SCTM# 1000-57-2-23 The proposed action has been reviewed to Chapter 268:, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the action is CONSISTENT with the below listed Policy Standards and therefore is CONSISTENT with the LWRP provided that: 1. The Board clarifies if the existing, beneficial vegetation will remain in-place in the "natural vegetated buffer". 2. The Board implements the comments made on the proposal by Jamie A. Richter R. A. of the Office of the Engineer in a letter dated November 1, 2016. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. 4 Town of Southold LL-- 9 2011 LWRP CONSISTENCY ASSESSMENT FORM Southold Town A. The lot is identified as Tax Map Block 1000-57-2-Lot 23 and totals 10,846.65 square feet. Wetlands occupy 950 square feet of the lot from the top of bank to the lot's southern boundary. The upland portion of the property is 9,897 square feet , .(including an undeveloped right-of-way, 11,060 square feet of upland occurs). The property ends at the water line; the wetland line occurs at the top of bank. Island View Lane forms the lot's northern boundary, with single family residences both to the west and east. Tidal wetlands/open water occurs to the south. This site can be identified on -New York State Department of Environmental Conservation (NYSDEC) Tidal Wetland Map#720-550. Application materials for a reconstruction (and expansion) of the residence were originally submitted to the Trustees in January 2016. The applicant requested and received an informal application review. Changes to the proposed, original Bontje site plan were made as a result of our meeting with the Board's administrator Elizabeth and Trustee (President) John Bredemeyer. and chronicled in our February 29, 2016 correspondence. At the Trustees' request, the applicant proceeded to and received approvals from the ZBA for the proposed house dimensions and coverages (October 21, 2016, #6982 enclosed). Trustee (President) John Bredemeyer then had several conversations with the applicant and requested that they proceed to the Town Engineering Department and discuss compliance with the Town's drainage ordinance prior to formally continuing with the Trustees' approval process. The applicant met with Mr. Richter (R.A.) and he issued a BONTJE65 Trustees Cover 3 Nov 20162 November 1 , 2016 correspondence. The applicant made several changes to the site plan with regard to storm water drainage capture and dissipation. Structural changes were largely limited to adding sub-surface drainage. The proposed total roof, walkway and deck surfaces were reduced from 2,050 square feet to 2,042 square feet. The applicant met with Mr. Richter again� (November 22, 2016)- and the changes were deemed responsive but the site plan was revised to add a few minor, recommended changes following that second meeting (no structural changes). SEORA DETERMINATION: The Zoning Board of Appeals has visited the properly'under consideration in this application and determines that this review falls under they Type II category of the State's List of Actions, without further steps under SEQRA. The applicant on October 3, 2016 submitted a letter describing an amended plan to drop the front yard fill to 2.2 feet in an attempt to mitigate the LWRP's concerns as well as the Trustees concerns. Furthermore, the applicant•submitted a survey prepared b Nathan Taft Corwin, III, L.S., last revised October 3, 1 2016,depicting a revised front yard setback to 30.5 feet ano a revised rear yard setback to 27.3 feet. E - � f ADDITIONAL INFORMATION: The applicant will be .required to submit an application to the Board of Town I Trustees to review and approve the proposed improvements, including the location and design of the sanitary, system and a stormwater run-off management plan to comp y with the Town's on site drainage code. FINDINGS OF FACT/REASONS FOR BOARD ACTION: 1 The Zoning Board of Appeals held a.public hearing on this application on September ],2016 at which time written and oral evidence were presented. Based upon all testimon, ,documentation, personal inspection of the property and surrounding neighborhood,and other evidence,the Zor ing Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 4267-b(3)(b)(1).. Grant of the variances, as amended, will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. Island View Lane is a private dead end road ! that consists of single family homes on irregular, non-conforming lots with.non-conforming setbacks similar to i what the applicant proposes. Currently,there is a single family home on Island View Lane which received variance i relief for a 15.8 foot setback from the high water mark/re I yard line. 2.- Town Law 4267-b(3)(b)(2). The benefit sought by the Iapplicant cannot be achieved by some method, feasible for the applicant to pursue, other than area variances. The applicant's lot is a small non-conforming lot with an existing dwelling that does not conform to existing zoning setbacks. The applicant's amended plan proposes to increase the rear yard setback to 27.3 feet thereby bringing the creek setback and rear yard setback into more conformity with the town code than the currentlyl existing dwelling. In order to.increase the setback i from the creek the applicant needs zoning relief from the front yard setback requirement of 35 feet. Any proposed additions and alterations will require an area vari ince. i 3. Town Law §267-6(3)(b)(3). The variance granted lerein for the front yard setback is not mathematically substantial, representing 9% relief from the code. I he, variance granted herein for the rear yard setback is mathematically substantial representing 29% relief from the code. However, the setbacks for the proposed new ; I i Page 3, October 20,2016 #6982,Bontje SCTM No. 1000-57-2-23 i structure are more conforming to the code than the setbacks of the existing dwelling,and due to the requirements of the sanitary system,odd shape of the lot,and setback from(the creek,variances are required. Moreover,the subject property includes a 16 foot right of way along the applicant's street frontage that will make