phone call from landowner Roger Robinson with his request to re-activate his application. Melissa reviewed former staff report with updates and suggested that LPC do a site visit to the property during the upcoming week and will e-mail possible dates to members.  PROJECT STATUS UPDATE Land Preservation Coordinator Melissa Spiro gave project status updates. Brushes Creek Properties closing scheduled for Friday, April 20, 2018 ADDITION TO AGENDA  SCTM #1000-127.-8-17.4 (CAPITAL ASSET RETIREMENT FUND, LLC) Inquiry: Sale of house lot located within Brushes Creek properties Landowner reached out to find if there was any interest with the County/Town for the acquisition of the house lot (SCTM #1000-127.-8-174) that has use of the right-of-way access lying within the Brushes Creek properties. Melissa directed to bring this inquiry before the Town Board. Inquiries for Uses or Structures on Preserved Property  SCTM #1000-96.-2-10.1 Review preliminary inquiry from ZBA regarding special event request Land Preservation Coordinator Melissa Spiro reviewed preliminary inquiry from ZBA regarding a special event request for a “restaurant without walls” event at 8 Hands Farm in September 2018. Sketch plan appears to show part of the event taking place within PDR land. MOTION made by Sam McCullough, seconded by Eric Keil, that the proposed Outstanding in the Field event, described as a restaurant without walls, is not consistent with agricultural production as defined in Chapter 70 and is not consistent with the terms of the recorded Development Rights Easement. Stewardship and Management: None General Land Preservation Items:  DISCUSSION OF VARIOUS PERSPECTIVES OF TOWN PRESERVATION PROGRAM Chairman Sam McCullough led discussion on various perspectives of the Town’s Farmland Preservation Program: 1) To protect farmland and thus farming as a component of the character of our community. 2) Decrease residential density. 3) There is a misconception among the public that farmland preservation equals open space preservation, prohibiting agricultural building to preserve views. 4) Many in the farming community believe that farmland preservation should only restrict the right to subdivide land and build houses. All other uses allowed under zoning should remain with the property. Chris Baiz, local vineyard owner and Chairman of Southold Town’s Agricultural Advisory Committee, suggested LPC recommend to the Town Board that changes be made to the Town Code to let Town buy all development rights on a farm but allow a Farm Homestead, ag production, etc. on Town preserved lands to keep farms viable for the future of farming. Land Preservation Coordinator Melissa Spiro presented information on Town Easements that were specific to scenic restrictions and/or lowered lot coverage restrictions. Adjournment: MOTION made by Eric Keil, seconded by Sam McCullough, to adjourn this meeting. Motion carried: 7/0 The meeting ended at 8:40 p.m. with seven LPC members in attendance.
