Resolution Authorizing the Town Board to File an Application
for Permission of the State Comptroller to Establish a Beach
Erosion Control District known as the North Sea Beach
Colony Beach Erosion Control District
WHEREAS, by Resolution No. 1215 of 2017, the Town Board of the Town of Southampton
authorized the establishment of a beach erosion control district known as the North Sea
Beach Colony Beach Erosion Control District (the “District”); and
WHEREAS, pursuant to said resolution, the Town Board, by Town Law §94, submitted the
resolution directly to the electors within the District for their approval, removing the need
for the filing of any petitions; and
WHEREAS, a special election was held on Saturday, March 3, 2018, for property owners
within said District to vote upon said proposition; and
WHEREAS, by a vote of 65 to 14, the property owners approved the proposition, resolving
to establish a beach erosion control district at a cost of approximately $406,050.00, to fund
a beach nourishment project over the next five years; and
WHEREAS, pursuant to Town Law §209-f, where, as here, there is (i) a proposal to finance
the cost of said improvements through the issuance of bonds, and (ii) an average annual
estimated cost threshold has not been established for beach erosion control districts,
permission by the New York State Comptroller is necessary; and
WHEREAS, the Town Board seeks to apply for said Comptroller approval; now therefore be
it
RESOLVED, that the Town Attorney’s Office, together with the Comptroller’s Office and the
Assessor’s Office, is hereby authorized and directed to prepare and file a Part 85 Application
for approval from the State Comptroller to establish a beach erosion control district known
as the North Sea Beach Colony Beach Erosion Control District; and be it further
RESOLVED, that the Town Board has reviewed said application and believes the contents of
said application to be accurate; and be it further
RESOLVED, that the Town Board has determined that the establishment of the District is in
the public interest and will not constitute an undue burden on the property which will bear
the cost thereof; and be it further
RESOLVED, that all real property assessed pursuant to said increase will be benefited by the
proposed improvement, that is, beach nourishment, and no benefited property has been
excluded; and be it further
RESOLVED, that the Town Board hereby authorizes the Supervisor to execute any and all
documents necessary in furtherance of said application.