the front yard setback, as amended, appear to be 46.5 feet from the dwelling to the road edge. 4. Town Law 4267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical for environmental conditions in the neighborhood. The applicant must comply with Chapter'236 of the Town's St im Water Management Code. 5. Town Law &267-b(3)(b)(5). The difficulty has been sr lf-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the Applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law &267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a new dwelling while preserving and protecting the character-of the neighborhood and the health,safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Weisman (Chairperson), seconded by Member Schneider,and duly carried,to j GRANT the variances AS AMENDED, and shown on� the Architectural plans prepared by Mark Schwartz, Architect labeled A-1-4 and dated February 3, 2016, and,survey prepared by Nathan Taft Corwin, III, LS dated July 13,2005 and last updated October 3,2016. The survey,dated 10/3/16,has been prepared by the office of Nathan Taft Corwin III, LS and the site plan was prepared by the office of B. Lang Associates, Environmental Consultants Please consider the following: 1 The LIPA easement as indicated on the survey running along the northerly property line should be verified. If it truly exists, any permanent work within that easement area should be coordinated with*and approved by LIPA. The proposed retaining wall may need to be relocated out of the easement area. 2 The Hydro CAD analysis for the site appears to be accurate however the requirements of Chapter 236 must be calculated for the control of a 2" rainfall event without consideration of soil permeability's found at the site. 3. The proposed driveway as noted is not considered to be PERVIOUS. Compacted subgrade materials covered with stone will not recharge stormwater in a satisfactory manner Drainage for the driveway must be provided. 4. The placement of fill in the road shoulder area is not allowed. This will only serve to push stormwater further down the roadway and may become a problem where there are currently no issues. 5. The new side & rear yard slopes proposed by the new grading & elevation of the site caused by the placement of fill must be controlled in a manner that will prevent stormwater from being directed to adjacent properties and/or the wetlands. Any act of filling or re-grading of the site must be done in such a manner as to prevent stormwater from migrating off site. All new fill must be clean virgin materials from an upland source. It appears that the Tie Line shown along the wetland boundary would be the southerly property line This item must be better highlighted on the plan and a building envelope must be shown with the proper rear yard setback. 7. The property Flood Zone must be shown or indicated on the plan. 8 The Propane Tank indicated along the Northerly Property Line must be relocated entirely out of the right-of-way-and/or the LIPA easement area as needed. 9. Erosion controls for the site must be detailed and shownon the site plan in a manner that is surrounding the entire limits offill or new construction. 10. It is my understanding that the ZBA has already addressed issues related to this project. Encroachments beyond Building envelopes and all other related Disapprovals registered by the Building Department should be shown or indicated on the site,-plan in a manner that addresses what the ZBA has approved. The applicant should be required to amend the site plan as noted above prior to filing. for a Building Permit Application. The approval of a stormwater management plan will be required during that application process and the issues for approval of the SWMP will be basically the'same but may not be limited to the items noted herein. Only watertight or waterproof forms shall be used. Wet concrete shall not be poured to displace water within the forms. 4. No Construction Debris in Wetland or Adjacent Area Any debris or excess material from construction of this project shall be completely removed from the adjacent area(upland) and removed to an approved upland area for disposal. No debris is permitted in wetlands and/or protected buffer areas. 5. No Disturbance to Vegetated Tidal Wetlands There shall be no disturbance to vegetated tidal wetlands or protected buffer areas as a result of the permitted activities. 6. Storage of Equipment, Materials The storage of construction equipment and materials shall be confined within the project work area and/or upland areas greater than 75 linear feet from the tidal wetland boundary. Seeding Disturbed Areas All areas of soil disturbance resulting from the approved project shall be stabilized with appropriate vegetation (grasses, etc.) immediately following project completion or prior to permit expiration, whichever comes first. If the project site remains inactive for more than 48 hours or planting is impractical due to the season, then the area shall be stabilized with straw or hay mulch or jute matting until weather conditions favor germination. 8. Clean Fill Only All fill shall consist of clean sand, gravel, or soil (not asphalt, slag, flyash, broken concrete or demolition debris). 9. Department Jurisdiction The department retains jurisdiction of all regulated lands where fill has been permitted. Placement of fill shall not be used to alter the department's Tidal Wetland jurisdictional area at the project site. The area remains a regulated area subject to Tidal Wetland Land Use restrictions of 6 NYCRR Part 661. 10. Establish Vegetated Buffer To protect the values of the tidal wetlands, a permanent vegetated buffer zone shall be established. There shall be no disturbance to the natural vegetation or topography within an area extending 5 linear feet landward of the tidal wetland boundary. 11. Straw Bales or Other at Tidal Wetland A row of staked straw bales or approvable erosion control devices shall be placed at the landward edge of the buffer area or 10 linear feet from the tidal wetland boundary, or as per the NYSDEC-approved plan, prior to commencement of any regulated activities and remain in place and in good, functional condition until the project is completed and all disturbed areas are stabilized with vegetation. 