The public hearing on this appeal was held on June 17, 1982.
Upon application of PETER KUJAWSKI, by Stanley C. Corwin, Esq., 634
First Street, Greenport, NY for a Variance: (1) to the Zoning Ordinance,
Article III, Section 100-31 for approval of the insufficient yard setbacks
due to location of new lot line, and (2) to New York Town Law, Section
280-A for Approval of Access. Location of Property: 3275 Skunk Lane,
Cutchogue, NY; bounded north by Bay Homes Subdivision and Kujawski; east
by Pontino and ano.; south by Marco; west by Skunk Lane; County Tax Map
Parcel No. 1000-97-9-10.1.
The board made the following findings and determination:
By this appeal, appellant seeks approval of insufficient yard area
extending three feet, more or less, from the proposed new division line
to the existing farm building on Parcel II. Appellant also seeks approval
of access over a right-of-way 297.39' in length and 51.06 feet in width
extending along the southerly side of property now or formerly of Anderson
155 feet,more or less, and extending approximately 142.39 feet along the
southerly side of the properties in question of appellant. Parcel I will
contain an acreage of 1.167 and Parcel 2, 10.0 acres.
The Planning Board on May 24, 1982 granted a conditional "set-off"
division pursuant to Chapter 106-13.
In considering this appeal, the board determines that the variance
request is not substantial in relation to the code requirements; that
the circumstances herein are unique; that by allowing the variance no
substantial detriment to adjoining properties would be created; that
the difficulty cannot be obviated by a method, feasible to appellant,
other than a variance; that no adverse effects will be produced on
available governmental facilities of any increased population; that the
relief requested will be in harmony with and promote the general pur-
poses of zoning; and that the interests of justice will be served by
allowing the variance as indicated below.
On motion by Mr. Grigonis, seconded by Mr. Douglass, it was

(b) Have topsoil removed to a depth of eight inches and then
filled with eight inches of a good grade stone and sand bank run. The
surface shall then be covered with a layer of two to four inches of
three-quarter-inch stone blend, or in the alternative oiled with a
minimum of four-tenths of a gallon of road oil per square yard.
3. No certificate of occupancy shall be issued for the construction
of any buildings or structures, or any existing buildings or structures,
on the premises to which this access is referred until all of the condi-
tions set forth herein have been complied with.
4. Where the terrain of the land over which this access road is
traversed is such that drainage problems may occur, the applicant and/or
owner shall be required to construct such drainage facilities as may be
recommended by the Town Engineer.
5. That this access road be approved by the Town Road Inspector or
Engineer, Town Building Inspector, or Board of Appeals as to meeting the
above requirements.
6. That this access road must be maintained at all times in good
satisfactory condition as stipulated above for access by all vehicles.

Please be advised that the following action was taken at
a Regular Meeting of the board held Thursday, June 17, 1982
concerning the above-entitled variance application:
RESOLVED, that the application for Peter Kujawski for

May 6, 1982, located at Cutchogue, subject to the following conditions
within six (6) months from date of resolution:
1. Receipt of the filing fee in the amount of $50
2. Applicant receiving approval from the Zoning

Dear Mr. Corwin:
In response to your request dated April 14, 1982, please
be advised that it is the unanimous decision of the board not
to schedule this matter for public hearing until such time as
the Planning Board has had an opportunity to officially take
action on the proposal and has recommended that this Board
proceed with the public hearing.
In the event the Planning Board does contemplate changing
the location of the proposed lot lines near the buildings
requiring the setback variance, that action may affect the
setback variance as presently applied for.
We are enclosing a copy of the Procedures adopted
January 13, 1982 pertaining to the procedures involving
subdivisions.
Upon receipt of the Planning Board's comments or
recommendations, we will be happy to proceed with your
application expeditiously as possible.

Application of Peter Kujawski
Gentlemen
A mailed announcement that the Planning Board expected me to make an
appearance before it on April 12th reached me the following day. I know
Mrs. Long mailed the card notwithstanding the unexpected snowfall, but
the postal service obviously gave it something less than first class delivery
service.
I am greatly distressed at this development, for I understand the Planning
Board merely adjourned the matter.
Now I request that in spite of the fact you have no communication officially
from the Planning Board, you schedule a hearing on this application. I
make this request because time is of;the essence; not in the contractual
sense, but because neither the buyer nor seller knows who is going to
farm this year. We simply can't wait.
Should the Planning Board not act before the hearing it could, I'm sure,
be conducted on an "if" basis. Whether that Board requires a formal map
or permits a set-off, it's ultimate determination is a foregone conclusio~l
since we have adequate area and a 50 foot right of way. The new property
lines create a variance which is really the basic concern.
I urge you to give this request a favorable response.

Dear Mr. Goehringer:
Supplementing the papers already on file in this appeal
there is enclosed a copy of a letter to Mr. Raynor of the
Planning Board and a copy of the description to the access
over the Patricia Marco property to the south of the ten-acre
parcel in question.
Also enclosed is a letter from Rudolph H. Bruer who is
the attorney for both Patricia Marco and Phil Marco Productions,
Inc. acknowledging notice of the application.
The line on a course N. 32° 11' W. for 100 feet between the
existing accessory buildings is one foot from the structure marked
as a barn and eleven feet from the accessory buildings that will
be a part of Lot 1.
I trust this information will enable the Board to act upon
this application. If you need anything further, please let me know.
