FINDINGS,DELIBERATIONS AND DETERMINATION AR, 2 1201 , MEETING OF MARCH 15,2018 ��/ ZBA FILE: #7141 Southold Town Clerk NAME OF APPLICANT: Joanna Dixon Reisman PROPERTY LOCATION: 2360 North Sea Drive, Southold,NY 11971 SCTM No: 1000-54-5-1 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated December 1, 2017 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated February 16, 2018. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to us, it is our recommendation that the proposed action is EXEMPT from Coastal Consistency Review. PROPERTY FACTS/DESCRIPTION: The subject .57 acre, 24,823 square feet parcel, located in the R40 Zoning District measures 129.92 feet along North Sea Drive then turns south and runs 184.10 feet along a residential neighbor to the west then runs 144.12 feet through freshwater wetlands along a second residential neighbor to the south before returning 79.72 feet along undeveloped land to the east belonging to the Town of Southold and continuing north 98.88 feet along the junction of Horton's Lane with North Sea Drive. The site is developed with a 1-story wood frame house on pilings with ground level garage, covered front porch and access stairs and a raised wood deck and stairs on rear of the residence as shown on the survey prepared by Nathan Taft Corwin, III Land Surveyor dated October 4, 1999 with several revisions, most recent being June 1, 2017. BASIS OF APPLICATION: Request for a Variance from Article XXIII, Section 280-124 and the Building Inspector's November 22, 2017, Notice of Disapproval based on an application for a building permit to construct additions and alterations to an existing single family dwelling; at; 1) less than the code required minimum front yard setback of 40 feet; located at: 2360 North Sea Drive, Southold NY. SCTM#1000 54-5-1. RELIEF REQUESTED: The applicant requests a variance to construct a 24 feet by 20 feet raised deck with partial roofing measuring 24 feet by 16.6 feet on the east side of the residence on a partial, second front-yard with a setback of 17 feet where the Code requires such structures to be built with a front-yard setback of 40 feet. Page 2,March 15,2018 #7141,Reisman SCTM No. 1000-54-5-1 ADDITIONAL INFORMATION: An adjacent neighbor emailed comment supporting this application. No other member of the public or immediate neighbor spoke for or against this application. The subject property is adjacent to Town owned lands and is diagonally opposite a Town Park with access to the Long Island Sound offering pubic parking and bathroom facilities. The meeting point of North Sea Drive and Horton's Lane on the east side of the subject parcel creates a second front yard for the applicant, although this "road" is unopened, unused, and not visible. Furthermore, the subject property is encumbered by wetlands to the south and is an area that is covenanted for non-disturbance. Including proposed additions along with an exterior hot tub, the total lot coverage is approximately 12.7%. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on March 1, 2018 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law &267-b(3)(b)(U Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. North Sea Drive, Horton's Lane and the general McCabe's Beach area is a waterside residential neighborhood almost completely developed featuring luxury beachfront residences and upland homes taking advantage of the dunal landscape and water access or water views. The area is developed with a variety of housing styles, sizes and amenities and many homes enjoy outdoor living spaces both at grade and raised. A covered raised deck is a common amenity in this neighborhood whether it is on the front, either or both sides or rear. The proposed application for all practical purposes illustrates the deck addition on the east side of the residence in a conforming side-yard location. However, as a result of a dog-leg turn at the junction of two public roads, a second partial front yard is created, prompting the need for a variance. The distance from the paved road at Horton's Lane to the proposed addition is approximately 70 feet. Since the immediate lands are Town owned and in a natural, wooded state, the impact of the granted application will have no detrimental effect on the immediate neighborhood, community or Town at large. 2. Town Law 4267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The site offers limited development opportunities as a result of Town Trustee and Department of Environmental Conservation flagged freshwater wetlands, on the southside of the lot,which are covenanted to remain in a natural and undisturbed state. Furthermore, driveway and garage access on the westside further limits the relocation of the requested improvements, leaving only the eastside available for expansion. The proposed residential addition conforms to the Town Code with regard to side-yard setback and if not for the `dog-leg' in the road,no variance would be required. 3. Town Law §267-b(3)(b)(3). The variance granted herein is mathematically substantial, representing 57.5% relief from the code. However, given the constraints on the site, this is the only feasible location for the proposed raised deck. Moreover, although the adjacency of undevelopable Town owned land and the dog-leg bend at the junction of two roads on the east side of the subject property, technically creates a second front yard along an undeveloped"paper road,"the proposed raised deck addition appears to be in a conforming side yard. 4. Town Law §267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law X267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a partially covered, raised deck with stairs while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Planamento, seconded by Member Goehringer, and duly carried,to GRANT the variance as applied for, and shown on the survey prepared by Nathan Taft Corwin, III, Land Surveyor, dated June 1, 2017, and the site plan prepared by Mullman Seidman Architects, dated September 21, 2016. SUBEJCT TO THE FOLLOWING CONDITION: 1. The covered deck is to remain open-air, unscreened and unenclosed. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s)granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured, and/or a subdivision map has not been filed with the Suffolk County Clerk,within three (3)years from the date such variance was granted. The Board of Appeals may, upon written request prior to the date of expiration, grant an extension not to exceed three (3) consecutive one (1) year terms. Although deemed to require front yard setback relief, the raised deck addition is actually pr(posed in the effective side yard of the property on the north side of the dwelling, greater than thelicode- required 40 feet from North Sea Drive to the west and greater than what would otherwiselbe the required 15' minimum side yard setback from the northerly property line. But due to the,presence of an unopened "paper" dogleg turn in Horton's Lane that adjoins little more than half of the northerly property line, it has been determined that the northerly lot line creates a second front yard for the property, thus necessitating 23 feet of relief for the deck's proposed 17' setback. However, the granting of this relief would do nothing to create an undesirable change in thecharacter,Iof the I neighborhood, as the adjoining unopened north-south dogleg of Horton's Lane, which is oriented perpendicular to Long Island Sound, is unimproved and heavily vegetated and therefore,d;es;not provide a thruway for vehicular or pedestrian traffic or possess any other visual or functional characteristics of a front yard. Rather, the west-east legs of Horton's Lane (farther to the;north) and North Sea Drive to the south act as the functioning front yards for the subject and neighboring properties along this stretch of roadway. Therefore, the deck would for all practical and fund. ional purposes appear to be located in the side yard. The only other corner property located'ori JNorth Sea Drive, which is similarly constrained by a second front yard created by Kenny's Road, was granted similar front yard setback relief in 1984 (Case No. 3204) when a variance was granted for the construction of an addition with a 16' setback from Kenny's Road. ' • I Granting of the requested variance would also cause no detriment to the neighboring property to the north because the unopened leg of Horton's Lane that separates the two properties is yin fact heavily vegetated and indistinguishable from the heavily vegetated and unimproved propertyi;to the north, which was purchased for preservation by the Town of Southold in May 2017. Thus,;unles§ the land purchased for preservation were to be cleared along its southerly boundary, the;,'entire dwelling and proposed deck should remain obscured from the viewshed of that propertyJ And even in the unlikely event that the property were cleared and the small section of road improved, j the side of the house and proposed deck would not directly face the side of the preserve Ian 'Le to the location and configuration of the roadway relative to the location of the dwelling. The benefit sought by the applicant, which is to gain additional deck area for recreational use'and to cover part of the deck for shade and use during foul weather, cannot be achieved without the benefit of area variance. Specifically, due to the presence of the freshwater wetlands associated with Lily Pond in the easterly portion of the property and the adjacent naturally vegetated,non- disturbance buffers imposed by the Board of Trustees and New York State Department of Environmental Conservation, there is not enough room to expand the deck on the rear side,of the house. Thus, due to the location of the driveway on the south side of the house, the north side of the house is the only practicable location for the deck expansion. And though the proposed deck would otherwise meet the required minimum 15' side yard setback for the principal dwelling structure, the presence of the unopened dogleg of Horton's Lane that adjoins the northerly property line creates a"second front yard,"thus making the requested setback relief unavoidable. 3. The approximately 58% setback relief required for the deck's proposed 17' setback �from; the northerly property line is mathematically substantial but it is not substantial relative to the.actual site conditions, as described above. Specifically, because 1) the west-east legs of North Sea Drive to the south and Horton's Lane to the north act as the functioning front yards for the subj'ecti and neighboring properties along this stretch of roadway; and 2) the dogleg of Horton's L'an& that creates the second front yard setback requirement is actually unopened and heavily vegetated, the deck would for all practical and functional purposes appear to be located in a conforming'side�,y d location. The requested relief is also nearly identical to that granted in 1984 to the only'oth;r corner property located along North Sea Drive. I 4. In order to maintain and protect the integrity and function of the existing wetland and:natuially occurring wetland buffer vegetation on the property, the proposed deck addition is to be located beyond the limit of the existing 65' wide, NYSDEC-required, naturally vegetated wetlan&non-* disturbance buffer situated adjacent to the freshwater wetlands associated with Lily Pond, to, the east. Thus, where proposed, the deck addition will require no clearing or disturbance of xisting natural vegetation and will be located farther from wetlands (73') than the existing deck (71�'), so there will be no additional encroachment on the existing wetlands setback. Although,thel deck expansion would add only 460 sf of lot coverage to the property, which would remain just, over, half the code-permitted 20 percent at 12.7 percent, a drywell is proposed to capture and recharge potential runoff associated with the proposed 375 sf roofed over portion of deck. And a temporary project limiting siltation fence will be installed along the landward limit of the non-disturbance buffer to ensure that the naturally existing buffer and wetland areas are in no way disturbed during construction. Therefore, the project will not have any adverse effects on the surrounding pliysical and environmental conditions or surrounding natural resources and ecosystems. � I Ro ert E. Herrmann !
