Located: 520 Park Avenue, Mattituck. SCTM# 1000-123-8-28.4 The proposed actions have been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed actions are INCONSISTENT with the below Policy Standards and therefore is INCONSISTENT with the LWRP. 4:2 Protect and restore natural protective features. Natural protective geologic features provide valuable protection and should be protected, restored and enhanced. Destruction or degradation of these features should be discouraged or prohibited. C. Minimize interference with natural coastal processes by: 1. providing for natural supply and movement of unconsolidated materials and for water and wind transport 2. limiting intrusion of structures into coastal waters D. A limited interference with coastal processes may be allowed where the principal purpose of the structure is necessary to: 1. simulate natural processes where existing structures have altered the coast 2. provide necessary public benefits for flooding and erosion protection 3. provide for the efficient operation of water-dependent uses It is recommended that a Coastal Engineer be contacted to determine if the restoration of the groin would provide a benefit or adverse impact to the natural coastal processes in the area including the relationships of the groins to the east and west. Limited interference is to be mitigated to ensure that there is no adverse impact to adjacent property, to natural coastal processes and natural resources, and, if undertaken by a private property owner, does not incur significant direct or indirect public costs Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. All applicants for permits* including Town of Southold agencies, shall complete this CCAF for proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This assessment is intended to supplement other information used by a Town of Southold agency in making a determination of consistency. *Except minor exempt actions including Building Permits and other ministerial permits not located within the Coastal Erosion Hazard Area. 2. Before answering the questions in Section C, the preparer of this form should review the exempt minor action list, policies and explanations of each policy contained in the Town of Southold Local Waterfront Revitalization Program. A proposed action will be evaluated as to its significant scant beneficial and adverse effects upon the coastal area (which includes all of Southold Town). If any question in Section C on this form is answered "yes" or "no", then the proposed action will affect the achievement of the LWRP policy standards and conditions contained in the consistency review law. Thus, each answer must be explained in detail, listing both supporting and non- supporting facts. If an action cannot be certified as consistent with the LWRP policy standards and conditions, it shall not be undertaken. See LWRP Section III - Policies; Pages 22 through 32 for evaluation criteria. 1`71 Yes ❑ No ❑ Not Applicable LWRP CONSISTENCY ASSESSMENT FORM ADDENDUM FOR MATTITUCK PROPERTY FAMILY TRUST 520 PARK AVENUE EXTENSION MATTITUCK,NY SCTM #1000-123-8-28.4 Policies 4 & 6 The project consists of the ordinary and routine maintenance of a historically existing erosion control structure, specifically the in-place replacement of an existing timber groin that pre-dates the Town's jurisdiction over erosion control structures along the Town's bayfront. Together with the surrounding groins to the east and west, the subject groin is part of a larger groin field that serves the historical role of erosion control along this developed shoreline through beach retention; and through its replacement, the groin will continue to help maintain the sandy beach along a shoreline that is vulnerable to potentially severe erosion. Consistent with the policy and practice of the Southold Town Board of Trustees and the New York State Department of Environmental Conservation, the replacement groin is designed to the minimum scale necessary to continue providing its current beach retention function without increasing erosion at adjacent properties. Specifically, the new groin will have a low-profile design such that the seaward end of the groin is elevated no higher than 18 inches above the elevation of lower low tide; and only the+/-48 linear feet of existing groin that is still functioning to maintain dry beach at lower low tide will be replaced, while the most seaward +/-8 linear feet of groin now located seaward of the intertidal zone will be permanently removed. Also, the new groin will be constructed with vinyl sheathing in place of the existing treated timber groin, which provides a potential benefit to the quality of the adjacent surface waters through the reduction of treated timber located in and adjacent to surface waters. The project will thus effectively maintain the historically existing site conditions with the benefits associated with replacing a treated timber groin with a shortened, lower profile groin constructed with vinyl sheathing. Therefore, the project will have no adverse impacts on the adjoining shoreline, tidal waters, or unvegetated tidal wetland area and will be consistent with Polices 4 and 6. See attached.
