TERMS AND CONDITIONS The Permittee Lucinda Barnes residing at 63875 County Road 48, Greenport,New York, as part of the consideration for the issuance of the Permit does understand and prescribe to the following: ]. That the said Board of Trustees and the Town of Southold are released from any and all damages, or claims for damages, of suits arising directly or indirectly as a result of any operation performed pursuant to this permit, and the said Permittee will, at his or her own expense, defend any and all such suits initiated by third parties, and the said Permittee assumes full liability with respect thereto,to the complete exclusion of the Board of Trustees of the Town of Southold. 2. That this Permit is valid for a period of 24 months, which is considered to be the estimated time required to complete the work involved, but should circumstances warrant, request for an extension may be made to the Board at a later date. 3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to maintain the structure or project involved,to provide evidence to anyone concerned that authorization was originally obtained. 4. That the work involved will be subject to the inspection and approval of the Board or its agents, and non-compliance with the provisions of the originating application may be cause for revocation of this Permit by resolution of the said Board. 5. That there will be no unreasonable interference with navigation as a result of the work herein authorized. 6. That there shall be no interference with the right of the public to pass and repass along the beach between high and low water marks. 7. That if future operations of the Town of Southold require the removal and/or alterations in the location of the work herein authorized,or if, in the opinion of the Board of Trustees, the work shall cause unreasonable obstruction to free navigation, the said Permittee will be required, upon due notice,to remove or alter this work project herein stated without expenses to the Town of Southold. 8. That the said Board will be notified by the Permittee of the completion of the work authorized. 9. That the Permittee will obtain all other permits and consents that may be required supplemental to this permit, which may be subject to revoke upon failure to obtain same. 10. No right to trespass or interfere with riparian rights. This permit does not convey to the permittee any right to trespass upon the lands or interfere with the riparian rights of others in order to perform the permitted work nor does it authorize the impairment of any rights, title, or interest in real or personal property held or vested in a person not a party to the permit. Kimack, on behalf of LUCINDA BARNES applied to the Southold Town Trustees for a permit under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, and Chapter 111 of the Southold Town Code, Coastal Erosion Hazard Areas, application dated February 14, 2018, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator issued a recommendation that the application be found Inconsistent with the Local Waterfront Revitalization Program policy standards, and, WHEREAS, the Board of Trustees has furthered the Local Waterfront Revitalization Program policy 6.3 to the greatest extent possible through the imposition of the following Best Management Practice requirements: the issuance of a permit for the structures; WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on April 5, 2018, at which time all interested persons were given an opportunity to be heard-, and, 2 WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the,standards set forth in Chapter 275 and Chapter 111 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that the Board of Trustees have found the application to be Consistent with the Local Waterfront Revitalization Program, and, RESOLVED, that the Board of Trustees approve the application of LUCINDA BARNES to remove invasive/non-native vegetation and vines within an approximate 9,000sq.ft. area landward of the top of bluff, and re-vegetate area by planting native vegetation consisting of low and high bush blueberries, beach grass, bayberry, and beach plum; and to maintain the existing approximately 4' wide by 140' long access path to the beach that consists of three (3) landings, each approximately 20sq.ft. with four (4) stair sections consisting of 36 natural locust log treads set in the path's grade, and two (2) steps in the approximate area of the slope's toe; and the downhill side of the pathway consists of imbedded locust logs functioning as retaining members to stabilize soil; with the condition that the construction is of all non-toxic locust; and as depicted on the site plan prepared by M.A. Kimack dated February 13, 2018, and stamped approved on April 5, 2018. It has been determined that the 4 ft. wide path consisting of locust logs dug into the bluff in a Coastal Erosion Hazard Area requires a permit subject to Code 111-1463. The applicant should complete a Coastal Erosion Hazard Area permit showing the beach path and a cross- sectional plan as part of the Wetland permit. These comments are submitted on my own as a Village Trustee, and not on behalf of the Mayor or Village Board, in part because we only meet twice a month and got this notice with 3 days of lead time. I received on December 8 notice from your board about a public hearing on a wetlands permit at a property adjacent to Village Property scheduled for December 13. Not knowing how the Town typically handles such matters, I will admit I was pretty surprised and concerned to see that notices to neighbors about a hearing were sent out with 3 business days' advance notice. I would have to go look up in the NYS Town Law and Town Code, I suppose,to find out if such short notice is legal. But as a matter of practice it certainly raises concern about transparency. As to the merits of this particular application,the two pages we were sent seem harmless enough,though in 2 1/2 years on the Village Board,which serves as the Village's Wetlands Permitting Body, I've never seen a wetlands application that is only 2 pages. Are there any documents missing from this application? As a neighbor to this application, I would just like to be reassured that these plantings will be in accordance with standard environmental practices to manage stormwater runoff and protect our waters, particularly that they will not need to be fertilized with any substance that could add nitrogen or other pollutants to the sensitive Moore's Drain ecosystem. Has your CAC reviewed the application yet?Are these materials available? This notice does not indicate a time for the hearing, but when I go to the Town Trustees' page I see you meet on 12/13 at 4:30. No agenda for the meeting-which is 2 days from today- is posted. So my official comment on the application itself is that I'd like more information before formulating a comment. Generally speaking, I hope that the next time the Village is asked to comment on a permit at a property neighboring Village lands- especially the Moore's Woods property that is of major environmental importance to our residents and to our watershed-we are given proper notice and documentation so we can ask our CAC and other environmental experts to review it. Not being an expert in marine horticulture, I can't possibly comment on this with 3 business days lead time.
