residing at 11330 Bay Avenue,Mattituck,NY 11952,as joint tenants with right of survivorship.
party of the second part,
WITNESSETH,that the party of the first part,in consideration of Ten Dollars and other lawful
consideration,lawful money of the United States,paid by the party of the second part,does hereby grant and
release unto the party of the second part,the heirs or successors and assigns of the party of the second part
forever,
ALL that certain plot,piece or parcel of land,with the buildings and improvements thereon erected,
situate,lying and being at Mattituck,Town of Southold,County of Suffolk and State of New York,bounded and
described as follows:
BEGINNING at a point on the westerly side of Bay Avenue marked by a concrete monument placed at the
northeast comer of land now or formerly of F.Gibbs,and running thence South 77 degrees 59 minutes 50
seconds West along said land now or formerly of Gibbs 472.55 feet to a concrete monument;running thence
North 20 degrees 21 minutes 10 seconds West along land of the Estate of H.F.Haggarty 75 feet to a concrete
monument placed at the southwest comer of land formerly of William Cramer,now of Koop;running thence
North 78 degrees 5 minutes 20 seconds East along land formerly of William Cramer,now of Koop 495.92 feet to
a concrete monument placed in the westerly side of Bay Avenue;running thence South 18 degrees 20 seconds 00
minutes East along the said westerly side of Bay Avenue 10.65 feet to a stake;running thence South 0 degrees 15
minutes 50 seconds West along the westerly side of said Bay Avenue 64.35 feet to the point or place of
beginning.
Being and intended to be the same premises conveyed to the parry of the first part by deed dated June 27,
1979 and recorded on 9/11/79 in Liber 8691 of Deeds,Page 583 and Deed dated May 5,2010 recorded in Liber
12624 Page 443 dated May 11,2010,and Deed dated December 20,2012 recorded in Liber 12717 Page 826 on
January 17,2013.
TOGETHER with all right,title and interest,if any,of the party of the first part in and to any streets and roads
abutting the above described premises to the center lines thereof,
TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to
said premises,
TO HAVE AND TO HOLD the premises herein granted unto the party of the second part,the heirs or
successors and assigns of the party of the second part forever.
AND the party of the first part,covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever,except as aforesaid.
AND the party of the first part,in compliance with Section 13 of the Lien Law,covenants that the party
of the first part will receive the consideration for this conveyance and will hold the right to receive such
consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will
apply the same first to the payment of the cost of the improvement before using any part of the total of the same
for any other purpose.
The word"party"shall be construed as if it read"parties"whenever the sense of this indenture so
requires.
