( ,�{{ , , , , - AL : SEE PLAN SCALE_: 1/4" r 11-011 Michael J.Domino,President o��rjF SU(/l�ol Town Hall Annex 54375 Route 25 John M.Bredemeyer III,Vice-President P.O.Box 1179 Charles J.Sanders Southold,New York 11971 Glenn Goldsmith G2 • Telephone(631) 765-1892 A.Nicholas y�4U Kru ski O Fax(631) 765-6641 p 1, M`I,N� BOARD OF TOWN TRUSTEES TOWN OF SOUTHOLD November 15, 2017 :Clifford & Karen Cid 675 Meadow Lane Mattituck, NY 11952 RE: 675 MEADOW LANE, MATTITUCK SCTM# 1000-115-5-7 Dear Mr. & Mrs. Cid: The Board of Town Trustees took the following action during its regular meeting held on Wednesday, November 15, 2017 regarding the above matter: WHEREAS, CLIFFORD & KAREN CID applied to the Southold Town Trustees for an Administrative Permit under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance, original application dated October 10, 2017, and, WHEREAS, said application was referred to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator recommended that a portion of the proposed application specifically to remove non-native plants and fencing in the 30' wide non- disturbance buffer area; revegetate with native plantings; install a 4'x44' bluestone path to pond; construct new 14'x22' elevated second-floor deck and stair to grade be found Inconsistent with the Local Waterfront Revitalization Program, and is also considered prohibited due to filed Covenants and Restrictions Liber 1X501 page 561, and, WHEREAS, the LWRP Coordinator issued a recommendation that a portion of the application specifically to install a split-rail fence; create a softer grade along north side of dwelling by adding 3'x22' tumbled bluestone steps; install a 315sq.ft. bluestone patio at seaward side of dwelling; install a 3'x22' bluestone walkway along seaward southerly side of dwelling; and remove 17'6"x4' balcony and stair to grade be found Consistent with the Local Waterfront Revitalization Program'policy standards if they are located outside of the 30' wide non-disturbance buffer, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the field inspection of the Board on June 13, 2017 disclosed disturbance within this 30' wide non-disturbance buffer area including the construction of a fence purportedly undertaken by a prior owner of this property, and, WHEREAS, the Board finds that the proposed activity in this application seeks to take place within a 30' wide non-disturbance buffer area that is preserved by a restrictive covenant (C&R) filed in Suffolk County in Liber 1X501 Page 561, and, WHEREAS, this property has a history of violations within the 30' wide non-disturbance area, and, NOW THEREFORE BE IT RESOLVED that the Board of Trustees DENIES WITHOUT PREJUDICE the application of CLIFFORD & KAREN CID for the removal of non-native plants and fencing in the 30' wide Non-Disturbance Buffer area; re-vegetate with native plantings and install a split- rail fence; create a softer grade along north side of dwelling by adding 3'x22' tumbled bluestone steps; install a 315sq.ft. bluestone patio at seaward side of dwelling; install a 4'x44' bluestone path to pond; install a 3'x22' bluestone walkway along seaward southerly side of dwelling; remove 17'6"x4' balcony and stair to grade and construct new 14'x22' elevated second-floor deck and stair to grade; and as depicted on the vegetation, walkways, patio, fencing site plan prepared by Clifford & Karen Cid, received on October 10, 2017, and also as depicted on the proposed deck site plan prepared by Clifford & Karen Cid, last dated October 7, 2017. SCTM# 1000-115-5-7 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the actions to remove of non-native plants and fencing in the 30' Non-Disturbance Buffer area; re-vegetate with native plantings, install a 4'x44' bluestone path to pond, and install a split-rail fence and construct new 14'x22' elevated second-floor deck and stair to grade is INCONSISTENT with the below listed Policy Standards and therefore is INCONSISTENT with LWRP. •6.3 Protect and restore tidal and freshwater wetlands.
