Statement of Problem
Parcels served by individual sewage systems and private wells must have a minimum lot
area of 40,000 square feet in accordance with Article 6, §760-605, paragraphs A.5 and
C.1 of the Suffolk County Sanitary Code.
Construction standards require that the distance between sanitary systems and shallow
private wells be at least 150 feet. The applicant is proposing installing the sanitary
system less than 150 feet from private wells.
Findings and Facts
1. The applicant is proposing to remove and replace an existing single-family
dwelling on a residential lot with an area of 17,724 square feet(sf). The new
dwelling is proposed to ham e 4 bedrooms (3 bedrooms and a study that
qualifies as a bedroom).
2. The site is located in Groundwater Management Zone 4.
3. Depth to groundwater is 11.4 feet below existing grade.
4. Soil conditions are good with fine to medium sand at 3.5 feet below existing
grade-
s. The property is currently improved with a single-family dwelling and a two-
bedroom cottage and garage. The cottage and garage will remain. All
existing structures have certificates-of-occupancy issued by the Town of
Southold.
6. The existing dwelling is served by a sewage disposal system consisting of one
cesspool (no septic tank). The existing disposal system will be removed or
abandoned in accordance with department requirements.

7. The applicant is proposing to use a new drinking water well installed on the
east side of the property. The well has a total well depth of 66 feet and a static
water level of 20 feet. Screen length is 4 feet. There is 42 feet of water above
the top of the screen. The new well is not shallow and is required to be 100
feet from sewage disposal systems.
8. A sample from the proposed well was analyzed by EcoTest Laboratories(Lab
No. 252949.01) on August 11, 2005. The water analysis indicated that total
aldicarb and methyl ethyl ketone(mek)both exceed New York State drinking
water limits. The nitrate level was 9.8 mg1L and is close to the limit of 10.0
mg/L for potable water, The applicant is proposing to install water treatment
for Aldicarb and nitrogen removal.
9. The proposed sewage disposal system consists of a 1,000 gallon precast septic
tank and five 8-foot 4� by four feet deep leaching pools with expansion area
for 2 leaching pools.
10. The variances requested are as follows:
a. Proposed sewage disposal system
i. 123 feet from existing well on the property to the south(Tillman).
ii. 120 feet from existing well on the property to the north(Rodger).
11. The owners of the two properties of the wells less than 150 feet were
contacted in order to get specific information on their wells. The Rodger well
is located in the basement of the house and the well point is only 5 feet below
the basement floor. The Tillman well was installed on August 30, 2004. The
well is 50 feet in total depth and the point is only 28 feet below groundwater
and is classified as a shallow well.
12. The applicant's engineer claims that neither neighbor is interested in having
their well moved
13. The Tillman well needed to be pulled back when it was being installed due to
saltwater intrusion. The Rodger well is in the basement. Due to existing
constraints on the surrounding properties neither off-site well can be deepened
or moved to an area where separation distance requirements can be mek
14. Direction of groundwater flow is reported by the engineer to be to the west,
toward Mattituck Creek. An effluent plume from the proposed sewage
disposal system will flow to the west, Laterally to the surrounding wells and

away from the proposed well. According to the applicant's engineer, the
plume will not be within the capture zones of any of the wells.
Determination
It was a 3 to 0 determination of the Board of Review(Board) to grant the request for the
variance to construct the sewage disposal system and well at the proposed locations
provided that the applicant can satisfactorily document to the department, as is
customarily required prior to the scheduling of a Board hearing, that the affected
surrounding property owners have declined to have their wells moved-
The proposed sewage disposal system is located at an optimal distance from wells on
adjacent property. The new disposal system is larger with respect to storage and leaching
capacity than the previously existing system. The proposed septic tank will provide a
greater degree of sewage treatment before discharge than the pre,nous (no septic tank)
sewage disposal system that is being removed
In order to meet drinking water standards, it will be required that a water treatment
system acceptable to the department be installed that includes treatment for Aldicarb and
nitrogen removal for the drinking water supply. The covenants normally required for
approval of a well with treatment shall include an agreement to connect to the public
water supply if mains are extended within 150 feet from the property.
As per §760-609 of the Suffolk County Sanitary Code (Sanitary Code), the approval of
the variance is in harmony with the general purpose and intent of the Sanitary Code to
protect groundwater and drinking water supplies, surface water and other natural
resources, and public health,safety and welfare. In compliance with §760-609(lxa), the
proposed variance is in general conformity with the Sanitary Code. The uses of
groundwater, surface water,and drinking water supplies will not be impaired,taking into
account the direction of groundwater flow and, as such the granting of the variance is in
compliance with §760-609(1)(b).
