The public hearing on this matter was held on November 18, 1982, at which
time the hearing was declared closed pending deliberations.
Upon application of LEANDER B. GLOVER, JR., Cox's Lane, Cutchogue, NY
for a Variance to the Zoning Ordinance, Article IX, Section 100-93 for
permission to set off property leaving a parcel with insufficient area and
width in this C-1 Zoned District. Location of Property: Cox's Lane,
Cutchogue, NY; County Tax Map Parcels No. 1000-083-03-04 and 004.001.
The board made the following findings and determination:
By this appeal, appellant seeks permission to set off a 18.893-acre
parcel to be conveyed to the Town of Southold, leaving a 2.417-acre parcel
with a frontage along Cox's Lane of 150.44 feet. The premises in question
is zoned "C-1 General Industrial.
Upon inspecting the vicinity of the parcel in question, the board
finds that a majority of the parcels in this C-1 District are less than
the required area and road frontage of the recent provisions of the
zoning code. Also, it is the understanding of the board that the Town
has agreed only to purchase 18.893 acres from Mr. Glover having 75 feet
along Cox's Lane, and does not intend to purchase the remaining 2.417
acres. Under the circumstances, the board is in agreement with the
applicants.
In considering this appeal, the board determines that the variance
request is not substantial; that the circumstances are unique; that by
allowing the variance no substantial detriment to adjoining properties
will be created; that the difficulty cannot be obviated by a method feasible to"
appellant other thana variance; that therelief requested willbeinharmony
with and promote the general purposes of zoning; and in view o~ the
manner in which the difficulty arose and in consideration of all the
above factors, the interest of justice will be served by allowing the
variance.

is requested forthe reason thatPetitioner is under contract to sell an 18.893
acre parcel zoned "C-l" General Industrial District to the Town of
Southold. Due to the configuration of the property being sold, your
Petitioner will be left with a parcel frontin? on Cox's Lane having
150,44 feet in width and an area of 2.417 acres which will require
an area variance.

REASON FOR APPEAL
Continued
1. STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties or unneces-
sary HARDSHIP because your Petitioner is under contract to sell to the Town of Southold
an irregularly shaped Parcel containing 18,893 acres on the westerly side of Cox's Lane,
Cutchogue, New York, to the Town of Southold. The Town intends to acquire this parcel
so it will have room to expand its adjacent land-fill site. The contract of sale is
contingent upon Petitioner obtaining an area variance from the Southold Town Board of
Appeals because your Petitioner will be left with a parcel of land containing an area
of 2.&17 acres with a width of 150.44 feet fronting on Cox's Lane. The prem/ses are in
a "C-1 General Zndustrinl District" which requires 200,000 square feet of area together
with a lot width of 300 feet. Attached hereto as Exhibit A is a survey depicting the
acreage to be sold to the 'Town of Southold and the 2.417 acre parcel remaining.
As seen on Exhibit A at this location your Petitioner presently haa road frontage on
Cox's Lane of 225.44 feet, and the Town of Southold desires to acquire a 75 foot strip
of this frontage so it will have suitable access to the land-fill premises in the rear.
The point being it will leave your Petitioner with a 150.44 foot ~lde parcel for a
depth of 500 feet. As stated previously the present zoning requirements for this indus-
trial zoned property are 200,000 square feet of area and 300 feet of lot width; the
request for this variance is not substantial when considering the over-all size of the
remaining parcel of 105,284.52 square feet and 150.44 feet of lot width, in relation to
the other parcels of co~ercially zoned property on the westerly side of Cox's Lane.
As seen from the portion of the Suffolk County Tax Map attached hereto as Exhibit B

2. The hardship created is UNIQUE and is not shared by all properties alike in the immediate
vicinity of this property and in this use district because one of the main reasous for t~e Town of
Southold acquiring your Petitioner's property ia to expand its exiatin$ land-fill area.
Portions of your Petitioner's property bain8 acquired by the Town already contain an
active sandpit. It is your Petitioner's understanding the Town :f Southold does not
want to acquire any additional acreage ae it is not needed thereby leavens your
with an undersized, wooded parcel requiring this variance.
3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE
CHARACTER OF THE DISTRICT because all of Patitioner's property in this neighborhood
is zoned "C-1 General Industrial District" and the property in question will still be
zoned and used as one industrial lot according to the use requirements of the zoning
ordinance. The granting of the variance to have the Petitioner retain an undersized
parcel will be in conformance with the majority of the existing industrial zoned parcels
on thewesterly side of Cox's Lane and will be in keeping with the limited overall de-
velopment that has taken place in this area.

