SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was not required to be referred to the Suffolk County Department of Planning under Administrative Code Sections A14-14 to 23. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The subject parcel is non-conforming .65 acre, 28,417 square feet residentially developed lot located in the R-40 Zoning District. The rectangular lot measures 215.87 feet along Youngs Street (Beach Way) with a northern lot line measuring 150 feet shared with a neighboring residence, then running 95 feet on the eastern end of the lot, adjacent to a second neighbor to a southern lot line of 151.96 feet along an unimproved dirt and gravel road accessing three other residences. The partially fenced parcel is developed with a one and a half story wood-frame residence with covered porch, rear wood deck, a 15.8 feet by 29.8 feet in-ground swimming pool and stone patio, frame shed, mechanicals and a one and a half story frame accessory building (formerly a garage) with attached wood frame arbor as shown on the survey prepared by John Metzger, Licensed Land Surveyor, dated August 3, 2017. BASIS OF APPLICATION: Request for a Variance from Article III Section 280-13C(2)(b) and the Building Inspector's August 21, 2017 Notice of Disapproval based on an application for building permit to convert an "as built" second dwelling unit in a pre-existing accessory garage into an accessory pool house with an "as built" second floor home office, at: 1) a home office in an accessory building is not permitted, located at: 1100 Youngs Road, Orient,NY. SCTM#1000-18-2-11.1. RELIEF REQUESTED: The applicant requests a variance to convert the pre-existing two story accessory structure to an accessory pool house and to legally maintain an as built home office on the second floor. ADDITIONAL INFORMATION: The applicant's legal counsel spoke on behalf of the applicant. Also, present was the applicant's building contractor. Two letters of support were received prior to the public hearing, one from Page 2, March 15, 2018 #7121, DiSimone SCTM No. 1000-18-2-11.1 the prior owner of the house detailing their understanding of the history of the house and the second from a neighbor who offered a first-hand perspective on the structure's prior use. Two emails were also received questioning this application. At the hearing, no members of the public or immediate neighbors spoke in favor or against the application. The applicant's attorney offered a detailed history of the property and adjacent lots, including lot line changes resulting in the current size of the subject. She shared that at one point in time, the subject accessory garage structure was a separate summer residence consisting of heated living space including a kitchen and bath. In the past that use was abandoned and the applicant is now seeking the conversion of an accessory garage to a pool house with a finished home office on the second floor. When a Pre Certificate of Occupancy was issued September 25, 1980 for this building, the habitable space in the accessory structure was not included. The current owners possess an open permit to convert the garage structure to an accessory pool house. When asked why the applicant wants the loft area designated as a home office instead of allowable storage or a workshop, the applicant's attorney indicated that the use of a workshop would not legally allow office type activities, such as using a home computer in the space, and that the applicants wish to be in compliance to avoid any future issues. The applicant is required to remove the existing interior shower from the bathroom as part of their renovation of the structure in order to receive a Certificate of Occupancy on the first-floor pool house FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on January 18, 2018 at which time written and oral evidence were presented. Based upon all testimony, documentation,personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law X267-b(3)(b)(I). Grant of the variance will produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. Youngs Road is a narrow country lane servicing a Long Island Sound beach community consisting of small bungalows and larger, renovated homes on irregular-shaped and frequently non-conforming sized lots developed over the past century. The bucolic neighborhood is residential in nature offering housing for year-round and second home owners. Accessory pool houses are common in the hamlet of Orient and the immediate residential neighborhood. However, in the immediate vicinity, there are no home-based businesses or professional offices located within a primary residence or in an accessory structure. The proposed use of the subject accessory structure as a home office will alter the character of the neighborhood. 2. Town Law§267-b(3)(b)(2). The benefit sought by the applicant can be achieved by some method, feasible for the applicant to pursue, other than an area variance. The applicant can convert an area not to exceed 25% of the area of all floors of the principal dwelling into their home office, provided that such use shall not occupy more than 500 square feet of floor area. 3. Town Law 4267-b(3)(b)(3). The variance denied herein is mathematically substantial, representing 100% relief from the code. The conversion of the first floor of the subject accessory structure to a pool house is permitted as of right. However, the use of the second floor as a home office is not permitted because Town Code Section 280-13 (c) 2b allows the incidental home office use only within a primary residential structure and with no more than one nonresident assistant for whom off-street parking is provided on site. The as built second floor home office in the subject accessory structure was finished without the benefit of building permits and is a non-permitted use. Moreover, the Board heard no convincing argument that distinguished between the applicant's proposed office use in the subject accessory structure and the current code definition of a home office use that is only permitted in a principal dwelling. Town Law &267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law &267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law &267-b. Grant of the requested relief is not the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a home office while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-13, motion was offered by Member Planamento, seconded by Member Dantes, and duly carried,to DENY the variance as applied for, and shown on the survey prepared by John Metzger, LS and dated September 14;2017 and the'building plans/construction drawings labeled A-1, A-2, A-3, A-4,A-5,A-6, A-7, A-8 prepared by Digital Design and dated September 19, 2017. The accessory building contained a full bathroom, kitchen and heaters. The Habermann family lived in the accessory building(during the summer while they rented the main house. They sold the property in 1980 to Gardner family. The accessory building was used as a cottage/second dwelling containing plumbing,heating,cooking and a full bathroom(See letter from Jerie Newman who played in the building with the Habermann's daughter as a child). Mr.and Mrs.DiSimone purchased the property from Susan B. Gardner. The accessory building was renovated by Ms Gardner and the living space on the second floor was converted from a pre-existing nonconforming cottage to a home office(personal use). Mr.and Mrs.DiSimone constructed a swimming pool and the first floor of the accessory building is now