($0.00), does hereby grant and release unto the party of the second part, the heirs or successors and
assigns of the party of the second part forever;
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon
erected, situate, lying and being in the Nassau Point,Town of Southold, Suffolk County and State of New
York, more particularly described in Schedule A attached hereto.;
TOGETHER with all right,title and interest, if any, of the party of the first part in and to any
streets and roads abutting the above described premises to the center lines thereof,
TOGETHER with the appurtenances and all the estate and rights of the party of the first part in
and to said premises,
TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the
heirs or successors and assigns of the party of the second part forever.
AND the party of the first part, covenants that the party of the first part has not done or suffered
anything whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the parry of the first part, in compliance with Section 13 of the Lien Law, covenants that the
party of the first part will receive the consideration for this conveyance and will hold the right to receive
such consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement
and will apply the same first to the payment of the cost of the improvement before using any part of the
total of the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so
requires.

ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon
erected, situate, lying and being at Nassau Point, Town of Southold, Suffolk County and State of
New York, known and designated as Fishermen's Beach, Lot No. one (1) as shown on map
entitled, "Sub-division Map of Peconic Bay Properties, Inc.", surveyed February 6, 1931 by Cato
W. Van Tuyl, Surveyor and filed April 15, 1931 in the Suffolk County Clerk's office at
Riverhead New York, map number 786. Said lot being more particularly bounded and described
as follows:
BEGINNING at the corner formed by the intersection of the southerly side of Haywaters Road
with the westerly side of Landing Road; RUNNING thence along the westerly side of Landing
Road, south 14degrees 42 minutes 40 seconds West, 299.21 feet to Cutchogue Harbor;
RUNNING thence along Cutchogue Harbor, North 47degrees 07 minutes 20 seconds 'West,
70.84 feet to the division line between Lots I and 2 on the above-mentioned map; RUNNING
thence along said division line, North 14 degrees 27 minutes 30 seconds East, 252.00 feet to the
southerly side of Haywaters Road; RUNNING thence along the southerly side of Haywaters
Road, along the arc of a curve bearing to the left, whose chord is south 87 degrees 30 minutes
East 65.00 feet to the point or place of BEGINNING.
Being and intended to be the same premises conveyed to the grantor herein by deed dated
February 14, 1990 and recorded in the Offices of the Clerk of the County of Suffolk in Liber