Dear Mr. Pell:
Pursuant to our letter of October 14, 1982 regarding the above referenced
subject, we wish to express, in good faith, additional comments relative to the
landfill.
The proposal of your committees to purchase additional property for the
landfill was confusing to us at first since the State D.E.C. had targeted 1984 as
a deadline for ending open pit dumping. However, we trusted that your good judgement
and concern did motivate that proposal, which prompted us not to oppose or question
the idea. Unfortunately, we should ~v~ questioned it in more detail.
When we entered into contracts to purchase property or homes on
Mathews Lane, we certainly knew that the landfill existed; however, we were assured,
advised and made aware of the State and Town efforts to eliminate open dumping, close
landfill areas and protect the environment, thereby protecting us. With this
knowledge, all of us have purchased, made substantial improvements to our homes and
property and are proud of it. Proud because we have taken a sparsely populated
residential area and developed it into a subdivision that rivals many in the Town.
Our hopes of increased development and property values will prove fruitless
because of your proposal that includes a general entrance to the landfill off
Cox Lane. The landfill traffic combined with the normal traffic on Cox Lane will
create a hazzard at the intersection of Route 48.
We've heard "The landfill would be socially unacceptable or unsuitable
in other areas of Southold." If it is unacceptable in other areas, it certainly
is in ours also!
The safety and well-being of all Southold residents including 13 children
in.the immediate vicinity should be of the uppermost importance in your decisions
for the present and future planning.
We urge you to reconsider your proposals on behalf of all of us who have
worked so hard to build and maintain our homes and property consistant with the
values and traditions of the Town of Southold.

Reference: Land Fill Expansion - Route 48, Cutchogue
Dear Mr. Raynor:
On October 8, 1982 I visited the Town Hall to acquire
information related to the expansion of the land fill and
discussed my findings with other neighbors on Mathews Lane,
Cox's Lane in Cutchogue.
On their behalf, I am directing this letter to you, as
Chairman of and the other Planning Board Members for serious
consideration of our following comments and recommendations
during your next and future meetings on the subject.
a) Of the total area you authorized purchase of
and bond issue for, included therein to the south
of property owned by J. Muratore is an area of
wooded land approximately 200 ft. (on Cox Lane)
by 600 ft., currently fully wooded, with a dirt
road for small vehicles.
Our long range belief is that the Planning Board
might consider the area for future use as access
or egree for the land fill site.
We recommend, for public safety, fire protection,
asthetic value and our privacy that this area be
maintained as wooded with the dirt road kept only
for emergency vehicle access and egress to the
land fill site and that the main entrance and
egress be as currently situated from Route 48.
b) Concerning the entire land fill site, we recommend.
the maximum treed areas be maintained and additional
onsite planting of trees and shrubs be included in
the planning as a buffer, noise abatement, and visual
asthetic improvement and to reduce the paper - plastic
"blowout and scatter" experienced which involves
~considerable time and personnel to clean up.

We also respectfully request that no further land
fill expansion beyond the present boundaries be
made which would affect or cause aquisition of all
or part of the present and future properties fronting
on Cox's Lane.
We believe the above recommendations are basic and can be
readily incorporated in the Land Fill Expansion Program. I
trust the Planning Board will review our recommendation and
keep us advised and perhaps call on us for questions and
assistance.

is requested for the reason that Petitioner is under contract to sell an 18.893
acre parcel zoned "C-l" General Industrial District to the Town of
Southold. Due to the configuration of the property being sold, your
Petitioner will be left with a parcel fronting on Cox's Lane having
150.44 feet in width and an area of 2.417 acres ~¢hich will require
an area variance.

