The above mentioned project included dredging which has not been a matter of contention. The proposed bulkhead, which is the source of contention, that we have requested is to be placed landward of the line delineating the Area Adjacent to the Tidal Wetlands , as shown on Tidal Wetlands Map 712-540. The proposed bulkhead is on a line projected from the adjacent bulkhead on the south and the bulkhead on the property to the north, across O-ld- Harbor Road. The above mentioned Tidal Wetlands boundary line has been accurately located on the Revised Plan, dated 8/1/90, by J. H. Geideman, P.L.S.. It is noted that there is some distortion in the Tidal Wetlands Map to the extent of 190' in a north-south direction and 180' in an east-west direction. This distortion was determined by measurements on the ground between discernible points in the critical - area. These actual ground measures were compared with the scaled distances between the same discernible points on the Tidal Wetlands Map. We wish to refer you to your recent decision on my application No. I0-87-2159. There is only 400' between these two projects. Your earlier decision allowed a bulkhead to be built since it 'met the criteria of the designation as .mapped on the Tidal Wetlands Map. With reference to the Department' s request for a recent survey, a property survey done in 1984 was included with the original submission. Please note that the revised plans are done by a licensed surveyor. The scaled cross-section which was requested was included with the submission 10/5/88. - 1 - We feel that if the Department wishes not to change the Tidal Wetlands boundary line then this project should be approved as submitted. The question of whether an action may be significant is not always easy to answer. Frequent- ly, there are aspects of a project that are subjective or unmeasureable. It is also understood that those who determine significance may have little or no formal knowledge of the environment or may not be technically expert in environmental analysis. I addition, many who have knowledge in one particular area may not be aware of the broader concerns affecting the question of significance. The full EAF is intended to provide a method whereby applicants and agencies can be assured that the determination process has been orderly, comprehensive in nature, yet flexible enough to allow introduction of information to fit a project or action. Full EAF Components: The full EAF is comprised-of three parts: Part 1: Provides objective data and information about a given project and its site. By identifying basic project data, it assists a reviewer in the analysis that takes place in Parts 2 and 3. Part 2: Focuses on identifying the range of possible impacts that may occur from a project or action. It provides guidance as to whether an impact is likely to be considered small to moderate or whether it is a potentially- large impact. The form also identifies whether an impact can be mitigated or reduced. This structure extends approximately 140 feet offshore, the same length as the previously existing structure we were able to confirm using our 1974 Tidal Wetlands Map. This length provides a very good size dock extending into water up to seven feet in depth and should meet your needs as we understand them. However, should Old Cove believe necessary, we can consider .. amending this permit to allow a longer structure if you .can adequately demonstrate either: r ti\ 1. A 250 foot fixed dock existed at the site some time between September 1974 and August 1977. Acceptable proof includes a survey or clear aerial photograph from that period. OR 2. The yacht club requires a dock of greater length. How many boats are in use at the facility during peak periods? What size .boats are in use at Old Cove? How many people attend sailing lessons or other mass dock use activities at one time? This type of facility use information is required to demonstrate need for a longer dock. Uniform procedures ( Part 621.9 (a) (17) ) provides that applicants have the right to a public hearing if they receive a permit with significant conditions from the Department. Design-Drafting 5 Kilburn Road • Garden City,N.Y. , 11530 • (516)-248-7937 OLD COVE YACHT CLUB BEACH RENOVATION r The Old Cove Yacht Club, is a small sailing club which operates from Memorial Day, to Columbus Day each year. The club also has one of the largest junior sailing ° schools on the North Fork. During the Noreaster of December 92, and the Blizzard of March 93, Old Cove sustained a considerable amount of damage. In December, the pier was destroyed, and most of the beach was destroyed. In the March storm, the erosion continued, and two trees previously on the club lawn fell on the clubhouse when the land under them eroded. At this point, the erosion is dangerously close to the buildings foundation. There are three different approaches to our current problem. The first is to develop a plan for refurbishing the beach by backfilling it with sand and rebuilding the 1 - finger pier. This option would be by far the most cost effective for the club. The problem with this approach is two-fold. First the finger pier would still have to be built, and second, their,is no guarantee that the new fill won't wash away in the fist storm. If it does wash away., the club would then find it financially unfeasible to repair the damage again. The second option is to put rip-rap on the beach and then backfill. This would form a good breakwater, and also a semi-retaining wall. The problem with rip-rap is two fold, first the finger pier would have to be rebuilt over the rip-rap to causing further difficulties. Second the rip-rap would be financially unfeasible. Rip-rap is expensive, and the club could not afford the cost of shipping and laying of the stone, and rebuilding the finger pier. R. LEHNERT INC. Bulkhead would form a perimeter for the property, bringing it to its legal boundaries. Bulkhead would also stop the erosion problem that is currently threatening the clubhouse. Bulkhead is also the most financially feasible for the club at this time. The club would hire a local contractor, who's equipment is already in the area thereby making it even less costly. Bulkhead in conjunction with a repaired finger pier, would also improve the . everyday running of the club, by providing a place to tie the boats up while the children are on land. The bulkhead would also allow us to attach the finger pier to the main property, thereby avoiding walking on the beach. In closing, I would like to state that the club, must complete this project before the summer months: Once school is out of session, the club holds sailing lessons for children who need not be members. With the beach and the clubhouse in its present condition, the club cannot hold lessons on the property due to liability reasons.
