SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated January 16, 2018 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated March 22, 2018. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to us, it is our recommendation that the proposed action is EXEMPT from Coastal Consistency Review. The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION. The applicant's parcel is a non-conforming 22,351 square feet corner lot located in the R-40 Zoning District with 224.47 feet frontage ori Bay Avenue and additional road frontage of 83 feet on Tuthill's Path, a private dirt road (24 feet wide right of way). The eastern lot line, shared with a residential neighbor, measures 221.84 feet with a southern lot line of 118.27 feet on Marion Lake. As a result of a corner location, the property is classified as having two front yards. The parcel is currently improved with a one-story, wood-frame, single-family residence of approximately 1,636 square feet, a wood deck and concrete retaining wall, walkways and steps, fencing and a small, waterside, concrete building. Marked "to be removed", are a waterside wood deck accessed by stairs from the deck above and a frame shed, located in the Tuthill's Path front yard as illustrated on the survey prepared by Nathan Taft Corwin, I11, Land Surveyor, dated September 26, 2017. BASIS OF APPLICATION: Request for a Variance from Article XXIII, Section 280-124 and the Building Inspector's November 13, 2017 Notice of Disapproval based on an application for a building permit to construct additions and alterations to an existing single-family dwelling; 1) located less than the code required minimum Page 2, April 19, 2018 #7153, Robalino SCTM No. 1000-31-9-21.1 front yard setback of 40 feet; located at: 1695 Bay Avenue (Adj. to Marion Lake) East Marion, NY. SCTM#1000- 31-9-21.1. RELIEF REOUESTED: The applicant requests a variance to construct additions and alterations to the existing single family residence, including a wood deck of 448 square feet measuring 28 feet in length and 16 feet in depth on the west side of the residence with a front yard setback of 15.7 feet where the Code requires a front yard setback of 40 feet. AMENDED RELIEF: During the hearing the Board discussed with the applicant bringing the plan into more conformity with the code. The applicant agreed to reduce the size of the proposed deck from 16 feet in depth of 14 feet which would increase the proposed front yard setback to 17.7 feet and thereby reducing the deck to 392 square feet in size. On April 17, 2018, the applicant's representative submitted an updated survey (revision date April 15, 2018) depicting an increased front yard setback of 17.7 feet, and the reduction in depth of the proposed deck to 14 feet, as discussed by the Board. Building plans dated April 17, 2018 were also submitted. ADDITIONAL INFORMATION: No member of the public spoke at the hearing in favor of, or against this application. The Board discussed the existing non-conforming 6 foot high chain link fencing along the front yard property line. The applicant and their agent stated that they will be removing this fencing running along Bay Avenue and replacing it with a 4 feet high fence that conforms to the Code. Furthermore, the applicant agreed to apply for a Certificate of Occupancy for the"as built' rear deck located on the southeast corner of the residence. A Pre-Existing Certificate of Occupancy, Z-22150, was issued February 22, 1993. The applicant was also asked to submit prior variances for other non-conforming front yard setbacks, and documentation of general non- conforming front yard setbacks in the neighborhood. On April 17, 2018,the applicant submitted comparative front yard setback relief to neighboring properties. They are listed as No. 830 granted March 24, 1966,No. 3079 granted on March 8, 1983, and No. 6868 granted on July 16, 2015, all receiving front yard setback relief of 14 feet, 20 feet and 15.8 feet; respectively. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on April 5,2018 at which time written and oral evidence was presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law &267-b(3)(b)(1). Grant of the relief as amended will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The general residential area surrounding Marion Lake is made up of single-family residences on non-conforming lots of varying shapes, configuration and access many of which are sited on the lake or the Peconic Bay. The subject property has a unique terrain; level on the north side fronting on Tuthill's Path and sloping down to Marion Lake on the south side with the residential structure built into the embankment above the lake and Bay Avenue. The majority of the neighborhood's original bungalows have been renovated into more substantial homes reflective of modern needs, many of which have customary front porches. While a deck on the front facade of a home is not a common feature in this neighborhood, the placement of the proposed addition, is offset by the fact that it will service the kitchen, dining and living room areas and will sit above the roadway, not visible from below. 2. Town Law 4267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The existing residence is sited close to Bay Avenue and has stood for many years without incident; it was constructed prior to Zoning with a front yard setback of 27.9 feet. Moreover, relocating the proposed addition to a conforming location on the east side would not allow the applicant Page 3, April 19, 2018 #7153, Robalino SCTM No. 1000-31-9-21.1 the same benefit for ease of use, owner and guest enjoyment and privacy as the bedrooms are located on this side of the structure and there is an immediate residential neighbor. The proposed location works logically with the existing floor plan 3. Town Law 4267;b(3)(b)(3). The variance as applied for is mathematically substantial, representing 60.75% relief from the code. However, the relief granted as amended herein will reduce that relief to 55.7 percent and, while still substantial, will enable to