12. Runoff Directed to Upland Drywells Roof runoff shall be directed to drywells a minimum of 30 linear feet landward of.the tidal wetland boundary for immediate on-site recharge. 13. Direct Runoff Away from Tidal Wetland and Buffer Roads, driveways, and parking areas shall be graded to direct runoff away from tidal wetlands and protected buffer areas. 14. Sanitary Systems above Groundwater Sanitary system (bottom of tank and leaching pools) shall be located a minimum of 2 feet above seasonal high groundwater. 15. Tidal Wetland Covenant The permittee shall incorporate the attached Covenant(or similar Department-approved language)to the deed for the property where the project will be conducted and file it with the Clerk of SUFFOLK County within 30 days of the effective date of this permit. This deed covenant shall run with the land into perpetuity. State Not Liable for Damage The State of New York shall in no case be liable for any damage or injury to the structure or work herein authorized which may be caused by or result from future operations undertaken by the State for the conservation or improvement of navigation, or for other purposes, and no claim or right to compensation shall accrue from any such damage. 19. State May Order Removal or Alteration of Work If future operations by the State of New York require an alteration in the position of the structure or work herein authorized, or if, in the opinion of the Department of Environmental Conservation it shall cause unreasonable obstruction to the free navigation of said waters or flood flows or endanger the health, safety or welfare of the people of the State, or cause loss or destruction of the natural resources of the State, the owner may be ordered by the Department to remove or alter the structural work, obstructions, or hazards caused thereby without expense to the State, and if, upon the expiration or revocation of this permit, the structure, fill, excavation, or other modification of the watercourse hereby authorized shall not be completed, the owners, shall, without expense to the State, and to such extent and in such time and manner as the Department of Environmental Conservation may require,remove all or any portion of the uncompleted structure or fill and restore to its former condition the navigable and flood capacity of the watercourse. No claim shall be made against the State of New York on account of any such removal or alteration. 20: State May Require Site Restoration If upon the expiration or revocation of this permit, the project hereby authorized has not been completed, the applicant shall, without expense to the State, and to such extent and in such time and manner as the Department of Environmental Conservation may lawfully require, remove all or any portion of the uncompleted structure or fill and restore the site to its former condition. No claim shall be made against the State of New York on account of any such removal or alteration. 21. Precautions Against Contamination of Waters All necessary precautions shall be taken to preclude contamination of any wetland or waterway by suspended solids, sediments, fuels, solvents, lubricants, epoxy coatings, paints, concrete, leachate or any other environmentally deleterious materials associated with the project. GENERAL CONDITIONS - Apply to ALL Authorized Permits: 1. Facility Inspection by The Department The permitted site or facility, including relevant records, is subject to inspection at reasonable hours and intervals by an authorized representative of the Department of Environmental Conservation (the Department) to determine whether the permittee is complying with this permit and the ECL. Such representative may order the work suspended pursuant to ECL 71- 0301 and SAPA 401(3). The permittee shall provide a person to accompany the Department's representative during an inspection to the permit area when requested by the Department. Relationship of this Permit to Other Department Orders and Determinations Unless expressly provided for by the Department, issuance of this permit does not modify, supersede or rescind any order or determination previously issued by the Department or any of the terms, conditions or requirements contained in such order or determination. 3. Applications For Permit Renewals, Modifications or Transfers The permittee must submit a separate written application to the Department for permit renewal, modification or transfer of this permit. Such application must include any forms or supplemental information the Department requires. Any renewal;modification or transfer granted by the Department must be in writing. Submission of Renewal Application The permittee must submit a renewal application at least 30 days before permit expiration for the following permit authorizations: Tidal Wetlands. 5. Permit Modifications, Suspensions and Revocations by the Department The Department reserves the right to exercise all available authority to modify, suspend or revoke this permit. The grounds for modification, suspension or revocation include: a. materially false or inaccurate statements in the permit application or supporting papers; b. failure by the permittee to comply with any terms or conditions of the permit; c. exceeding the scope of the project as described in the permit application; d. newly discovered material information or a material change in environmental conditions, relevant technology or applicable law or regulations since the issuance of the existing permit; e. noncompliance with previously issued permit conditions, orders of the commissioner, any provisions of the Environmental Conservation Law or regulations of the Department related to the permitted activity. 6. Permit Transfer Permits are transferrable unless specifically prohibited by statute, regulation or another permit condition. Applications for permit transfer should be submitted prior to actual transfer of ownership.
