SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 thru A 14-25, and the Suffolk County Department of Planning issued its reply dated December 1, 2017 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The property located at 145 Dickinson Street, Peconic, is 10,349 square feet in total area with a single family one story dwelling, an attached garage with wood decking attached to the rear and side of the dwelling. The westerly line of the property measures 95.38 feet, the northerly line measures 115 feet, the easterly line along Dickinson Street measures 95.38 feet and the southerly lines measures 115 feet as shown on the survey submitted by John Minto, L.S., dated July 6, 2017. BASIS OF APPLICATION: Request for variance under Section 280-124 and the Building Inspector's November 8, 2017, Notice of Disapproval based on an application for a building permit to legalize an "as built" deck addition attached to a pre-existing single-family dwelling: at 1) less than the code required minimum front yard setback of 35 feet; 2) less than the code required minimum side yard setback of 10 feet; located at: 145 Dickinson Street, Peconic,NY. SCTM No. 1000-67-3-11. RELIEF REQUESTED: The applicant requests variances to legalize an "as built" deck addition to a pre-existing single-family dwelling with a front yard setback of 7.6 feet where the code requires a minimum of 35 feet, and a side yard setback of 1.7 feet where the code requires a minimum of 10 feet, as shown on the survey prepared by John Minto, L.S. dated July 6, 2017. ADDITIONAL INFORMATION: During the public hearing the applicant's agent submitted a list of four comparable properties with copies of prior ZBA decisions, two of which received relief for non-conforming front yard setbacks. The Board asked the applicant's agent to submit a pre-certificate of occupancy for the subject Page 2,March 15,2018 #7136, Seven Cats Investments SCTM No. 1000-67-3-11 dwelling which she provided to the ZBA office that day. The pre-CO detailed a building violation indicating that the "as-built" deck addition was constructed without a building permit. Accordingly, pursuant to procedures the applicant will be required to apply for a building permit and Certificate of Occupancy for the "as-built" deck, if approved by this Board. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on March 1, 2018 at which time written and oral evidence were presented. Based upon all testimony, documentation,personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 4267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. Dickerson Street(AKA Dickinson Street) is a small, single lane dirt road that provides access to the subject dwelling and to 5 other neighboring homes that also have pre- existing nonconforming setbacks. The original subdivision was created in the 1930's as Peconic Shores and contained seasonal cottages, including the subject dwelling, all sited at various angles that do not parallel the private dirt road or each other, creating the appearance of a"compound." The community is not visible to a public street and is located in a very private wooded area with sloping terrain. 2. Town Law X267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The rear of the subject property drops down to a drainage area which appears to be a stream. As a result,the applicant has little to no useable outdoor recreational area in the rear yard, without the as built attached raised deck, which provides different levels that follow the topography. However, the applicant cannot legalize and therefore retain the as built deck addition and obtain a certificate of occupancy without variance relief. 3. Town Law §267-b(3)(b)(3). The variances granted herein are mathematically substantial, representing 83%% relief from the code for the side yard setback and 78% relief from the code for the front yard setback. However, the dwelling was constructed prior to zoning with no required setbacks from property lines. The deck is attached to the subject dwelling and cannot meet conforming setbacks. Moreover, it is difficult to determine where the property lines are due to the nature of the dirt road that, in places, appears to be merely a narrow path, and the irregular layout of the dwellings on the six original subdivision lots. 4. Town Law X267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The dwelling was built as a summer cottage in a summer community with similar size homes and properties, and has since been expanded having only one bedroom. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law §267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. The owner did not pursue a building permit prior to the deck addition. 