the applicant to enjoy an outdoor deck that will logically provide access from the kitchen, dining and living room areas of the dwelling, and will sit above the roadway, not visible from below 4. Town Law 4267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law §267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law 4267-b. Grant of the requested relief as amended is the minimum action necessary and to enable the applicant to enjoy the benefit of alterations and additions including a deck addition while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Planamento, seconded by Member Weisman (Chairperson), and duly carried, to DENY the variance as applied for, and GRANT THE RELIEF AS AMENDED for front yard setback of to the proposed deck of 17.7 feet as shown on the survey prepared by Nathan Taft Corwin, III, L.S. submitted to the Board on April 17, 2018, and last revised April 15, 2018. SUBJECT TO THE FOLLOWING CONDITION: 1. Applicant shall remove all existing non-conforming fencing from the subject property 2. The applicant shall obtain Trustee's approval to legalize the as built deck and stairs on the south side of the dwelling Any deviation from the variances) granted herein such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured, and/or a subdivision map has not been filed with the Suffolk County Clerk, within three Page 4, April 19, 2018 #7153, Robalino SCTM No. 1000-31-9-21.1 (3) years from the date such variance was granted. The Board of Appeals may, upon written request prior to the date of expiration, grant an extension not to exceed three (3) consecutive one (1)year terms. Vote of the Board: Ayes: Members Weisman (Chairperson), Goehringer, Dantes,Acampora, and Planamento. This Resolution was duly adopted(5-0). Upon application of WALTER GAIPA, 360 Lakeview Terrace, East Marion, NY, for variances to: (a) the Zoning Ordinance, Article XIV, Section- 100-141B and Article III, Section 100-32 for permission to construct accessory building in the frontyard area, and (b) New York Town Law, Section 280-a for approval of access. Location of Property: 360 Lake- view Terrace, East Marion, NY; County Tax Map Parcel No. 1000-31-09-012. By this appeal, appellant seeks permission to replace the existing 12' by 29' accessory storage building located approximately one foot from the front property line_abutting the private right-of-way with_a new 3`2' by 30' accessory storage building, to,:be located 18 feet from the front property__line_ as depicted on survey, submitted with the subject application. The parcel in question contains an area of approximately 11,120 square feet and borders Marion Lake. Existing on the premises is a one-family l'h-story frame dwelling and the accessory building which is the subject of this application. Access to this parcel is over a private right-of-way extending from Bay Avenue in an easterly direction 210 -feet in length and 24 feet in width, and runs thence in a northerly. direction a width of 20 feet 58.0 feet to the premises in question. Applicant is also seeking approval of access over this right-of-way, and the board finds after personal. inspection that the right-of-way is in fine, satisfactory condition. For the record it is noted that a prior appeal has been made concerning this property under Appeal No. 2156 in which the appli- cant was granted permission to construct the existing accessory build- ing in the front yaxd on July 1, 1976. In considering this appeal, the board determines that -the variance request is not substantial in relation to the requirements of the zoning code; that the circumstances are unique; that by allowing the 'variance "? no substantial detriment to adjoining properties will be created; -.that the difficulty 'cannot be obviated by a method feasible for appellant other than a••variance; that-the relief requested will be in harmony with and promote the general purposes of zoning; and in view of the manner in which the difficulty arose and in consideration of all the above factors, the interest of justice will be served by allowing the variance as indicated below. PROPERTY FACTS/DESCRIPTION: The property is a non-conforming 9,000 square foot lot located in an R-40 zone. The parcel is a corner lot located on the corner of Tuthill's Path and Lakeview Terrace. Lake View Terrace is a Right of Way which gives several properties access to Truman's Path. The parcel has 100 feet of frontage on Lakeview Terrace and 90 feet of frontage on Tuthill's Path. The parcel runs 100 feet along the West side and runs 90 feet on the North side. The parcel is improved with a 1 story frame dwelling a wood plat. Town Law 4267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The neighborhood consists of single family homes built on non-conforming lots. There are other homes built closer to the right of way than what the applicant is proposing. The addition of a screened in porch to the applicant's home will not change the character of the neighborhood. 2. Town Law $267-b(3)(b)(2).The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The existing structure is less than 35 feet off of the right of way. Any additions and alterations on the East side of the house will require the applicant to seek variance relief. The property has two front yards. The architectural front yard runs along Truman's path. The applicant proposes to build the covered porch in the architectural side yard. 3. Town Law 5267-b(3)(b)(3). The variances granted herein are mathematically substantial, representing 55 % relief from the code. However, the additions and alterations are being made in an architectural side yard and Lakeview Terrace is a Right of Way which does not serve many residences. 4. Town Law §267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law 5267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law 5267-b. Grant of the requested relief is the minimum action.necessary and adequate to enable the applicant to enjoy the benefit of a screened in porch while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community.