REASON FOR APPEAL Continued
1. STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties or unneces-
sary HARDSHIP because your Petitioner is under contract to sell to the Town of Southold
an irregularly shaped parcel containing 18.893 acres on the westerly side of Cox's Lane,
Cutcbogue, New York, to the Town of Southold. The Town intends to acquire this parcel
so it will have room to expand its adjacent land-fill site. The contract of sale is
contingent upon Petitioner obtaining an area variance from the Southold Town Board of
Appeals because your Petitioner will be left with a parcel of land containing an area
of 2.417 acres with a width of 150.44 feet fronting on Cox's Lane. The premises are in
a "C-1 General Industrial District" which requires 200,000 square feet of area together
with a lot width of 300 feet. Attached hereto as Exhibit A is a survey depicting the
acreage to be sold to the Town of Southold and the 2.417 acre parcel remaining.
As seen on Exhibit A at this location your Petitioner presently has road frontage on
Cox's Lane of 225.44 feet, and the Town of Southold desires to acquire a 75 foot strip
of this frontage so it will have suitable access to the land-fill premises in the rear.
The point being it will leave your Petitioner with a 150.44 foot wide parcel for a
depth of 500 feet. As stated previously the present zoning requirements for this indus-
trial zoned property are 200,000 square feet of area and 300 feet of lot width; the
request for this variance is not substantial when considering the over-all size of the
remaining parcel of 105,284.52 square feet and 150.44 feet of lot width, in relation to
the other parcels of commercially zoned property on the westerly side of Cox's Lane.
As seen from the portion of the Suffolk County Tax Map attached hereto as Exhibit B
(continued on Rider attached hereto under #1)
2 The hardship created is UNIQUE and is not shared by oil properties alike in the immediate
vicmr~y of this property and in this use district because one of the main reasons for the Town of
Southold acquiring your Petitioner's property is to expand its existing land-fill area.
Portions of your Petitioner's property being acquired by the Town already contain an
active sandpit. It is your Petitioner's understanding the Town of Southold does not
want to acquire any additional acreage as it is not needed thereby leaving your Petitioner
with an undersized, wooded parcel requiring this variance.
3 The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE
CtlARACTER OF THE DISTRICT because all of Petitioner's property in this neighborhood
is zoned "C-1 General Industrial District" and the property in question will still be
zoned and used as one industrial lot according to the use requirements of the zoning
ordinance. The granting of the variance to have the Petitioner retain an undersized
parcel will be in conformance with the majority of the existing industrial zoned parcels
on the westerly side of Cox's Lane and will be in keeping with the limited overall de-
velopment that has taken place in this area.

the parcel immediately adjacent to Petitioner's parcel in question on the north
is owned by Joseph Muratore and contains approximately 87,120 squre feet of
area with 180 feet of lot width. Other property bordering your Petitioner's
on Cox's Lane is owned by Glenn F. Heidtmann & Sons, Inc. and contains 91,476
square feet of area with road frontage of 150 feet. The parcel owned by
Eastern Suffolk Co-Operative, Inc. contains 130,680 square feet and has road
frontage of approximately 415 feet; the land owned by W. H. Grefe contains
only 43,560 square feet with 92 feet of road frontage. The point being is all
of the neighboring parcels on the westerly side of Cox's Lane with the excep-
tion of the six acre parcel owned by Francis J. McBride are undersized
according to the present zoning standards. The granting of this variance will
have no increase of population density in that the Town of Southold is
acquiring the property from your Petitioner to expand the land-fill area, and
there will be still only one industrial zoned lot at this location on Cox's
Lane. Since the Town is acquiring only 75 feet nothing other than a roadway
could be constructed so the practical effect would still be to have a lot
width of 225.44 feet. Furthermore, the retained 2.417 acre parcel will have
no change in the industrially zoned character of this particular neighborhood.
Practical difficulties encountered by your Petitioner could only be obviated
if the Town would condemn the land it is desirous of acquiring rather than
purchase by an outright sale. Considering the character and location of the
property, substantial justice would be served by granting the variance.