6. Town Law &267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a pre-existing "as built" deck while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. Page 3,March 15,2018 #7136, Seven Cats Investments SCTM No. 1000-67-3-11 RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Acampora, seconded by Member Dantes, and duly carried, GRANT the variance as applied for, and shown on the survey prepared by John Minto, L.S., dated July 6, 2017. SUBJECT TO THE FOLLOWING CONDITION: 1. The deck shall remain open to the sky. That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured, and/or a subdivision map has not been filed with the Suffolk County Clerk,within three (3) years from the date such variance was granted. The Board of Appeals may, upon written request prior to the date of expiration, grant an extension not to exceed three (3) consecutive one (1)year terms. I RECEIVED NOV 15 2017 Name of Owner: Seven Cats Investments,LLC ZBA File# 'QNING BOARD OF APPEALS REASONS FOR APPEAL(additional sheets may be used with preparer's signature): AREA VARIANCE REASONS: (1) An undesirable change will not be produced in the CHARACTER of the neighborhood or a detriment to nearby properties if granted, because: The subject house pre-dates zoning (pre-co pending) and an addition was constructed in 1960 (CO #Z836 issued). The house was constructed on Lot 59 and 60 of Peconic Shores, Filed September 15, 1930 as File No 654. The house was originally a summer cottage,then in 1960 the addition was connected to the pre-existing structure. The rear of the property drops off and a deck is needed due' to the existing topography. The deck was added 20 years ago. It was recently repaired prior to sale. Dickinson Street are small private dirt roads, the homes on Dickinson Street are primarily located at pre-existing nonconforming setbacks. The deck is in the rear of the existing house, however, because it is within the 35 foot setback it is in the "front yard". This variance makes no sense since the area "behind the house" is the rear yard, regardless of the dimensional location. A deck is necessary since the land drops down to the drainage area "stream",also on the north- west side(Lot 58)is also below the grade of the house and the adjacent property is undeveloped. The existing deck is well designed and provides different levels which follow the topography. (2) The benefit sought by the applicant CANNOT be achieved by some method feasible for the applicant to pursue,other than an area variance,because: The back of the house would walk out to a slope. The house only has one bedroom and the living area opens to the deck. Without the deck the rear yard would be unusable. The rear yard is bisected by the drainage swale which is shown as a "stream" on the survey. This swale collects the seasonal storm water and overflow of Autumn Lake. The rear yard is across the stream and on top of the hill. There is no practical rear yard other than the existing deck. (3) The amount of relief requested is not substantial because: The existing house was placed on Lot 59 which was only 50 feet in width. There were no side yard setbacks applicable when the house was constructed. The addition was constructed on the east side of the existing house. Later,when zoning was adopted the setback would have been 3'. The adjacent parcel (Lot 60) was merged doubling the size of the property, however, the house and deck remain all on Lot 59. The closest point of the deck is a landing and steps. The property slopes upwards to the rear of the house. .(4) The variance will NOT have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district because: The deck will have no impact on the physical or environmental conditions in the neighborhood or district. The old homes and topography in. Peconic Shores are all unique and require retrofitting to the surrounding topography. The property lines are impossible to determine visually. At the public hearing, the applicant's agent submitted a letter dated May 8, 2012 from Suffolk County Department of Health Services, Office of Wastewater Management stating that the applicant's proposed lot merger does not require an application to their department.A second letter from the NYS Department of Environmental Conservation dated March 9, 2011 stating that they conducted a site inspection of the subject property and confirmed that the applicant's as built decks and shed are within the adjacent area to a NYS regulated freshwater wetland, and that they were constructed without obtaining permits from their agency. However,they will not pursue these violations and all structures can remain in place. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on December 5,2013 at which time written and oral evidence were presented. Based upon all testimony,documentation,personal inspection of the property and surrounding neighborhood,and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 42674(3)(b)(1). Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The granting of the variance for insufficient lot size, upon merging the subject parcels, will have no effect on the character of the neighborhood. The parcels will simply be combined where they are now separate. The granting of a variance for the insufficient rear yard setback of the as- built deck would not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The subject as-built deck is at the first floor, open to the sky,and is purported to have been there since prior to 1988 without evidence of negative impact to the surrounding properties. The granting of a variance for maintaining the as-built shed in a front yard will not produce an undesirable change to the character of the neighborhood. The subject as-built shed appears in the architectural side and rear yard of the improved parcel and does not present a visual obstruction to the unimproved(not open)Third Avenue paper road or nearby properties: 2. Town