Dear Mr. Just:
The following action was taken by the Board of Town Trustees during
its regular meeting held on November 15, 1990:
RESOLVED that the Town Trustees APPROVE the request of J.M.O.
Consulting on behalf of DENIS O'BRIEN for a waiver to construct a
freshwater pond and establish plantings of emergent vegetation within
a freshwater wetland; plant the area around the pond with upland
shrubs and construct two gravel paths, based on the approved plan of
the N.Y.S.D.E.C.
A waiver fee of thirty-five ($35.00) dollars is due.
Please return to the Building Department for a determination on the
need for any other permits which may be required for this project.

Before beginning work in the area of the pond, a temporalry fence shall
be erected five (5) feet from the limit of excavation. Hay bales shall be
stacked so that the top of the hay bates are a minimum one (1) foot
above the water surface. The hay bales shall be secured place with a
wood stake or a steel pin extending through the hay bales at least one
(1) foot into the groundwater.
350 emergent plants shall be planted as per the above limt
according to seasonal availability with no more than 30% (~f one
variety planted two feet on center.
The proposed pond/wetlands shall be excavated to a minir-num depth
of four feet. Within five feet of the final shore line, the Ipond
depth will be two feet sloped @ 1:4 to meet the existing
topography in the shortest distance to preserve existing
vegetation.
Pond AerotTon:
Aerating nozzles will be used at o minimum of one location
within the limits of the new pond. Aerotfon will reduce the
algae and slime growth while speeding along the process ~of
balancing the pond.
All electrical shall be connected to ground fault interrupter 2
pole, 3 wire grounding duplex receptacle
Aeration systems shall conform to the following table of
underwater connections and assembled os detailed by Lilypon Water
Gardens, Lilypons, Maryland 21717-0010.
Pump required to aerate the pond shall be of the following
specifications:

Size of Pits:
The depth of pits for container grown shrubs shall be adequate to provide
o minimum of three inches of soil under the bails.
Plante:
Container grown plants with root ball 25% or less In diameter and depth
than that specified for B & B moteri~ will be acceptable for plants specified as
B & B. A 15~ tolerance will be allowed In diameter and depth provided that the
volume of the resultant root boll is not tess than the volume of the root
ball spceifled,
Container grown shrubs moy be planted In existing soil with the
incorporation of an approved organic material equal to one quarter
(1/4) the pit volume.
Planting Soil:
Shall consist of topsoil and approved organic material pre-mixed In the
proportion of one part organic material to seven parts topsoil.
Fertilizer:
MAG AMP (7-40-6) and Triple Superphosphote (0-46-0) shall be placed in
each plant pit before setting plants at the following rates:
One pound of MAG AMP and one-half (1/2) pound of triple superphosphote for
each major tree. One-half (1/2) pound of MAG AMP and one quarter (1/4)
pound of trl le superphoephate for each minor tree and evergreen tree.
One eighth ~1/8) pound of MAG AMP and one eighth (1/8) pound of triple
superphosphote for each shrub. Up to three waterings for the compaction
of the planting soil after satang plants and before applying mulch shall
be provided. Saucer depth sh~ll be three (3) Inches.
Mutchlng:
A six-inch (6) layer of shredded wood of wood chip mulch shall be
uniformly placed in the area of ~11 plant pits and planting beds. After
mulching, fertilizer shall be evenly applied to all mulched areas at a
rate of 0.15 pounds of fertilizer per squore foot. A second applicotlon of
10-6-4, at the same rate, shall be made on the mulched ~re~s at the end of
the period of establishment.
Care of Planting:
Care of planting shaft consist of keeping the plants In a healthy growing
condition by watering, weeding, culUvotlng, pruning, spraying, with
Insecticides, tightening of guys, re-mulching, applying approved
anti-desiccants as directed, and by any other necessary operations.
All plants shall be watered to provide not less than five gallons of water
per square yard (1" foyer of water) of plant pit and bed areas.
Unless otherwise approved, all plants shall be sprayed with a~
anti-desiccant. ]'ne anti-desiccant shall be applied occordlng to the
manufacturer's directions to thoroughly cover all above ground parts. The
time of application shell be ~s follows unless otherwise approved:
Evergreen: Apply within 10 doys following pleating.
Deciduous: Spring planting-Apply when leaves have reached at least
seventy-five percent (75%) of mature size.
FaTI planting-Apply in October or November when the temperature Is 40
degrees Fahrenheit or over.
Ail dead, unhealthy, or badly Impaired plants shall be promptly removed
from the project. In the event of the threat of serious damage from
insects, dlse~ses, or rodents, the plants shall be treated by preventive
or remedial measures approved for good horticultural practice.
