TERMS AND CONDITIONS The Permittee Cartwright Family Trust, 55 Second Street,New Suffolk,New York, as part of the consideration for the issuance of the Permit does understand and prescribe to the following: l. That the said Board of Trustees and the Town of Southold are released from any and all damages, or claims for damages, of suits arising directly or indirectly as a result of any operation performed pursuant to this permit, and the said Permittee will, at his or her own expense, defend any and all such suits initiated by third parties, and the said Permittee assumes full liability with respect thereto, to the complete exclusion of the Board of Trustees of the Town of Southold. 2. That if future operations of the Town of Southold require the removal and/or alterations in the location of the work herein authorized, or if, in the opinion of the Board of Trustees, the work shall cause unreasonable obstruction to free navigation,the said Permittee will be required, upon due notice,to remove or alter this work project herein stated without expenses to the Town of Southold. 8. Confident that this Board has addressed the adequacy of the original existing septic system, lying to the east of the cottage, a few feet under the sand, and that it will not be additionally compromised by the heavy construction vehicles necessary to complete this project, or issues of possible dewatering during the installation of the concrete piers, we would like the Board to also consider the following issues: As you will have noticed upon your inspection,this is a very tight, close-knit community.The properties to the north, Lots 21, 20.2, 20.5 and 20.7 have deeded rights of way across the northerly and then the easterly property line of the premises which is the subject of this application,to Peconic Bay. It is difficult to imagine a scenario whereby the types of vehicles necessary would not adversely impact this right-of-way. We would request that any permit issued contain a provision which would prohibit the impeding of our deeded right-of-way to Peconic Bay. Our summers here, as everywhere in our community we call the North Fork, are precious and all too short. Any project of this magnitude on such a tiny parcel will by necessity have a negative impact on the adjoining property owners and their enjoyment of the beach and bay, and it would at least be hoped that construction would not commence until after Labor Day.
