Dear Mr. Dart:
As required in condition number 1 in Town Board Resolution No. 2017-728, we are now
in receipt of proof of payment for 100 juvenile living Christmas Trees as set forth in the contract
annexed to your application to hold a Special Event on September 30, 2017. Consequently,
enclosed is the Special Event Permit for the subject event. A duplicate of this permit must be
continuously posted during the event. This permit is granted subject to the following other
conditions set forth in Town Board Resolution 2017-728:
2. Any noise emanating from the subject property shall be in compliance with Section 180-6 of
the Town Code, and:
3. There shall be no amplified music at the subject property on the day of the event after
10.00PM, and:
4. Access from Willow Pond Lane shall be for emergency vehicles only.
There are also several general conditions written into the permit. Please be aware that
under the State Fire Code, the number of persons occupying the building and/or tent area is
limited. The use of a tent will require an application and approvals at least three days before the
event, from the Building Department. A Town Building Inspector must inspect the tent, before
occupancy, they can be reached at 765-1802 between the hours of 8 a.m. and 4 p.m.
This permit does not authorize parking on Suffolk County Right of Way located in front
of the property or any lands owned by County of Suffolk, Town of Southold or Peconic Land
Trust. All parking and traffic controls are the responsibilities of the event operators, and their
agents. Note that parking on any County or State Roads are not authorized under this permit.
Any violations of this permit can be cause for revocation. The Town also reserves the right to
revoke any permit or deny future permits if the event(s) generates unforeseen impacts to the
health, safety or welfare of residents and guests of the Town

RESOLVED that the decision of the Chairperson of the Zoning Board of Appeals dated June 23,
2017 denying the Special Event application of Old Town Farm to hold a private wedding on
September 30, 2017, is hereby reversed, and the Chairperson of the Zoning Board of Appeals is

Dear Mr. Dart:
1 am in receipt of your Special Event application submitted on June 8, 2017 for a private
wedding and reception to be held on the premises noted above on September 30, 2017.
According to the procedures and standards of special event provisions detailed in Chapter
205 of the Southold Town Code, a special event approval shall be determined after careful
consideration of any or all impacts on adjacent property owners and the surrounding
neighborhood.
In response to a previous special event application for a wedding that you submitted last year,
in consultation with me, the Town Attorney informed you in a letter dated July 28, 2016, that
the following criteria for allowing special events on your property had not been met:
1. No nexus between marketing your agricultural products as a tree farm operation and a
wedding event
2. The fact that a catering use is not permitted in the R-40 Zoning District
3. A use variance must be approved for a special event to take place on,the premises.
As a result, I denied your application. Pursuant to Section 205-6 of the Town Code you
appealed that decision to the Town Board who requested additional information from you.
Upon receipt of that information, I approved your application on September 30 2016 for that
one event only and conditioned upon the Town having the right to revoke any permit or deny
future permits if events generate unforeseen impacts to the health, safety or welfare of
residents and guests of the Town.
After the wedding event was held on your property on October 1, 2017, the Town received
complaints from three adjoining residential property owners citing excessively loud music

and noise disturbances. Subsequently, I am denying your request for a special event that
involves a wedding with catering and live music.
Pursuant to Section 205-6 of the Southold Town Code, an applicant who is denied a permit
by the Chairperson of the Zoning Board of Appeals may apply to the Town Board for
reconsideration of the applications by filing an appeal with the Town Clerk within ten (10)
days of the date of denial.

PERAUSSION IS HEREBY GRANTED,SUBJECT TO THE FOLLOWING CONDITIONS:
1. By acceptance of this permit, applicant agrees to adequately supervise and direct all parking to be on the
premises or at another site, and to provide parking assistants and any additional traffic controls necessary for this
event.Parking is strictly prohibited on ANY Town.County or State Roads or Rights of Way.
2. Traffic control at events for three hundred(300)or more people shall be provided by a qualified traffic controller
in accordance with the attached,approved traffic control plan.
3. One "on-premises" sign not larger than six (6) square feet in size may be displayed not longer than thirty (30)
days before this event, and removed immediately after the event. Directional parking signs shall be adequately
displayed.

