That the said Board of Trustees and the Town of Southold are released from any and all damages, or claims for damages, of suits arising directly or indirectly as a result of any operation performed pursuant to this permit, and the said Permittee will,at his or her own expense, defend any and all such suits initiated by third parties, and the said Permittee assumes full liability with respect thereto, to the complete exclusion of the Board of Trustees of the Town of Southold. 2. That this Permit is valid for a period of 24 months,which is considered to be the estimated time required to complete the work involved, but should circumstances warrant, request for an extension may be made to the Board at a later date. 3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to maintain the structure or project involved, to provide evidence to anyone concerned that authorization was originally obtained. 4. That the work involved will be subject to the inspection and approval of the Board or its agents, and non-compliance with the provisions of the originating application may be cause for revocation of this Permit by resolution of the said Board. 5. That there will be no unreasonable interference with navigation as a result of the work herein authorized. 6. That there shall be no interference with the right of the public to pass and repass along the beach between high and low water marks. 7. That if future operations of the Town of Southold require the removal and/or alterations in the location of the work herein authorized, or if, in the opinion of the Board of Trustees, the work shall cause unreasonable obstruction to free navigation, the said Permittee will be required, upon due notice,to remove or alter this work project herein stated without expenses to the Town of Southold. 8. That the said Board will be notified by the Permittee of the completion of the work authorized. 9. That the Permittee will obtain all other permits and consents that may be required supplemental to this permit,which may be subject to revoke upon failure to obtain same. 10. No right to trespass or interfere with riparian rights. This permit does not convey to the permittee any right to trespass upon the lands or interfere with the riparian rights of others in order to perform the permitted work nor does it authorize the impairment of any rights, title, or interest in real or personal property held or vested in a person not a party to the permit. McLean Associates, P.C., on behalf of MATTITUCK PARK DISTRICT applied to the Southold Town Trustees for a permit under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated January 9, 2018, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator issued a recommendation that the application be found Consistent with the Local Waterfront Revitalization Program policy standards, and, WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on February 14, 2018, at which time all interested persons were given an opportunity to be heard, and, 2 WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standards set forth in Chapter 275 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that the Board of Trustees have found the application to be Consistent with the Local Waterfront Revitalization Program, and, RESOLVED, that the Board of Trustees approve the application of MATTITUCK PARK DISTRICT to demolish two buildings (a 575sq.ft. comfort station and a 148sq.ft. shed), and construct a new 167sq.ft. comfort station; connecting new comfort station to upgraded sanitary system; and a re-vegetation plan using native beach grass species in the vicinity of the new comfort station and disturbed areas; and as depicted on the site plan prepared by L.K. PROJECT DESCRIPTION AND PURPOSE Veterans Memorial Park—Bathroom Facility LKMA Project#: 17107.000 SCTM#: 1000-126-6-17& 18 The Mattituck Park District proposes to demolish two buildings (a 575 s.f. aged comfort station and 148 s.f shed)and construct a new 167 s.f. comfort station for those residents and tourists utilizing the beach at Veterans Memorial Park, located at 11280 Peconic Bay Boulevard in Mattituck, NY. (Please refer to included site plans for full details and dimensions.) Veterans Memorial Park is Mattituck Park District's main recreational facility, featuring open recreation areas, a playground, a beach, pavilion and on-site parking lot. One of the buildings to be demolished is an aging comfort station that has been out of service due to antiquated conditions, and the other had been used as a shed. As evidenced in the included photos (see included photo sheet), the current site conditions in the vicinity of the proposed demolition include sand sparsely populated with grass. The proposed comfort station(see included elevation drawings) will serve users of the Peconic Bay beach at the park. The proposed building will be located further from the bulkhead(and tidal wetlands)than the prior structure was, and will be connected to the new sanitary system. The prior comfort station was closed a few years ago due to poor conditions, lack of accessibility, and its connection to an aged on-site sanitary system. Since that time, .a new sarutary system has been installed on-site, which is in full compliance with all current Suffolk County Department of Health water quality regulations. Temporarily, the main pavilion was serving the beach-goers, but this has proved to be a maintenance issue, safety hazard and impact on operations at the pavilion due to excessive sand and water accumulation on surfaces. The proposed comfort station will be a pre-fabricated concrete building installed on a slab on grade, and be reduced in size