LEWIS, c/o TOM LUCAK SCTM# 1000-66-2-39 Costello Marine Contracting Corp. on behalf of ESTATE OF GRACE R. LEWIS, c/o TOM LUCAK requests a Wetland Permit to construct one (1) 45' long low-profile jetty and one (1) 60' long low- profile jetty. Located. 885 Rogers Road, Southold. SCTM# 1000-66-2-39 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the action is INCONSISTENT with the below listed Policy Standards and therefore is INCONSISTENT with LWRP. 6.3 Protect and restore tidal and freshwater wetlands. A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction The proposed groins are not permitted pursuant too: § 275-11. Construction and operation standards. C. (1) (f)which states: f� No new jetties or groins will be permitted unless the work results in a net decrease in the total number of jetties in the subject area. There is no indication that the work would result in the net decrease in the total number of jetties in the area. Further the proposed action does not meet the goals of The Peconic Estuary Program to reduce hardened shoreline structures. Note that Policy 4.2. Protect and restore natural protective features of the LWRP strives to minimize interference with natural coast process (littoral drift), however, limited interference could be undertaken if the benefits are proven and necessary if certain parameters are met. (see below). C. Minimize interference with natural coastal processes by: 1. providing for natural supply and movement of unconsolidated materials and or water and wind transport 2. limiting intrusion of structures into coastal waters D. A limited interference with coastal processes may be allowed where the principal purpose of the structure is necessary to: 1. simulate natural processes where existing structures have altered the coast. 2. provide necessary public benefits for flooding and erosion protection. 3. provide for the efficient operation of water-dependent uses Limited interference is to be mitigated to ensure that there is no adverse impact to adjacent property, to natural coastal processes and natural resources, and, if undertaken by a private property owner, does not incur significant direct or indirect public costs. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. All applicants for permits* including Town of Southold agencies, shall complete this CCAF for proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This assessment is intended to supplement other- information used by a Town of Southold agency in making a determination of consistency. *Except minor exempt actions including Building Permits and other ministerial permits not located within the Coastal Erosion Hazard Area. 2. Before answering the questions in Section C, the preparer of this form should review the exempt minor action list, policies and explanations of each policy contained in the Town of Southold Local Waterfront Revitalization Program. A proposed action will be evaluated. as to its significant beneficial and adverse effects upon the coastal area(which includes all of Southold Town). 3:_ If any question in Section C on this form is answered "yes" or "no", then the proposed action will affect the achievement of the LWRP policy standards and conditions contained in the consistency review law. Thus, each answer must be explained in detail, listing both supnorting and.non- supporting facts. If an action cannot be certified as consistent with the LWRP policy standards and conditions,it shall not be undertaken. Foster a pattern of development in the Town of Southold that enhances community character, preserves open space, makes efficient use of infrastructure, makes beneficial use of a coastal location,and minimizes adverse effects of development. See LVVRP Section III—Policies; Page 2 for evaluation criteria. ©Yes ❑ No ❑ Not Applicable This is a community beach used by the residents of Beixedon Estates to ensure all residents have waterfront access. The beach.has eroded greatly reducing the ability to even walk along the shoreline during all tide cycles. We want to stabilize the beach by constructing two small, low profile jetties. We are confident that the addition of these minor structures will result in sand build up. This will allow continued communal use of the beach and protect further erosion of this property. Due to recent storms and the reconstruction of the jetty to the east, this beach has been depleted of sand Jetties, much larger in size, can be found along the shoreline.