losses including but not limited to attorney's fees arising from activities under this permit.
5. Tent proposals must receive permit approval from the Southold Town Building Inspector before placement on
the property and must meet all fire and safety codes.
6. This permit is valid only for the time, date, place and use specified above, and for the designated event. Each
additional day will require a separate permit application, fee, and related documents for review, etc. at least 60
business days prior to the scheduled event.
7. Adequate temporary sanitary facilities must be provided by applicant for this event and applicant agrees to
remove the temporary facilities from the premises within 48 hours after the day of the event.
8. On-site food preparation is NOT permitted, although food may be catered subject to all Suffolk County
Department of Health regulations.
9. NO activities associated with this event, including but not limited to parking, in rgress/egress/access, tent(s) or
temporary, structure(s), or temporary sanitary facilities, shall be conducted on Town of Southold Purchase of
Development Rights land.
10 NO activities associated with this event, including but not limited to parking, ingress/egress/access, tent(s) or
temporary structure(s), or temporary sanitary facilities, shall be conducted on Suffolk County Purchase of
Development Rights land without a permit issued by the Suffolk County Farmland Committee.
11. Issuance of this permit does not authorize in any manner the occupancy of any building exceeding the legal
limitations under the fire code or other codes which would prohibit such increased occupancy.
12. Access shall be provided for emergency vehicles,to all public assembly areas, all buildings, all work areas and
any additional area where emergencies may occur. Two emergency-fire exits and exit paths from the building(s)on
the property,to a public way or remote safe area,shall remain open and unobstructed at all times.
13. Owner assures that all fire,safety,building,and other laws will be complied with.
14. Music,when outdoors,is required to stop at the time specified in the permit.Placement of the speakers must be

Nature of Event: The Helf family of Peconic wishes to utilize a portion of the premises at The Old Town
Farm in Southold for the purposes of a private wedding and after-wedding reception for not more than
200 guests. The Helf family has been friends and acquaintances of the farm proprietor for over ten years.
Three members of the Helf family have been prior employees at the farm.
As a precondition to having their event at the farm, the bride and groom have entered into a contract for
the purchase of agricultural products from the farm. A copy of that contract is included with this
application. The event also will include the viewing of antique farm tools, dissemination of information
about farming history unique to this property as well as the solicitation of the sale of additional farm
products to the event guests.
Facilities: The event shall include the use of the historic barn and barnyard for the wedding and social
reception purposes. As noted on page one of the application, a tent shall also be erected on the farm
property for a sit-down dinner reception. The services of a property licensed caterer will be employed.
Live music will be included in the festivities. Music volume shall comply with applicable Town codes and
shall be directed away from closest adjoining neighbors to minimize noise intrusion. It is anticipated that
music will end by 10PM. Festivities will be concluded by 11:00PM and the property vacated as soon as
reasonable thereafter. Both the bam/bamyard location and tent location are shown on the surrey that is
a part of this application, as well as locations of portable sanitary facilities and trash dumpster. Temporary
sanitary facilities and trash shall be removed within 48 hours after day of the event.
Parking: Not more than 100 vehicles are expected for the event. All parking shall be on-site and
contained within the parcel in the parking areas shown on the attached parkinglevent plan. No parking
shall be on any town road.
Ingress/egress: To mitigate traffic impacts on neighboring properties to the greatest extent possible, all
ingress and egress to the subject property during this event will be from Main Bayview Rd. Proper
directional signs shall be placed temporarily at the points of ingress/egress. An on-site event manager will
supervise parking, ingress and egress,noise and all other event attributes.

