The public hearing on this application was also held on December 22, 1982.
Upon application for THEODORE AND MEL METALIOS, by Irving L. Price,
Jr., Esq., 828 Front Street, Greenport, NY for a Variance to the Zoning
Ordinance, Article III, Sections 100-30C and 100-32 for permission to
construct tennis court and deck to be located in the frontyard area at
16315 Main Road, East Marion, NY; County Tax Map Parcel ID No. 1000-023-
01-012.2.
The board made the following findings and determination:
By this appeal, appellants seek permission to construct an accessory
tennis court and deck area to be located in the center of the frontyard
area, approximately 110 feet south of the existing dwelling and 115 feet
from the Main Road (at its furthest point), 25 feet from the west bound-
ary line and at approximately 16 feet from the east property line. Also
proposed is a 10-foot fence to be erected only at the north and south
ends of the proposed 60' by 120' tennis court. The lot in question con-
tains an area of 1.2 acres and road frontage of 132.13 feet. The rear
of the existing one-family dwelling is set back approximately 75 feet
from the rear property line.
In considering this appeal, the board determines that the vari-
ance request is not substantial; that the circumstances are unique;
that by allowing the variance as indicated below no substantial
detriment to adjoining properties will be created; that the difficulty
cannot be obviated by a method feasible to appellants other than a
variance; that the relief reqQested will be in harmony with and pro-
mote the general purposes of zoning; and in view of the manner in
which the difficulty arose and in consideration of all the above
factors, the interest of justice will be served by allowing the
variance, as indicated below.
On motion by Mr. Douglass, seconded by Mr. Doyen, it was
RESOLVED, that Appeal No. 3059, application for THEODORE AND MEL
METALIOS for permission to construct tennis court and deck area in
the frontyard area approximately 115' from the Main (State) Road,
Orient, be and hereby IS APPROVED SUBJECT TO THE FOLLOWING CONDITIONS:

1. STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties or unneces-
sary HARDSHIP because a tennis court is not a permitted use as an accessory
structure thus depriving applicant of an ordinary use of property.
2. The hardshipcreated is UNIQUE and isnotshared by all properties alike in the immediate
vicinity ofthis property and inthis use district because the existing residence is near
the rear of a lot 455 feet deep. There is also a home owned by another
person somewhat near to what would normally be the rear yard of applicant.
The proposed location of the tennis court and accessory deck and bench is
115 feet back from Main Road (front) and will be screened by extensive
plantings on all sides.
3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE
CHARACTER OF THE DISTRICT because the front yard in this instance is akin
to a rear yard, will be heavily screened and is set back further than
most rear yards.

Dear Mr. Haje:
The following action was taken by the Board of Town Trustees during
their regular meeting held on August 27, 1987 regarding the above matter.
RESOLVED that the Southold Town Trustees Approve the request made by
En-Consultants, Inc. on behalf of Theodore Metalios for a waiver of the
Wetland Ordinance to remove x(egetation killed by Hurricane Gloria, bring
in 199+ cu. yds. of fill, I00_+ topsoil, grade into 4' hinged mounds, construct
2' high timber retaining wall on the south side of existing tennis court and
revegetate according to planting plan. Property is located on the north side
of Main Road, East Marion. This waiver is granted all in accordance with the
planting plan and the survey submitted dated May 12, 1987.
Please be advised that there is a $25.00 fee for this waiver granted.

New York State Department of Environmental Conservation has found the
__parcel X project to be:
Greater than 300' from inventoried tidal wetlands. (e~ One end)
Landward of a substantial man-made structure (Permanent Read)
greater than 100' in length constructed prior to September 20, 1997.
Landward of 10' contour elevation above mean sea level ~n a gradual, nat-
ural slope.
Landward of topographical crest of bluff, cliff or dune in excess of 10
feet in elevation above mean sea level.
Therefore, no permit under Article 25 (Tidal WetLands of the Environmental
Conservation Law) is required at this time since the current proposal is beyond
State mandated Jurisdiction pursuant to this act. However, any additional work
or modifications to the project may require a permit. It is your responsibility
to notify this office, in writing, if such additional work of modifications are
contemplated.

1. STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties or unneces-

structure thus depriving appZicant of an ordinary use of property.
2. The hardship created is UNIQUE and is not shared by all properties alike in the immediate
vicinity of this property and in this use district because the existing residence is near
the rear of a lot 455 f~t deep. There ia also a ho~e o~ned by another
parson somewhat near to what would normally he the rear yard of applicant.
The proposed location of the tennis court and accessory deck and bench is
115 feat back frc~ Main Road (front) and will be screened by extensive
plantings on all sides.
