SCTM# 1000-66-3-1 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the action is CONSISTENT with the below listed Policy Standards and therefore is CONSISTENT with the LWRP provided that: 1. The Board require that the 10' wide non-turf buffer be vegetated with beneficial plants. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. Before answering the questions in Section C, the preparer of this form should review the exempt minor action list, policies and explanations of each policy contained in the Town of Southold Local Waterfront Revitalization Program. A proposed action will be evaluated as to its si nig_ficant beneficial and adverse effects upon the coastal area (which includes all of Southold Town). See LWRP Section III - Policies Pages 16 through 21 for evaluation criteria ® Yes ❑ No ❑ Not Applicable In association with the removal of the existing dwelling and construction of the proposed dwelling,a drainage system of leaders,gutters,and drywells will be installed to collect roof runoff. By also reducing lawn areas and increasing the setback of lawn areas from wetlands by establishing a 10'wide,approximately 1,535 sf nonturf buffer adjacent to the tidal wetlands boundary,which can serve both as a sink and filter for stormwater runoff and contaminants,the quantity of runoff reaching the adjacent tidal waters will be decreased and the quality of runoff will be improved through a reduced concentration of potential fertilizers,pesticides,and insecticides. Additionally, groundwater and ultimately surface water quality will benefit from the replacement of the existing,nonconforming sanitary system components associated with the existing dwelling and pool house with a new,Suffolk County Department of Health Services-conforming sanitary system located outside Chapter 275 jurisdiction and more than 166 feet from the wetlands and surface waters of Pettys Pond. Therefore,consistent with Policy 5,water quality and supply will be both protected and improved as a result of the mitigation measures associated with the project. See LWRP Section III - Policies; Pages 22 through 32 for evaluation criteria. ®Yes ❑ No ❑ Not Applicable LWRP ADDENDUM for BEXSTOREN, LLC 625 ARSHAMOMAQUE AVENUE SOUTHOLD, NY SCTM#0900-66-3-1 Policy Consistent with Policy 6, the project will contribute to the protection and restoration of the adjacent tidal wetland ecosystem. The proposed project includes renovations to an existing one-story dwelling located entirely in a FEMA designated Zone X, primarily the addition of a screened porch(within the footprint of the existing raised deck to be removed); replacement and reconfiguration of the existing upper and lower attached decks; and replacement of the existing pool house and associated sanitary system. As a result of the project, the overall structural footprint will change minimally and lot coverage of Town-defined buildable land will in fact decrease by approximately 217 sf from 19.33 to 18.78 percent. And because the portion of deck located closest to wetlands will be removed and replaced in the same location, the minimum wetlands setback of +37' will be maintained. Groundwater and ultimately surface water quality will benefit from the replacement and relocation of the nonconforming pool house sanitary system located+70' from wetlands, as a new, upgraded, Suffolk County Department of Health Services-conforming sanitary system will be installed beyond Chapter 275 jurisdiction and serve both the new pool house and the existing dwelling. Additional mitigation measures designed to offset any potential impacts of the proposed construction activities and improve upon existing site conditions to create a net environmental benefit upon project completion include installation of a drainage system of leaders, gutters, and drywells to collect and recharge roof runoff; installation of a pool drywell to capture backwash from the existing swimming pool to remain; and establishment of a 10' wide, approximately 1,535 sf non-turf buffer adjacent to the tidal wetlands boundary, which can serve both as a sink and filter for stormwater runoff and contaminants. By thus reducing lawn areas and increasing the setback of lawn areas from wetlands, the quantity of runoff reaching the adjacent tidal waters will be decreased, and the quality of runoff will be improved through a reduced concentration of potential fertilizers, pesticides, and insecticides, thereby providing a net benefit to surface water quality. Therefore, the project would create no new encroachment on the adjacent wetlands; reduce lot coverage and existing lawn area adjacent to wetlands; and improve site drainage and on-site septic treatment. As a result, the project will have no significant adverse impacts on the adjacent tidal wetlands or tidal waters of the Town and will be consistent with Policy 6. See attached.