Enclosed is the Special Event Permit for the event planned for October 1, 2016.
A duplicate of this permit must be continuously posted during the event. This grant is
based upon additional information in your resubmission on September 27, 2016 that was
lacking in your original application submitted to my office on July 6, 2016. Details of the _
incomplete application were described in a letter to you from the Southold Town
Attorney dated July 28, 2016. The missing information was requested by the Town Board
during your appeal to them of my denial. This information consists of an event contract
for the purchase of 200 of your juvenile Christmas trees by Kristen Hand, the person
renting your property for a private after-wedding reception and farm tour; and the
information you provided on off-site parking inter alfa in your August 5, 2016 letter of
appeal to the Town Board, which took no action to uphold or overturn my denial.
Please take note that your resubmission application is still deficient in that it does
not include the required license number (Suffolk County permit) for the food vendor;
fails to provide the calculations for onsite parking explicitly described in the application
form; and because the included aerial view of your property depicting parking,
ingress/egress, sanitary facilities, tent location and property boundaries is unclear and
vague. Nevertheless, given that the closeness of the event date does not allow sufficient
time to remedy these deficiencies, I am approving your application with the
understanding that this approval is for this event only and should not be construed to
assume approval of any future events on your property.

This permit is granted with the following condition: To mitigate traffic
impacts on neighboring properties to the greatest extent possible, all ingress and
egress to the subject property during this event must be from Main Bayview. There
are several other conditions written into the permit. Please be aware that under the State
Fire Code, the number of persons occupying the building and/or tent area is limited. The
use of a tent will require an application and approvals at least three days before the event,
from the Building Department. A Town Building Inspector must inspect the tent, before
occupancy; they can be reached at 765-1802 between the hours of 8 a.m. and 4 p.m.
This permit does not authorize parking on any lands owned by the County of
Suffolk, Town of Southold or land for which an agricultural property tax exemption has
been granted. All parking and traffic controls are the responsibilities of the event
operators, and their agents. Note that parking on any County or State Roads are not
authorized under this permit. Any violations of this permit can be cause for revocation.
The Town also reserves the right to revoke any permit or deny future permits if the
event(s) generates unforeseen impacts to the health, safety or welfare of residents and
guests of the Town.

Nature of Event:
Guests, by invitation only,will be invited to an old fashioned farm event for
historic farm tours, purchase of ar,gicultural products (trees), meal, entertainment
and dancing.
Non-handicapped guests will park remotely and be transported to the site by
shuttle bus.A limited number of parking spaces (less than 20) will be reserved on
the barn parcel for those guests who are handicapped or have limited mobility.
No parking will be on that portion of the farm for which an agricultural property

Farm tours will encompass a talk on the history of the farm since its

I am the Town Attorney for the Town of Southold and am writing to you in my capacity
as counsel to the Zoning Board of Appealsi:("ZBA")on behalf of Chairperson Leslie Weisman
with regard to the above-referenced application.
The subject property is looted in the"Low-Density Residential(R-40)"zoning district
("R40")and is currently used for a single family residence and a tree farm. When a business
makes an application for a special event permit,the Cheirpemon of the ZBA examines the
proposed special event to determine if there is a nexus between the special event and the business
currently being operated*on the property. By way of example,wineries are granted special event
permits for weddings because their wine is featured at the weddings and therefore,weddings iare
seen as an opportunity For wineries to market their products.
Your application to the office of the ZBA states that the special event permit is being
requested for an"old fashioned farm event for historic farm tours,purchase of agricultural
products(trees),meal, entertainment and dancing." However,it has come to our attention that
the event is actually a private wedding: Heir,there does not appear to be any nexus between;the
tree farm operation and this wedding event Therefore,the special event is a change.of use on
the property. Since catering is not an allowed use in the zoning district in which your property is
located, an application to the ZBA for a use;variance must be approved for this type of event to
take place on the property.

Finally,the application states thatIess than 20 parking spots would be provided on site
for guests who are handicapped or have limited ability and non-handicapped guests would'park
remotely and be transported to the property by shuttle bus. Attached to the application is an
aerial photo showing a"barnyard parking,area." However the application fails to establish that
the area is sufficient to accommodate even the limited number of cars that the application states
will be parking on site. Additionally,the.application fails to provide any information regarding
the off-site parking such as the size or location of the off-site parking-