a pool house but the second floor remains unchanged. The owners wish to obtain a CO for the pool house with the accessory home office on the upper floor(loft). The home office is used only for their personal use. A home office is a "customary accessory use", used by the owners of the property. In this case the existing home office space is located in the accessory building. (2) The benefit sought by the applicant CANNOT be achieved by some method feasible for the applicant to pursue,other than an area variance,because: The accessory building is pre-existing,the home office is existing and the applicants wish to close out their pool house permit with the second floor accessory office space. Mr.and Mrs.DiSimone use the office space regularly and it is a valuable improvement. When they purchased the property the home office space was existing. The space was described as""additional studio with sleeping loft". (3) The amount of relief requested is not substantial because:A home office is a customary accessory use. The Town code lists"work shop"as a customary accessory use in an accessory building. A home office is a quieter and more sedate use than a work shop. In 2017 a home office should be considered customary and accessory. The space is no longer a"sleeping loft"and the Board's approval of a"home-office"space would be recorded for future owners. (4) The variance will NOT have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district because: The building is existing and the improvements are existing. Orient,NY,this is what I know about the garage. When we bought the house in 1980,there was no certificate of occupancy as the house was built in 1929 before there was such a thing. At the time, there was a toilet and sink in the garage which went to a separate cesspool. There was also a separate entrance at the rear of the building and a stair to a finished loft with-lighting and electricity. There was a small kitchen and a kerosene heater. In fact, our neighbors told us that the original owners, The Habermanns, used to live in the garage in the summer while they rented out the main house. The lawyer for the seller, Rudy Bruer, got a certificate of occupancy in order for us to get a mortgage. We never thought at the time, to include toilet and sink in the garage as we were told they were grandfathered in. Over the years, we upgraded the electrical service and finishes and replaced the toilet and sink and tied them into the separate cesspool. We continued to use the upstairs loft as a home office. This pre-co does not identify the finished spaces in the garage and loft. The garage and loft merely identified a "kerosene stove chimney", therefore it was heated, it incorrectly missed the plumbing and electrical. Enclosed are two letters dated July 29, 2017. The first letter from Jerie Newman who has lived in Orient for the past 64 years attests to the fact that the garage and loft contained bathroom, kitchen and heaters. The Habermanns, who owned the property until 1980 used the space as a second dwelling. The second letter, from Susan B. Gradner who sold the property to my clients describes that in 1980 the garage and loft had a separate entrance, heat, electricity, a bathroom, small kitchen and a kerosene heater. The second floor space was converted by the prior owner to a legal customary accessory use, a home office. The owners do not wish to use the accessory building as a second dwelling, the owners are converting the existing first floor space to a "pool house" and the second floor loft remains as home office (as used by the Gardner Family). The owners will be filing a building permit for the pool house and home office to clean up the permits for the accessory structure. The existing sanitary system for the accessory structures will be updated with Health Department approval. Please issue the pre-CO for the second floor loft with heat, electric and plumbing in the accessory structure. As soon as the Health Department permit is in hand we will file the necessary permits. Orient,NY,this is what I know about the garage. When we bought the house in 1980,there was no certificate of occupancy as the house was built in 1929 before there was such a thing. At the time,there was a toilet and sink in the garage which went to a separate cesspool. There was also a separate entrance at the rear of the building and a stair to a finished loft with lighting and electricity. There was a small kitchen and a kerosene heater. In fact, our neighbors told us that the original owners, The Habermanns,used to live in the garage in the summer while they rented out the main house. The lawyer for the seller, Rudy Bruer, got a certificate of occupancy in order for us to get a mortgage. We never thought at the time,to include toilet and sink in the garage as we were told they were grandfathered in. Over the years,we upgraded the electrical service and finishes and replaced the toilet and sink and tied them into the separate cesspool. We continued to use the upstairs loft as a home office. (14,250 sq. ft.), and usual requirement is la0 ft. frontage. Farm zst (Continue on other side) REASON FOR APPEAL Continued 1. STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties or unneces- sary HARDSHIP because this is the lot on which the Sauls would like to build their home. They have three Sons, ages 179 15 and 10, who do not want to leave Orient, and the schools they are attending. They rent the house in which they are now living, and the landlord wants this house by next June. They have been unable to find a house to rent, or a suitable one to buy, and have therefore decided to build. They must start building in the immediate future, before the bad weather sets in and the ground becomes too hard. There is no adjacent property on either side that could be bought to aake up the 5 ft. 2. The hardship created is UNIQUE and is not shored by all properties alike in the immediate vicinity of this property and in this use district because the other properties have the 100 ft. frontage. 3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE ,CHARACTER OF THE DISTRICT because the house would be built in line with Lice other houses in the district and the lot is 150 ft. deep, the same as the other lots in this District. Based upon the file review and my opinion as a NY State licensed architect,the following are concerns with granting a variance: 0 The C of O dated January 121h 1998 is for a one family dwelling ,2 car garage no reference to kitchen,toilet or sink. 0 1 have lived next door for 16 years and the proposed variance structure was used as I a garage and storage area. 0 1 was unable to find any drawings that were filed for the addition of a toilet,sink, kitchen,heating nor any application to the Department of Health for new or expanded I cesspools. 0 The swimming pool filing was the only application on record. 0 The July 2EP stop work order noted the inconsistencies with construction to the garage. 0 If a variance is granted,this is new construction and the plans should be signed by a licensed professional who would take into account: occupant safety,the means of egress from the second floor,a 2nd means of egress and the existing stair width 0 1 hope these plans can also include DOH,environmental impacts(the sound is nearby),electrical, mechanical, hurricane proof windows&doors and material fire ratings information of the newly installed work. 0 Below is a recent Realtor.com photo showing the garage structure before the non- permitted renovation.
