SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 thru A-14-25 to the Suffolk County Department of Planning issued its reply dated December 27, 2017 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated March 22, 2018. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to us, it is our recommendation that the proposed action is EXEMPT from Coastal Consistency Review. PROPERTY FACTS/DESCRIPTION: The property is located at 860 East Road, (Adj. to Cutchogue Harbor) Cutchogue, NY. The overall size of the property is 21,287 square feet. The southerly line that is adjacent to Cutchogue measures 53.46 feet, the westerly line measures 432.44 feet, the northerly line measures 55.00 feet and borders East Road, and the easterly line measures 422.77 feet based on the survey prepared by John C. Ehlers, LS, dated January 1, 2018. The applicant's property is a long narrow waterfront parcel in an R-40 District. The property is improved with a two story residence, a detached wood deck and a one story single car garage. BASIS OF APPLICATION: Request for a Variance from Article XXIII, Section 280-15 and the Building Inspector's December 26, 2017 Notice of Disapproval based on an application for a building permit to demolish and reconstruct an existing accessory garage; at; 1) located less than the code required minimum front yard setback of 40 feet; located at: 860 East Road, (Adj. to Cutchogue Harbor) Cutchogue,NY. SCTM#1000-110-7-23. RELIEF REQUESTED: The applicant requests a variance to demolish the existing wood frame single story garage which is in a very poor state of disrepair, and to build a new single car garage with a second story, not to exceed 18 feet in the same location with a front yard setback of 19 feet where the code requires 40 feet. The second floor is to be used for storage space. Page 2,April 19,2018 #7152, Kilbride SCTM No. 1000-110-7-23 ADDITIONAL INFORMATION: The Board received two letters from the applicant's neighbors. One neighbor wrote in support of the project as the present garage is an eyesore. Furthermore, both neighbors supported the location of the existing and proposed new garage because the conforming front yard setback location would cause an undesired outcome and negatively affect views from their properties. The applicant presented photographs of previous decisions in the community by the Zoning Board of Appeals for non-conforming front yard setbacks. In Appeal #5362, November 6, 2003 the Board granted a front yard setback of 7 (seven) feet and in Appeal #6468, May 18, 2011 a variance for a 22.5 front yard setback was granted, for properties on East Road. On April 19, 2018, an amended building plan was received dated April 10, 2018, which depicts the height (top of ridge) of the garage at 17.8 feet which is conforming to the Town Code. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on April 5,2018 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law §267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The proposed garage will replace an existing structure in the same location that is currently in disrepair. The community of Fleet's Neck, where prior front yard area relief was granted, consists of mostly older homes upon nonconforming lots that were built before the adoption of zoning laws. 2. Town Law 4267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The applicant stated the new garage will be built in the same footprint of the existing garage but with a height of 18 feet in order to make the area above the garage useable for storage. The property-has a deep slope on the easterly side making it difficult to relocate a new garage and requiring extensive regrading of the property. Furthermore, because of the narrowness of the area lots; a conforming location may have a negative impact to the views from neighboring lots. 3. Town Law 4267-b(3)(b)(3). The variance granted herein is mathematically substantial, representing 52% relief from the code. However, this condition can be mitigated by the fact that the many properties within the community have front yard accessory structures close to the road front. 4. Town Law 4267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The proposed new accessory garage will be located within the same footprint as the existing accessory garage which has been in this location without adverse impact since prior to zoning. Placing the garage at the conforming distance may have a negative aesthetic impact and require the regrading of a sloping front yard. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. In the community of Fleets Neck there are many road front garages in existence. 5. Town Law &267-b(3)(b)(5). The difficulty has not been self-created. The garage to be demolished was in place before the adoption of current zoning laws. 6. Town Law 4267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a new garage with a second story for storage while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. Ehlers L.S., dated January 23, 2017 and building plans prepared by Anthony Portillo, R.A. LEEK AP, dated April 10, 2018. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s)granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall.become null and void where a Certificate of Occupancy has not been procured, and/or a subdivision map has not been filed with the Suffolk County Clerk,within three (3) years from the date such variance was granted. The Board of Appeals may, upon written request prior to the date of expiration, grant an extension not to exceed three (3) consecutive one (1)'year terms. April 5, 2018 ZBA Hearing Dear Chairwoman Kanes-Weisman and Members of the Board: I am writing regarding the application of the Kilbride Family for the replacement of the detached garage on their family property which is directly alongside my home. My house is the closest neighborhood structure to the proposed garage. I plan to attend the ZBA meeting but also have put my thoughts in writing for your consideration. I am in favor of this project and support the replacement of the garage at the existing location.The current garage has stood in this location, I would guess,for 100 years or more. Along East Road and West Road and neighboring roads here in Fleets Neck there are many, many houses and garages similarly constructed close to the road. This is typical. As you know,this is a very old neighborhood which was mapped and developed long before current zoning guidelines. The proposed garage will be a big visual improvement in our tight neighborhood. But as I understand the current zoning requirements,the normally required positioning of a new garage would be a set back farther from the road,which means building closer to my house. I am not in favor of that location. I would lose a sense of open space from my yard and back porch as well as losing the screening that the current garage location provides me from Beach Parking congestion. Additionally,the zoning required site would necessitate significant re-grading of the Kilbrides' heavily sloped yard which would result in a strong negative appearance in contrast to the current beautiful natural slope of our adjoining properties. The appropriate location for the new garage based on: (1) the historic neighborhood positioning of buildings,and (2)my own preference to not be crowded in on our narrow lots by this new construction, is the location of the current garage. In conclusion, I believe that I am the neighbor most affected by this proposed construction. I am pleased to see the project proceed and I am strongly in favor of rebuilding at the current street-side location. A current Zoning requirement that the new garage be constructed further from the road would move the new garage down closer to our house which we do not prefer. Due to the steep slope of our adjoining properties,such a repositioning would require significant re-grading and installation of fill to level that portion of their site,even to the extent of construction of a retaining wall or high profile foundation wall.Such construction would be in full view from our house which lies below this site in elevation.This is not an attractive outcome for us.The present natural slope of the adjoining properties,and sense of open grass area which we share visually would be lost.