I was recently denied permission to hold'a special private event at my farm by the Chairwoman of the
Zoning Board of Appeals. I respectfully request that you reconsider my applicationand grant permission
for the event_ The original.application,the ZBA response,and a letter from the Town Attorney are attached
for your review.
BACKGROUND:
I have poured a lifetime of energy,as di&my father and grandfather before me into maintaining and
preserving this historic pre-revolutionary fano Circa 1753 as on ongoing agricultural enterprise. We have
farmed this land for 100 years.I am now 67 years old and times are changing.I have no successors
interested in agriculture at this time. Growing and selling Christmas trees,which need a 8-10year plant-to-
harvest time requires a long time to generate'cash flow,and is becoming more strenuous for me. I must
find new methods of selling my crop in order.to maintain the property as a viable agricultural enterprise.
Recently,I was approached by a young couple desiring to host their after-wedding reception at the
farm.In exchange for making the premises available,I would be compensated by their purchase of a very
substantial quantity of my juvenile Christmas trees intended for gifting as lasting, living and growing
memories of their marriage and of their day at the farm. In addition,I will have the opportunity to
showcase and promote my tree sales to many first time on-site potential customers.They will receive from
me the opportunity to step back into history at The Old Town Farm and enjoy its picturesque uniqueness,
historic barn tours,viewing of antique farm equipment and an educational presentation on local agriculture
over the years.
This,to me is an innovative means to genef�ite tree sales revenue without needing to wait the entire 8-
1 Oyear production time,as well as bringing good exposure to the farm for its other products. I am seeking
your support in my agricultural survival efforts.
PERMIT APPUCATION RECONSIDERATIONS
1.NEXUS; In the letter of denial,Mr Duffy states that there is no Nexus or connection between:the

2. WEDDING; Contrary to Mr Duffy's impression,there is no wedding. Guests who have previously
attended a off-site wedding are invited for the after-wedding farm event The couple wishes to avail their
guests of the opportunity to experience the historic farm,the fields of Christmas trees,farm tour,farm
museum collection and learn about farming life going back 200 years and,importantly to leave the event
with a young Christmas tree which makes a beautiful and lasting connection between"their day"and a
growing future together.
3. PARKING; Guest panting is off-premises as stated in the application. I didn't know it was necessary
to state exactly where the off site parking location is,but for your information it will be in Cutchogue at the
church where the wedding is performed. Guests will be shuttled from the parking location to the farm
event. On-site parking to easily accommodate 20 cars will be available in the barnyard area for those
guests who have special mobility needs.These parking locations are shown on the included aerial photos.
4.CATERING; We are not in the business of providing catering services. Catering is not the useof the
property, it is an accessory to the farm event.
5.FUTURE EVENTS; We do not have any immediate plans,but any firture events will be limited by farm
products available and will in any event require further application to the Town_

Brief Description of I thought this was a residentially zoned area with an exception

music and microphones voices and hundreds of people
screaming in my backyard. In addition, there is a giant bus in
the front yard, approx 50-100 feet away from my front door that
is running and revving its engine! I did not spend a fortune on
my house over 10 years ago so this man would be allowed to
rent his space out to a circus! Who gave this man permission to
do this against all the laws that Southold has to protect its
residentially zoned residents!!!

Dear Board Members,
On October 1 a special event was held at the Old Town Farm formally known as Darts Christmas Tree Farm.
The music from this event was so loud that even though my house is at least one half mile south of the event
the thumping music and the announcements made by the DJ could be clearly heard in my living room with
the windows closed and the N on.
I spoke with the Southold Town Police and they informed me that this could go on until 11pm.
In addition,when I rode by I noticed that there was a bus parked in the recently constructed turn out
on Bayview Road.
I hope that this event is the last one of its kind and this"Farm"does not become a venue for more
"Special Events" similar to what has evolved at the various vineyards.
In closing, I must state that this event shattered the peace and quiet that-the adjacent homes have
come to enjoy in this part of Southold Town.
` Furthermore, I find it incredulous that the town allows agricultural establishments to hold "Special Events"
which have no connection to agriculture yet destroys the peace of historically quiet neighborhoods.
I strongly urge the board members to deny any special event permits for this:location that will include
amplified sound.
