Matttuck Creek,Town of Southold,Suffolk Countv Request for Additional Data and Information Dear Mr. Hall: The Department of State received your Federal Consistency Assessment Form and consistency certification and supporting information regarding the above referenced proposal. Pursuant to 15 CFR Part 930.58, the following additional data and information is required to enable the Department of State to adequately assess and undertake Its review of the coastal zone effects of this proposed activity 1. Please note that as of November 11,2005, the Town of Southold has a federally approved Local Waterfront Revitalization Program (LWRP). Please submit a revised policy analysis which assesses the consistency of the proposed activity with the policies of the Town of Southold LWRP. 2. The policy analysis provided is inadequate. Please pay particular attention to Policy 4.1. D which states that hard structural erosion protection measures be used for control of erosion only where: the construction of a hard structure is the only practical design consideration and is essential to protecting the principal use,and the proposed hard structural erosion protection measures are limited to the minimum scale necessary. Please be sure to provide a more thorough analysis that clearly discusses the necessity of the proposed bulkhead. 3 The proposed activity would be undertaken within the State designated Mattituck Inlet and Creek Significant Coastal Fish and Wildlife Habitat. Consistency-,vith LWRP Policy 6.2 requires that"Significant Coastal Fish and Wildlife Habitats will be protected, preserved,and where practical,restored so as to maintain their viability as habitats." Please provide an alternatives analysis which supports the consistency of the proposed activity with LWRP Policy 4.1.13 which requires that such structures be Lnuted to the minimum scale necessary. 5. Please provide the necessary information requested above as soon as possible. If this necessary information and data is not provided within thirty days of the date of this letter,the Department of State may close the File regarding this proposed activity. The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP)Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is exempt from review pursuant to Chapter 268-3, Exempt Minor Actions, item B which states: "Replacement, rehabilitation or reconstruction of a structure or facility, in kind, on the same site, including upgrading buildings to meet building or fire codes, except for structures in areas designated by the Coastal Erosion Hazard Area (CEHA) law where structures may not be replaced, rehabilitated or reconstructed without a permit".
