TERMS and CONDITIONS The Permittee Nunnakoma Water Association residing at Wampum Way . Southold N.Y., as part of the consideration for the is_~,-nce of *he Permit does understand and prescribe to the fol- lowing: 1. That the said Board of Trmtees and the Town of Southold are released from any atai all damages, Or dalmq for damages, of suits arising directly or indirectly as a result of any oper- ation performed pursuant to this permit, and the said permi~tee ~ at his or her owll expeose~ defend any and all. such suits initiated by third parties, and the said Permittee assumes full Liability with respect thereto, to the complete exclusion of the Board o~ Trustees of the Town of Southold 2. That thh Permit is valid for a period of 24 mos. which is considered to be the estimated time required to complete the work involved, but should circumstances warrant, request for an extension may be made to the Board ar a later date.- 3. That this Permit should be retained indefinitely, or as long as the said Permitter wish~ to maintain the structure or project involved, to provide evidence to anyone concerned that aufla~ orization was originally obtained. 4. That .the work involved will be subject to the inspection and approval of the Board or its agents, and non-compliance with the provisions of the originating application, may be cause for revocation of this Permit by resolution of the said Board. 5. That there will be no unreasonable interference with navigation as a result of the work herein authorized. 6. That there shall be no interference with the right of the public to pass and repass along the beach between high and low water marks. 7. That if future operations of the Town of Southold require the removal and/or alterations in the location of the work herein authorized, or if, in the opinion of the Board of Trtutees, lt~ work shall cause unreasonable obstrumon to free navigation, the said Permk-tee will be requked~ upon due notice, to remove or alter this work or project herein stated without expenses to the Tovm of Southold. 8. That the said Board will be notified by the Permlttee oz the completion of the work auth- orized. 9. Re: App. No. 667 Dear Mr. Kassner: The following action was taken by the Board of Town Trustees during its regular meeting held on February 22, 1990 regarding the above matter: WHEREAS, Robert Kassner on behalf of Nunnakoma Water Association, Inc. applied to the Southold Town Trustees for a permit under the provisions of the Wetland Ordinance of the Town of Southold, application dated Septemper 16, 1988 and, WHEREAS said application was referred to the Southold Town Conservation Advisory Council for their findings and recommendations, and, WHEREAS~ a public hearing was held by the Town Trustees with respect to said application on February 22, 1990 at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS,~ the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW, THEREFORE BE IT RESOLVED that ROBERT KASSNER ON BEHALF OF NUNNAKOMA WATER ASSOCIATION, INC. BE AND HEREBY IS GRANTED PERMISSION UNDER THE WETLAND ORDINANCE TO: Dredge channel approximately 1500 c.y. of material to be hydraulically removed and pumped to adjacent beach as nourishment. This permit will expire two years from the date it is si~ned if work has not commenced by said date. Fees must be paid, if applicable, and permit issued within six months of the date of~this notification. Two inspections are required and the Trustees are to be notified upon completion of said project. Please return to the Building Department for a determination on the need for any other permits which may be required for this project. New York 11971 SOUTHOLD TOWN CONS ERVATION ADVISORY COUNCIL To: Southold Town Trustees From: Southold Town Conservation Advisory Council Dated: November 15, 1988 The following recommendations were made by the CAC at its regular meeting held Tuesday, November 15, 1988: RESOLVED to recommend to the Southold Town Trustees approval of Wetland Application No. 667 of Robert G. Kassner on behalf of Nunnakoma Waters Association Inc. to dredge channel, approximately 3600 c.y. of material to be hydraulically removed and pumped to adjacent beach as nourishment. Corey Creek, Southold. Southerly end of Wampum Way. RESOLVED to recommend to the Southold Town Trustees approval with stipulations Wetland Application No. 668 of Mattituck Inlet Marina for proposed dock and dredging. The CAC approves with the stipulation that the proper gradient is maintained to prevent the distruction of the bank and grasses. Also, due to the large number of boats and the popular use of the marina the CAC feels the Southold Town Trustees should require a pumpout facility at the marina. Mill Road, Mattituck. RESOLVED to recommend to the $outhold Town Trustees approval of Wetland Application No. 669 of Marie Nerosyan to remove and replace (in same location and configuration) 23 I.f. of existing timber bulkhead and attach to existing bulkheads to north and south. An 8' return to be constructed on north side. Replace and existing stairway and 8' x 11' fixed dock with a 4' x 20' walk. Maximum 10 c.y. of spoil to be removed from in fornt of bulkhead to 3' below MLW and used as backfill. Mesrobian Drive, Laurel. RESOLVED to recommend to the Southold Town Trustees approval of Wetland Application No. 671 of Daniel C. Mooney to install and maintain three fence posts and 16' split rail fence.
