Very truly yours, Henry P. Smith, President Board of Town Trustees Ilene Pfifferling, Clerk~ V - 12. APRIL 24, 1986 POSSIBLE WAIVERi/ LEAD AGENCY RESOLVED that the Southold Town Trustees declare itself lead agency in regard to the State Environmental Quality Review Act in the matter of the application of Stephen W. O'Leary for a Wetland Permit on certain property located at 770 Old Salt Road, Mattituck, New York. April 7, 1986 Board of Town Trustees Town of Southold Town Hall 53095 Main Road P.O. Box 728 Southold, New York 11971 Gentlemen: Enclosed please find an application for a variance for a treated wooden deck Which was unknowingly erected for the bay front of our summer residence in Mattituck in violation of a newly enacted Town Regulation (deck within 75' of mesne high water). This is a summer residence which has been in our family for 46 years. It originally belonged to my two Aunts, then to me, and hopefully to our children in the future. We have a twelve foot high cement bulkhead at the bayside and to my knowledge no water has gone over its top in 46 years. The deck is back at least 35' from the wall bulkhead. The deck was installed in a highly professional manner and its primary purpose was to provide a reasonably safe means of ingress and egress for elderly people and youngsters by avoiding an immediate step down or up into the building. The cost was substantial. Ail of our neighbors have patios and this deck simply covered a brick patio which needed replacement. We thought the safety factor made this a constructive addition. I respectfully request the exercise of a favorable discretion for the variance. Enclosure Thank you for your consideration. Resphectfully, "~ 'i.
