Form ZBI (Continue on other side) REASON FOR APPEAL Continued ] STRICT APPLICATION OF' THE ORDINANCE would produce practical difficulties or unneces- sar',, HARDSHIP because applicant would have to reduce the number of lots to ob~nin sufficient width, resulting in several lots whida would be well in e~cess of the c~e acre requirement. ~e eight lots propcsed are already significantly larger ~n most of the other lots in the neighborhood, including those ira~diately adjoining the property. 2 Tl,e hardship created is UNIQUE and is not shared by all properties alike in the immediate ~,ic,nn~ of this property and in this use district because the frontage of the t~o lots is reduced due to the existence of parcels ~rned by other parties alc~g the road. ~pplicant has sufficient width at the rear of both parcels, but the properties owned by C~ovese and Seaman cut into the front yard area of the t~o lots. 3 The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE C!h~ACTER OF THE DIST. Dear Ms. Wickham: As a result of your inquiry received by this office on February 16, 1982, a map inspection was made to determine if the above parcel is subject to reg- ulation by this Department in accordance with Article 24 (Freshwater Wetlands) of the Environmental Conservation Law. It has been determined that the subject parcel is not under the regulatory jurisdiction of this Department because the parcel is located more than 100' of any regulated Freshwater Wetland.
