The public hearing on this appeal was held on June 17, 1982.
Upon application of ELWOOD AND CAROL HUGHES, 1711 Meadow Lane, East
Meadow, NY 11554, for a Variance to the Zoning Ordinance, Article III,
Section 100-31 for permission to construct addition to dwelling with an
insufficient sideyard at 6125 Skunk Lane, Cutchogue; Filed Map No. 1179,
Part of Lot 130; County Tax Map Parcel No. 1000-104-4-1.
The board made the following findings and determination:
By this appeal, appellants seek permission to construct a 9'4" by
13'4" addition to the kitchen area, leaving a setback to the northerly
property line of seven feet, a total reduction of four feet from the
existing house. The board feels that the relief requested is minimal
and practical under the circumstances, and therefore agrees with the
reasoning of appellants.
In considering this appeal, the board determines that the variance
request is not substantial in relation to the code requirements; that
the circumstances herein are unique; that by allowing the variance no
substantial detriment to adjoining properties would be created; that
the difficulty cannot be obviated by a method, feasible to appellant,
other than a variance; that no adverse effects will be produced on
available governmental facilities of any increased population; that the
relief requested will be in harmony with and promote the general pur-
poses of zoning; and that the interests of justice will be served by
allowing the variance as indicated below.
On motion by Mr. Goehringer, seconded by Mr. Sawicki, it was
RESOLVED, that the application of ELWOOD AND CAROL HUGHES for
permission to construct addition to dwelling with an insufficient
sideyard, be and hereby is APPROVED AS APPLIED FOR in Appeal No. 2995.

Map Parcel No. 1000-104-4-1.
Vote of the Board: Ayes: Messrs. Goehringer, Doyen, Grigonis,
Douglass and Sawicki. This resolution was unanimously adopted.

1. STR CT APPLICATION OF THE ORDINANCE woula produce practical difficulties or unneces-
sary HARDSHIP because Appellant'$ house ~s lo~ated on a large parcel of land bounded
on the South and West side by a 50' wide public road (Skunk Lane)'and on the North
a~d East side by two equally large parcels. The northerly side of the house
contains a mud porch. The Appellant desires to enlarge the mud porch and include
it as part of the kitchen area thus providing more utility and beneficial use of
the house. The NE corner of the proposed addition is close to the North property
line end the distance from the corner of the addition to the property line would
change from 11 feet to approximately 7 feet. This is an lnsignificant change
since the neighboring house is situated more than 100 feet from the property
line in question.
2. The hardship created is UNIQUE and is not shared by all properties alike in the immediate
vicinity of this prope_rty and in this use district because The topography of the land is
such that~the southerly part of the Appellant's property has a natural pond
which not only provides natu=al drainage for the Appellant's property but also
the adjacent property of Watts and Bozsnyak and also provides drainage for the
publi~, road (Skunk Lane). In order to preserve this natural pond and continue'
the natural flo~ of-drainage the Appeltant's house was located close (within
11 feet) of the North property line~ thus benefiting the neighbors and the
public.
3. The Variance would Observe the spirit of the Ordinance end WOULD NOT CHANGE THE
CHARACTER OF THE DISTRICT because The neighboring .houses are situated
remotely (in excess of 100. feet) from the property line in question and
remotely from the Appellant's house and the minor variance requested would
not factually change the existing, conditions.
For the above-stated reasons favorable consideration by the Zoning Board of
Appeals is respectfully requested.,

for permission to construct addition to dwelling with an insuffi-
cient sideyard, be and hereby is APPROVED AS APPLIED FOR in
Appeal No. 2995.
This resolution was unanimously adopted.
An official determination and findings will be filed with
the office of the Town Clerk as soon as possible and simultane-
ously forwarded to you for your records.

1. STRICT APPLICATION OF THE ORDINANCE would produce procticol difficulties or unneces-
sary HARDSHIP becau~ Appellant's house is located on a large parcel of la~d bouhded
on the South and West side by a 50' wide public road (Skunk Lane) and on the North
and East side by two equally large parcels. The northerly side of the house
contains a mud porch. The Appellant desires to enlarge the mud porch and include
it as part of the kitchen area thus providing more utility and beneficial use of
the house. The NE corner of the proposed addition is close to the North property
line and the distance from the corner of the addition to the property line would
change from 11 feet to approximately 7 feet. This is an insignificant change
since the neighboring house is situated more than 100 feet from the property
line in question.
2. The hardship created is UNIQUE and is not shared by ail properties alike in the immediate
vicinity of this property and in this use district because The topography of the land is
such that the southerly part of the Appellant's property has a natural pond
which not only provides natural drainage for the Appellant's property but also
the adjacent property of Watts and Bozsnyak and also provides drainage for the
public road (Skunk Lane). In order to preserve this natural pond and continue
the natural flow of drainage the Appellant's house was located close (within
11 feet) of the North property line thus benefiting the neighbors and the
public.
3 The Vcriance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE
CHARACTER OF THE DISTRICT because The neighboring houses are situated
remotely (in excess of 100 feet) from the property line in question and
remotely from the Appellant's house and the minor variance requested would
not factually change the existing conditions.
For the above stated reasons favorable consideration by the Zoning Board of
Appeals is respectfully requested.