Law 42674(3)(b„)(2).The benefit sought by the applicant for an insufficient lot size variance cannot be achieved by some method, feasible for the applicant to pursue,other than an area variance.The two subject parcels exist with their fixed areas which, when merged, cannot be increased to 40,000 square feet. The benefit sought by the applicant for an insufficient rear yard setback to the as-built deck cannot be achieved by some method feasible for the applicant to pursue, other than an area variance. The entire as-built deck exists in a non-conforming rear yard location and services the dwelling with ingress and egress in two locations.To remove the as-built deck would not be feasible.The benefit sought by the applicant to maintain the as-built shed in a front yard can be achieved by some method, feasible for the applicant to pursue, other than an area variance. The applicant can relocate the as- built shed to a more conforming location upon the execution of the proposed merger. 3. Town Law &267-b(3)(b)(3). The variance granted herein for insufficient area, upon the merger of the subject parcels, is mathematically substantial, representing 24% relief'from the code. However, the variance relief will permit the creation of a more code conforming parcel with respect to area. The variance granted herein for a rear yard setback to the as-built deck, is mathematically substantial, representing 80% relief from the code. However, the subject rear yard is created by an unimproved(not open)paper road which terminates along the same bearings as the southerly property line of the Tax lot#10. Town Law L§267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law 4267-b(3)(b)(5). The difficulty has not been self-created with respect to the requested variance for lot area relief. The subject parcels exist with their respective areas and their merger does not meet the code requirement of a minimum of 40,000 square feet. With respect to the request for a rear yard setback to the as-built deck and locating an as-built shed in a front yard, the applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law 4267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefits of: 1)merging of two adjoining parcels at less than the required 40,000 square feet, 2)maintaining an as-built deck at a 10 foot rear yard setback with respect to Third Avenue and 3) maintaining an as-built shed in a front yard, with respect to Third Avenue, while preserving and protecting the character of the neighborhood and the health,safety and welfare of the community. (owner) Box 361, Peconic, NY 11958 At a Meeting of the Zoning Board of Appeals held on February 4, 1983 the above appeal was considered, and the action indicated below was taken on your [ ] Request for Variance Due to Lack of Access to Property New York Town Law, Section 280-a [ ] Request for Special Exception under the Zoning Ordinance Article , Section [X] Request for Variance to the, Zoning Ordinance Article III , Section 100-31 [ ] Request for The public hearing in this matter was also held on February 4, 1983. Upon application of RONALD J. ROTHMAN, Box 878, Southold, NY (Owner: V. L'Epplatenier) for a Variance to the Zoning Ordinance, Article III, Section 100-31 for permission to construct new dwelling with insufficient front (and/or rear) yard setbacks at Lakeview Avenue, Peconic, NY; Peconic Shores Section II, Subdivision Lots 52-56 incl.; County Tax Map Parcel ID Nos. 1000-67-03-002, 003 and 013. The board made the following findings and determination: By this appeal, appellant seeks permission to locate a proposed one-family dwelling on a parcel of land containing an area of approxi- mately 34,750 square feet and comprising Subdivision Lots 52, 53, 54, 55 and 56 of "Map No. 2 of Peconic Shores, Map No. 654 as filed in the Suffolk County Clerk's Office." The proposed dwelling is to be located at the southeasterly end of the subject premises with a ` ' I setback from both Lake View Avenues of 15fpgt The appellant has lY_ indicated that the rear yard setback from Autumn Lake will be a minimum of 50 feet as required by the zoning code. Survey amended September 1, 1981 for Victor L'Eplattenier, Jr. by Roderick VanTuyl, P.C. indicates that the parcel in question has a higher elevation at this proposed location in comparison with the remainder of the lot, between 10' and 5' . It is noted-for the record that this property is located in the Flood Zone A-8 which requires a minimum elevation above mean sea level of the lowest floor at or above 111 . The board agrees with the reasoning of the applicant and find that this area is the most feasible and practical building area. In considering this appeal, the board determines that the variance request is not substantial in relation to the requirements of the zoning code; that the circumstances are unique; that by allowing the variance no substantial detriment to adjoining properties will be created; that the difficulty cannot be obviated by a method feasible for appellant other than a variance; that the relief requested will be in harmony with and promote the general purposes of zoning; and in view of the manner in which the difficulty arose and in consideration of all the above factors, the interest of justice will be served by allowing the variance as indicated below.