from the prior structures, thereby reducing the impervious area of the site. This structure and foundation type was selected to minimize disturbance to the natural conditions at the park, as well as to shorten the anticipated construction timeframe. A shorter construction timeframe also lends itself to rmnimizing environmental impacts of the project. The proposed comfort station will feature modern plumbing and lighting fixtures, thereby reducing energy use and water consumption at the facility. It will be fully ADA-compliant and accessible, thereby increasing public access to the waterfront, in accordance with the goals the Town of Southold's LVW and New York State's Coastal Management Policies. It will furthermore be easier for families with young children to access this new structure,than to navigate the pavilion. Construction will be undertaken in the most sensitive manner possible. The vacant land created by demolition will be kept graded in accordance with surrounding grades, and planted with native beach grasses. No trees, shrubbery, or natural plant life will be disturbed. No fill will be brought into the site and this project does not include any dredging; the only material removed from site will be the excavated material that will allow for the installation of the underground elements of the foundation and the sanitary connection. It is estimated that removed material will total to less than 100 cubic yards. Soil and erosion control measures will be installed in accordance with NYSDEC guidelines, and construction activity will be supervised by an engineer to ensure full compliance with all applicable environmental regulations. Areas cleared during construction will be protected from erosion. In summary, the decrease in impervious area, relocation of building further from the bulkhead, improvements to water quality, lessening of energy and water consumption, increase of public access to the waterfront, use of soil and erosion control measures and addition of native plantings are all in harmony with the Town's LVW and NYS Coastal Management Policies, and serve to minimize environmental impacts both during and after construction. • ;I Town of Southold t ' �+ LWRP CONSISTENCY ASSESSMENT FORM A. Foster a pattern of development in the Town of Southold that enhances community character, preserves open space, makes efficient use of infrastructure, makes beneficial use of coastal location, and minimizes adverse effects of development. The Mattituck Park District proposes to demolish two buildings and construct a new comfort station for those residents and tourists utilizing the beach at Veterans'Memorial Park, located at 11280 Peconic Bay Boulevard in Mattituck, NY Veterans Memorial Park is Mattituck Park District's main recreational facility, featuring open recreation areas, a playground, a beach, pavilion and on-site parking lot. The proposed comfort station will feature modern plumbing and lighting fixtures, thereby reducing energy use and water consumption at the facility It will be fully ADA-compliant and accessible, thereby increasing public access to the waterfront, in accordance with the goals the Town of Southold's LWRP and New York State's Coastal Management Policies Policy 2. Protect and preserve historic and archaeological resources of the Town of Southold. See LWRP Section III—Policies Pages 3 through 6 for evaluation criteria. Construction shall avoid disturbance or adverse effects on any object of archaeological or paleontological interest situated on or under lands that may be discovered during the construction and demolition phases Proposed comfort station shall be similar architecture of existing surrounding buildings Policy 3. One of the buildings to be demolished is an aging comfort station that has been out of service due to antiquated conditions, and the other had been used as a shed The proposed comfort station will be reduced in size from the prior structures, and designed in accordance with traditional coastal architecture The reduction in building size, as compared to the two building that are being removed, enhances the visual quality by expanding the scenic views The structure and foundation type was selected to minimize disturbance to the natural conditions at the park. The vacant land created by demolition will be kept graded in accordance with surrounding grades, and planted with native beach grasses No existing trees, shrubbery, or natural plant life will be disturbed Policy 4. The proposed comfort station will be a pre-fabricated concrete building installed on a slab on grade, and will be designed in accordance with current local, state and federal building codes It is a non-habitable structure that will withstand most forces associated with flood waters, and the first floor elevation is proposed to be above the base flood elevation of 6 0 feet. The proposed building will be located further from the bulkhead (and tidal wetlands) than the prior structure was, and will be connected to the new sanitary system The prior comfort station had been connected to an aged on-site sanitary system, whereas the proposed comfort station will be connected to a new sanitary system, which is in full compliance with all current Suffolk County Department of Health water quality regulations, thereby minimizing adverse effects to water quality The proposed comfort station will feature modern plumbing and lighting fixtures, thereby reducing energy use and water consumption in comparison with the prior structure Furthermore, water pollution from stormwater runoff(i e non-point sources) will be minimized by the reduction in impervious surfaces 'Policy 6.
