Dear Mr. Verity:
I enclose surveys produced by John Ehlers with regard to the above-captioned
property.
Prior to my clients acquiring the property,the then owner obtained a Building
Permit and pursuant to same completed construction of a small extension. I enclose
paperwork from your department in that regard. It is hard to believe that the then owner
went to the trouble of applying for a Building Permit,finished the construction and did
not request an inspection and a Certificate of Occupancy. My client was then represented
by Phillip J. Ofrias,Jr., Esq.,who moved out of state and I understand is no longer alive.
Therefore, I have no ability to reach out to my clients' attorney to see if there is any
Certificate of Occupancy in his file. When my clients purchased the home with the
extension completed,they were unaware of the lack of C.O. Thereafter, my clients
obtained Building Permits for other unrelated improvements and the Town issued
Certificates of Occupancy for same. No one pointed out any absence of a Certificate of
Occupancy for the small extension.
I would ask that the Town arrange for an inspection of the property with a view
towards issuing the Certificate of Occupancy based upon the fact that the construction
was completed over thirty-five years ago. My clients are under contract to sell their
home so we need to promptly obtain the Certificate of Occupancy.
