TOGETHER with all right, title and interest, if any, of the party of the first part in and to airy streets and
roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances,
and also all the estate which the said decedent had at the time of decedent's death in said premises, and also
the estate therein, which the party of the first part has or has power to convey or dispose of, whether individ-
ually, or by virtue of said will or otherwise; TO HAVE AND TO HOLD the premises herein granted unto
the party of the second part, the heirs or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been incumbered in any way whatever, except as aforesaid.
AND the party of the first part., in compliance with Section 13 of the Lien Law, covenants that the party of
the first part will receive the consideration for this conveyance and will hold the right to receive such consid-
eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply
the same first to the payment of the cost of the improvement before using any part of the total of the same for
any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.

ALL that certain plot, piece or parcel of land, with the
buildings and improvements thereon erected, situate at South Harbor,
near the Village of Southold, in the Town of Southold, County of
Suffolk and State of New York, bounded and described as follows:
BEGINNING at a point on the easterly line of South Harbor
Road at the southwesterly corner of land of Edward S. Klemm and
Mabel Y. Klemm, his wife, formerly of Fred Boergesson; thence run-
ning along the southerly line of land of Edward S. Klemm and wife,
formerly of Fred Boergesson, North 88 degrees 28 minutes 20 seconds
East 344. 70 feet to a monument and land of Baywater Realty Company;
thence running along land of Baywater Realty Company the following
four courses and distances: (1) South 3 degrees 05 minutes 40
seconds East 414.72 feet; (2) South 61 degrees 32 minutes 20 seconds
East 121.43 feet; (3) South 52 degrees 01 minute 00 seconds East
160 .00 feet to a stone and two stakes; (4) South 24 degrees 04 min-
utes 00 seconds West 150 . 05 feet to a stake and land now or formerly
of Carrie Hutchinson; thence running along land now or formerly of
Carrie Hutchinson the following three courses and distances: (1)

feet to the approximate center line of a gutter; running thence north-
westerly along the approximate center line of said gutter separating
the premises herein described and land now or formerly of Alvah S.
Terry to a point distant North 54 degrees 13 minutes 10 seconds West

westerly along the approximate center line of the meadow and along

the terminus of the last mentioned course; thence running along the
easterly line of South Harbor Road the following two courses and

feet to a monument; (2) North 1 degree 04 minutes 10 seconds West
41.70 feet to the point or place of beginning.
Together with such rights of way as now exist from the said
premises to the South Harbor Road and all other rights of way ap-
pertaining thereto. Being and intended to be the same premises con-
veyed by GEORGIANNA D. HILL to ANTOINE H. VAN DEN HEUVEL and ELIZABETH
M. VAN DEN HEUVEL, his wife, by deed dated February 28, 1949, and
recorded in Suffolk County Clerk Office on March 1, 1949, in Liber
2926 of Conveyances at Page 511.

near Southold in Town of Southold, County of Suffolk, State of New
York, bounded and described as follows:
BEGINNING at a point formed by the intersection of the
Westerly line of Nakomis Road and a straight line to the East as a
1 continuation of the Northerly line of property of Antoine van den
Heuvel thence Southerly by and along the Westerly line of Nakomis
Road 500 feet more or less by continuing in a straight line to a
point at the foot of the highland, also the property of Antoine van
den Heuvel, thence Westerly 190 feet more or less by and along pro-
perty of Antoine van den Heuvel to a concrete monument, thence
Northerly 414 feet more or less by and along the property of Antoine
van den Heuvel to a point in the Northerly line of property of Antoine
van den Heuvel, thence Easterly in a straight line from same, along
property of Cedric H. Wickham 125 feet more or less to the point and
place of beginning in the Westerly line of Nakomis Road.
Together with any and all rights to the use of roadways and
beaches above main high water, jointly owned by the Laughing Water
Property Owners Association, or used jointly by all Laughing Water
Property Owners .
