1982 and thence recessed until September 30, 1982, at which time the
hearing was declared closed.

Main Road, Mattituck, NY for Variances: (1) to New York Town Law, Sec-
tion 280-A for approval of access, and (2) ~o the Zoning Ordinance,
Article III, Section 100-31 for permission to construct new dwelling with
an insufficient frontyard setback from Landing Road. Location of
Property: Haywaters Road, Nassau Point, Cutchogue, NY; Subdivision
Lot No 1 as shown on Map of Peconic Bay Properties No. 786; Suffolk
County Tax Map Parcel No. 1000-111-1-42.
The board made the following findings and determination:
By this appeal, appellant seeks: (t) approval of access over a
private road known as "Haywaters Road Extension" as shown on the Map of
Peconic Bay Properties, Map No. 786, which road'has a width of 33 feet;
and (2) permission no construct a new one-family dwelling with an
insufficient frontyard setback off Landing Road a~ 15 feet. The premises
in question has a width of 65 feet as measured at a tie line (roadline
has an irregular curve) and an average depth of 275.50 feet, giving a
total area of approximately 16,608 square feet. The new dwelling
proposed will comply with other setbacks..as-required by the zonmng code.
This premises is located in the "A" Residential and Agricultural Zone
and is vacant. It should also be noted that this parcel is located in
the Flood Zone "A-4 [El. 8' minimum], and the elevation above mean sea
level in the location of this proposed dwelling varies from three feet
to eight feet.
It is the opinion of this board that the access road in question
is in good satisfactory condition.
In considering this appeal, the board determines that the variance
requested is not substantial; than the circumstances herein are unique
and practical difficulties have been shown; that by allowinq the variance
no substantial detriment to adjoining properties~would be c~eated; that
the difficulty cannot be obviated by a method feasible to appellant other
than a variance~ that no adverse effects will be produced on available
governmental facilities of any increased population; that the relief
requested will be mn harmony with and promote the general purposes.of
zoning; and that the interests of
variances requested, as indicated

A Variance to Section 280A Subsection 3
A Variance to the Zoning Ordinance
is requested for the reason that Applicant seeks to build a house on a corner parcel as
shown on annexed survey requiring a front yard variance and approval of access.

1. STRICT APPLICATION OF THE ORDINANCE would produce practical difficultiesbr"unnece~:'
sary HARDSHIP because subject premises is located on the corner of two private roads,
both located in filed sub-division maps requiring an access variance. Due to the
fact that the property is is a corner parcel, it has two front yards. Applicant seeks
to locate house as shown on annexed survey, which location requires a front yard
set back of 15 feet from the required 50 feet away from Landing Road.
2. The hardship created is UNIQUE and is not shared by all properties alike in the immediate
vicinity of this property and in this use district because property is a corner parcel and unless
a front yard variance is granted, the parcel ,~ould be unsuitable for the construction
of a single family residence.
3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE
CHARACTER OF THE DISTRICT because ~subject premises is~a lot on a filed map, and
the character of the neighborhood would not be chenged by the granting of a variance
for the construction of a single family residence. Th ere are many houses located
on the private road.

san/HARDSHIP because subject premises is located on the corner of two private roads,
both located in filed sub-division maps requiring an access variance. Due to the
fact that the property is is a corner parcel, it has two front yards. Applicant seeks
to locate house as shown on annexed survey, which location requires a front yard
set back of 15 feet from the required 50 feet away from ]~anding Road.
2. The hardship created is UNIQUE end is not shored by all properties alike in the immediate
vicinity of this property end in this use district because property is a corner parcel and unless
a front yard.variance is granted, the parcel would be unsuitable for the con~,truction
of a single family residence.
3. The ~/ariance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE
CHARACTER OF THE DISTRICT because ~ubject premises is'a lot on a filed map, and
